WHEREAS, the Valley View Boys Soccer Team won the District Championship for the 4
th
consecutive time and went undefeated during district play; and
WHEREAS, the Valley View Boys Soccer Team made a second consecutive trip to the State
Soccer Tournament making it all the way to finals. With this accomplishment, Valley View became the first valley school to make the State Tournament on back to back years; and

HEREAS, during this season, several team accomplishments were achieved. The Hill Country Shootout Champions, District Championship, Bi-district Champions, Area Champions, Sectional Champions, Regional Quarterfinal Champions, Regional Champions, State Semifinal Champions, and State Runner ups; and
WHEREAS, individual accomplishments are ALL STATE SELECTIONS: Jose G. Flores, Max
Jara, and Erik Martinez. ALL VALLEY MVP SELECTIONS: Jose A. Soto, Erik Martinez, and Damian Magallan, Coach of the Year. And ALL DISTRICT SELECTIONS: Jose A. Soto, Jose Guerrero, Max Jara, Erik Martinez, Jose G. Flores, Eduardo De la Garza, Mario Gomez, Christian Tobias, Saul Juarez, Jose Rodriguez, and Daniel Lince.

City Engineer’s Report June 17, 2014 Design Projects: City of Pharr Bicycle Accessible Improvements Engineer has completed 90% of the design; 90% has been submitted to TxDOT for review. Owassa Road Sections of the Environmental Document have been submitted to TxDOT for review. TxDOT approved the schematics, which is a four lane street with a center turning lane. International Trade Center – Bridge Architect has submitted 90% of construction plans. A meeting with staff was held this month to review 90% plans. South Pharr Sidewalk Improvements Project Plans and specifications are 100% complete. Bid opening has been scheduled for July 30, 2014. Construction Projects: Pharr Commercial Park Phase I Contractor has completed construction. Pharr Produce District Subdivision Phase I The final entrance is waiting for AT&T to relocate pedestal. Project is 100% complete and final inspection was held this month. Magic Valley Electric is currently working on installing electrical service. Northside Park – Special Needs Contractor has completed concrete basketball courts and is currently working on the restroom facilities and concrete sidewalk. Moore Road Driveway at Pharr Police Department Contractor has finished installing the new inlets & storm manhole and will begin working on the subgrade and base material for the driveway.

CITY OF PHARR RESOLUTION NO. ______________
On June 3, 2014, at the regularly scheduled meeting of the City Council of City of Pharr, a motion was duly made and seconded to resell properties described on the attached list, which were acquired by the City through previous tax foreclosure proceedings. The properties were sold in accordance with Texas Tax Code Ann. §34.05. Discussion was then conducted, and upon completion of the same, the Mayor of City of Pharr called for a vote onthemotion, and the same waspassed by majority. Now therefore: BE IT RESOLVED that the City Council of City of Pharr approved the bids received on the properties described in the attached list and authorizes the Mayor of City of Pharr to execute tax resale deeds conveying the approved properties.

MARKETING AND PROPERTY ACQUISITION AND USE AGREEMENT
This agreement is made by between INMOBILARIA JUGAS, S.A. DE C.V. (hereinafter “JUGAS”) a Mexican formed entity, and CITY OF PHARR, a political subdivision of the State of Texas (hereinafter "City") also cumulative known as “Parties.” The parties agree that Jugas shall provide its corporate formation filings, deed records, and financial records pertaining to the terms of this agreement and amendments thereto, as well as, any resolutions and minutes authorizing approval of the terms and conditions contained within this agreement. 1. Terms. The following terms conditions shall be completed within the effective term of this agreement: (a) Jugas and City agree to undertake joint marketing efforts with City to generate new logistical business. These joint marketing efforts may include, but are not limited to: joint advertising activities aimed at promoting land routes; joint exhibitor booths at produce, logistics, and manufacturing events; joint press conferences; editorial placement, and other public relations materials or activities of mutual interest. (b) Jugas and City agree to share data that may be helpful in forecasting future trade flows, developing marketing strategies and obtaining additional knowledge about the logistical market. The parties may also exchange information that may include, but is not limited to transit information, type of commodities, cargo tonnage, value of cargo, future plans, and liner services. All data interchange should be in the premise of business confidential security of both parties. The parties have a mutual understanding that the Pharr Bridge is subject to the Public Information Act and other national securities’ laws and regulations that may be require disclosure of certain data in their possession. (c) The parties agree to exchange information contained in studies performed by them or by their consultants or representatives that may be of interest to the other party. The information contained in the studies shall be treated in a confidential manner. The parties may also elect to perform joint studies that address their areas of respective interest. All information exchange is subject to the restricted privacy policy of both parties and its related third parties. (d) The parties may elect to share information regarding improvements and/or modernization efforts being undertaken and which may have as a purpose and need of satisfying an increase in demand or improved customer services. (e) City shall pay Jugas $300,000 for donation of land sufficient to carry out the purpose of development and construction for the addition of the following development by Mexican authorities: (i) two (2) new northbound lanes and two (2) new entrance booths at the Mexican Port of Entry of the Pharr-Reynosa International Toll Bridge; (ii) One (1) additional southbound exit lane from the Mexican Port of Entry of the PharrReynosa International Toll Bridge. The amount to be paid shall be deposited in accordance with the requirements of banking as stated in this agreement. All funds to be paid shall be paid in accordance with an amortized percentage of completion as approved by City. 1
(f) It is further agreed by the Parties that Jugas will pay for and develop specific assets just south of the Pharr-Reynosa International Toll Bridge that will collectively be known as “Centro Logistico: REX - PHARR”. Some of those assets include, but will not limited to: (i) (ii) (iii) (iv) (v) (vi) (vii)
Dry and cold storage warehouse; Dry and cold transfer area; Open transfer/staging area; Truck stop; Gas station; Business office premises; and Money exchange business
2. Other Assets/Banking. (a) The Parties also agree that City will reimburse Jugas an amount to exceed $150,000 for the placement and use of the following for the sole benefit of traffic of the Pharr-Reynosa International Toll Bridge: (i) Two (2) commercial truck scales; (ii) one (1) electric forklift. Jugas shall provide to City, prior to reimbursement, any and all receipts associated with the purchase, installation, and evidence of the full operational satisfaction by City of these items. (b) The Parties further agree that any funds paid by City to Jugas shall be deposited into an account of a domestic banking institution located in the United States to ensure the protection of applicable securities and depository laws. 3. Term. The term of this Agreement shall commence on the 17th day of June, 2014 and shall expire on the 16th day of June, 2019. 4. Termination/Default. Either City or Jugas may terminate this Agreement prior to the expiration of the term with or without cause. Upon termination, any and all financial obligations shall cease; however, Jugas may be required to reimburse City for any prorated fees or expenses paid prior to termination of the month of the termination. Also, upon termination Jugas shall return any funds paid by City for non-completed development, construction, or assets. 5. Applicable law; Venue; Damages and Specific Performance. (a) It is agreed that laws of the United States and Texas shall govern this agreement, and venue shall be agreed to in Hidalgo County, Texas. (b) Either party to this agreement may seek specific performance or an injunction to enforce the terms contained herein or to seek protection of funds. Without waiving any applicable defenses or immunities, the Parties may seek damages including expenses, court costs, and attorneys fees for a breach of this agreement or to interpret the terms and conditions herein. 6. Independent Contractor/Non-Disclosure. The parties stipulate and agree that: (a) Jugas shall be an independent contractor for all purposes under this Agreement, and as such, no part of Jugas’s work-product, methods, or process provided to City shall be directed or controlled by City; (b) Jugas is not prohibited from providing services to any other entity or person; (c) Jugas will provide its own 2
equipment, supplies, and necessities to perform under this agreement; (d) Jugas acknowledges and agrees that it may be personally liable for self-employment taxation; (e) Jugas is not entitled to any benefits as may be applicable to the personnel of the City; (f) Jugas further agrees and stipulates that neither it nor any agent, employee, or representative shall disclose or share any information or materials obtained from City or in furtherance of this agreement with any person or third-party including but not limited to any other domestic or foreign municipality unless authorized by City. 7. Modification/Waiver. No modification or waiver of any of the terms and conditions of this Agreement shall be effective unless such modification or waiver is expressed in writing and signed by each of the parties. This Agreement may be amended only in writing signed by each of the parties. No course of prior dealings between the parties and no use of trade shall be relevant or admissible to supplement, explain or vary the terms of this Agreement, whether the same be consistent with the terms of this Agreement or otherwise. 8. Severability. If any provision, or any portion of this agreement is found to be unlawful, void, or for any reason unenforceable, it shall be severed from, and shall in no way affect the validity or enforceability of the remaining provisions of this agreement. 9. Entire Agreement. This document is intended by the parties as the final and binding expression of their agreement and is a complete and exclusive statement of the terms thereof and supersedes all prior negotiations, representations, and agreements and no representations, understandings, or agreements have been made or relied upon in the making of this Agreement, other than those specifically set forth herein. 10. Indemnification.
