CITY COUNCIL WORK SESSION MINUTES January 16, 2018 5:30 – 6:30pm 1) Call to Order Mayor Whalen called the meeting to order at 5:30 p.m. Present – Council: Mayor Lisa Whalen, Pam Mortenson, Patricia Thoele, Mike Molitor and Shannon Bruce; Staff: City Administrator Michael Barone, Finance Director Brian Grimm, Community Development Director David Abel, Public Safety Director Paul Falls and City Clerk Kris Linquist; Consultant: Assistant City Attorney Andrew Biggerstaff, Kennedy & Graven and City Engineer Paul Hornby, WSB Engineering. Absent: None

2) Code Compliance/Enforcement Options Biggerstaff overviewed the staff report found in the January 16, 2018 Work Session packet. Highlights included:  Nuisance Abatement Proceedings  Public Nuisance  Private Nuisance  Hazardous Building Proceeding  Enforcement of Zoning Code  Towing Authority  Eminent Domain  Other Agency Involvement There was discussion regarding multiple options as to how the Council would like to proceed with the property on Deer Creek Rd along with potential costs associated with each options. There was discussion on the City Zoning Code and possibly changing the zoning code. The property owner claims that they are not operating a business out of their home. There was discussion on Eminent domain. This option is highly regulated by state statutes. This would probably not be an option for this situation. There has been one formal complaint and many verbal complaints for the address located on Deer Creek Rd. There was further discussion on a public nuisance avenue and the fees associated with the process. There was discussion on having the neighbors work it out amongst themselves. Fred Holzheiser, 1295 Preserve Blvd, Minnetrista – commented that the neighbors have tried speaking with the property owner and at times he is an aggressive man. Council directed the Attorney’s office to draft a letter to the property owner on Deer Creek Rd.

3) Halstead Road Update Hornby overviewed the staff report found in the January 16, 2018 Work Session packet. Highlights included:  Mini-roundabout discussion with alternatives  Guardrail Discussion There was discussion on the new mini-roundabout and the possibility of educating people on how to use the roundabout. The construction is not complete for this project and will be done this coming spring. It was noted that reconstruction of this intersection may not be covered by State funding and may cause a loss of funding for the constructed and modified improvements. There was discussion on the school bus making a three point turn around in the roundabout. Hornby stated that there has been discussions with the bus company about not performing such actions. There was discussion on the guardrails and the need for them. Thoele commented that she had gotten some complaints from the neighbors regarding how they thought the guardrails were not pleasant to look at. Council directed staff to look into plantings that would be aesthetically pleasing to the neighborhood with minor financial impact.
