“The World of Active Shooters – Are You Prepared?” Over the past 15 years our comfort level with feeling safe in society has changed. From the events that occurred in Columbine to 9/11 to Virginia Tech to movie theatre shootings, and now to Sandy Hook our safe "Mayberry" world is gone. The reality is that we now have a duty to make sure that all buildings that occupy people have safety plans that are practiced by building managers and the people in those buildings. Active shooters encompass many potential individuals and can happen anywhere at any time. The question now should be are we prepared? If not, where do we need to start?

Breakout Session I: (8:30 AM – 9:45 AM) Health Care Reform Update The latest news from Washington is a delay in the implementation of the penalties on large employers for any failure to provide “qualifying coverage” under PPACA for their full-time employees. The session will discuss the background of PPACA, the basics of compliance for employers, the impact of the delay and what employers need to do to prepare for 2014 in any event. Supply Chain Risk Quantification As supply chains continue to broaden their reach around the globe, it is easy to become overwhelmed by their complexities. Exploring ways to augment information gathering with subject matter expertise (SME) can greatly improve risk intelligence, avoid analysis paralysis and improve your organization response to potentially catastrophic exposures. Our role as Risk Manager is ever changing and will continue to be challenged to adapt and improve our communication of timely supply chain risk intelligence and risk transfer opportunities. Student Session This is an educational session for college students that will include a panel of four successful insurance professionals who will speak about their start and career development. Student Q&A will follow panel discussion. Breakout Session II: (10:15 AM– 11:30 AM) “Space Age Times – Stone Age Minds” Workplace Violence & Corporate Espionage Despite all of our technological advancements, human beings are still driven by basic human desires, even when it comes to violence, retaliation, corporate espionage, or a host of other criminal manifestations in the workplace. Even with the best of intentions and technology, it is understanding these human dynamics that can enhance ongoing efforts to make workplaces and outside sales/service personnel safer as well as reducing risks and claims of negligence against employers resulting in higher insurance premiums if not civil judgments. Presented by: Jeff McKissack, President - Defense by Design

Recent Insurance Litigation – Additional Insured and Loss Payable Clause Two recent judicial decisions, one in the United States and the other in the United Kingdom, may impact your current insurance coverage. The Ranger Insurance, Limited v. Transocean Offshore Deepwater Drilling, et. al. v. BP P.L.C., et. al. decision should be considered by risk managers when reviewing the additional insured wording in their insurance policies to prevent “additional insureds” from accessing your coverage beyond those liabilities “assumed” in the service agreements and other contracts. In the secondever public decision on the Bermuda Form of liability insurance (and the first-ever substantive decision), an English court in Astrazeneca Insurance Company Limited vs. XL Insurance (Bermuda) LTD, et. al. held that a policyholder must prove that it was “actually liable,” not simply “arguably or allegedly liable” in order to recover settlement payments and defense costs. The implications of this decision should be considered when reviewing Bermuda Form insurance policies and handling claims that might impact Bermuda layers.
