Joint Declaration of Intent of the Federal Ministry for the Environment, Nature Conservation, Building and Nuclear Safety (BMUB) of the Federal Republic of Germany and the Ministry of the Environment (MINAM) of the Republic of Peru regarding Interinstitutional Cooperation in the Field of Environmental Protection, Climate Change and Sustainable Development

The Federal Ministry for the Environment, Nature Conservation, Building and Nuclear Safety (BMUB) of the Federal Republic of Germany and the Ministry of the Environment (MINAM) of the Republic of Peru (hereinafter referred to as the “two sides”) intend to take into account that the international commitments in relation to climate change, achieving sustainable development thus protecting the environment and caring for the common heritage of mankind, have been recorded in many international fora and conventions. The two sides assume the importance of addressing environmental issues, climate change and sustainable development at the multilateral, regional and bilateral levels to effectively address the global challenges. They understand that strong action is needed to combat climate change, to protect the environment and to improve environmental quality. They acknowledge the ongoing fruitful cooperation between Germany and Peru, including the substantial cooperation between the Peruvian authorities and the Federal Ministry of Economic Cooperation and Development and the Federal Ministry for the Environment, Nature Conservation, Building and Nuclear Safety in the field of environmental protection, climate change and sustainable development. They believe that their collaborative efforts will be of great benefit for the two sides. And they continue to take into account the Memorandum of Understanding on cooperation regarding Clean Development Mechanism project activities and climate policy issues between the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety of the Federal Republic of Germany and the National Council of the Environment of the Republic of Peru, signed on 8 November 2006. The two sides have therefore come to the following understanding regarding interinstitutional cooperation in the field of environmental protection, climate change and sustainable development:

I. OBJECTIVE This Joint Declaration of Intent aims to promote, strengthen and further develop cooperation between the two sides in the field of environmental protection, climate change and sustainable management of natural resources through the implementation of joint activities and projects that are identified on areas of common interest on the basis of equality and mutual benefit.

II. AREAS OF COOPERATION To achieve the objective of this Joint Declaration of Intent, the two sides declare their willingness to carry out cooperation activities in the following areas: 1. Climate policy with carbon market mechanisms being one special focus; 2. Climate change with special focus on REDDplus and sustainable management of forests, including forest and land restoration as part of a sustainable landscape approach; 3. Adaptation to climate change, especially ecosystem-based adaptation; 4. Environmental technologies, including mining and resource efficient production; 5. Air quality, air pollution monitoring; 6. Sustainable waste management; 7. Sustainable water management, wastewater treatment and water provision; 8. Sustainable management of national parks and protected areas; 9. Nature conservation and protection of biological diversity; 10. Reducing emissions from deforestation and forest degradation and the role of conservation, sustainable management of forests and enhancement of forest carbon stocks; 11. Protection and sustainable management and use of natural resources including raw materials; 12. Awareness raising, education and capacity building; and any other area in which the two sides intend to do so. III. FORMS OF COOPERATION As far as the means, resources and requirements of the participants may permit, the cooperation in the fields stated in section II of this Joint Declaration of Intent may take the following forms: 1. Technical advice, exchange of experiences and best practices; 2. Encouragement of the cooperation between companies, public and private organisations; 3. Joint organisation of seminars, workshops and meetings attended by scientists, experts, regulators, civil society and others concerned; 4. Exchange of environmental documentation, information and literature related to the areas comprised in section II of this Joint Declaration of Intent; 5. Cooperation in relevant regional and international fora; 6. Other forms of cooperation as the two sides jointly intend. IV. MONITORING AND COORDINATION MECHANISM The division responsible for cooperation with the Republic of Peru within the Federal Ministry for the Environment, Nature Conservation, Building and Nuclear Safety (BMUB) of the Federal Republic of Germany and the International Cooperation and Negotiation Office of the Ministry of the Environment (MINAM) of the Republic of Peru should act as focal points responsible for the implementation of this Joint Declaration of Intent and for the coordination of bilateral cooperation and organization of relevant activities according to mutual demands. This Joint Declaration of Intent should be implemented in a manner consistent with the laws

and regulations of the two sides. V. FINANCIAL ARRANGEMENTS Each of the two sides intends to meet, to the extent possible, the expenses of their participation in the activities undertaken within the framework of this Joint Declaration of Intent, in accordance with their own financial and budgetary processes and subject to the availability of funds. The two sides may come to the understanding to apply together for financial resources of third organizations. VI. SCOPE This Joint Declaration of Intent is not designed to create international legal obligations to the Ministry of Environment (MINAM) of the Republic of Peru or to the Federal Ministry for the Environment, Nature Conservation, Building and Nuclear Safety (BMUB) of the Federal Republic of Germany. VII. AMENDMENTS The two sides may at any time request in writing an amendment of all or any part of this Joint Declaration of Intent. VIII. COMING INTO EFFECT AND DURATION This Joint Declaration of Intent will come into effect on the date of its signature. It should remain in effect for a period of five (05) years, and continue to be effective for a subsequent period of five (05) years, unless one of the two sides informs the other in writing, six (6) months in advance, of its intention to end the cooperation according to this Joint Declaration of Intent.
