CANADIAN NATIONAL EXHIBITION “Contractor Obligations & Operations Guide” The Canadian National Exhibition operates in compliance with all provisions of Ontario’s Occupational Health and Safety Act & applicable Regulations. All contract personnel conducting work or providing services for the CNE are likewise required to work in compliance with provisions of Ontario’s Occupational Health and Safety legislation, and are further required to comply with, and ensure their employees and any other subcontractors or agents working on their behalf, comply with our Corporate Health and Safety Policy, and written safe work procedures. This correspondence is provided as part of our “briefing” for contractor personnel that will include details of our Corporate H&S Policy, and applicable safe work measures. PROJECT HEALTH AND SAFETY MANAGEMENT EXPECTATIONS Contractors, subcontractors and trades are responsible for the administration of their own H&S Program, and for ensuring the safety and health of their own workers, while working on any CNE site or project. Contractors will promptly investigate any accidents, injuries or property damage incidents involving their staff, and will prepare accident reports and statistics, and provide same to us, upon request. Applicable First Aid certification requirements shall be maintained and the names of trained First Aid personnel shall be provide upon request, or posted on site. In the event of an incident incurred by a contractor (or contracted worker) that causes serious property damage, or results in an accident or injury to a worker while working at, or for the CNE, the contractor agrees to be liable for the actions of their staff and any subcontractors as it applies to health and safety compliance in the situation. In the event that the property damage, accident or injury is serious enough to warrant third-party consulting assistance, investigation or audit as may be determined and selected by CNE management, the contractor acknowledges liability in whole, or in part for associated costs, including fees incurred by the third-party investigation, audit, or other appropriate reparation or restoration. Where five (5) or more contract company employees are employed at the CNE, a Health and Safety Representative shall be selected from amongst them to represent the contract workers’ health and safety interests on that project. The representative shall be introduced to our CNE Manager or Project H&S Manager, as appropriate

Contract workers will be acquainted with all potential hazards in the work they are to conduct as well as those on a project where they may be working, including exposure to toxic substances. All contract personnel will have received current WHMIS training and provide proof of training upon request, where there is any likelihood of exposure to any potentially hazardous product. The contractor will provide information, instruction and supervision to their workers to protect their health and safety. Every precaution reasonable in the circumstances will be taken to ensure their safety while working on a CNE project, or site. The contractor will ensure that tools and equipment used on site as well as appropriate protective equipment, materials and devices for the protection of their workers are provided; maintained in good condition; and used as prescribed by legislation, and relevant corporate safety policies and safe work procedures. Contractors will immediately notify the appropriate CNE Manager or Project H&S Manager of any abnormal workplace conditions found during work, and shall notify the CNE immediately of any possible exposures to toxic or controlled products, or of chemical spills that may affect the environment, the work, any workers, or the public. Contract personnel shall properly label, store, and dispose of any potentially toxic or hazardous materials, off site in accordance with the applicable legislation. Contractors shall obtain, prior to commencing work, any necessary Municipal, Provincial or Federal approvals or permits, have them available at the site, and provide them to our representatives, upon request. While working on any CNE project or site, contractors are responsible to ensure that all tools, equipment, scaffolding, powered lift equipment, mobile lift vehicles and cranes and other powered vehicles associated with the work, are operated in accordance with the manufacturer’s instructions and are used, constructed, certified, inspected and mechanically sound, as may be required by applicable Regulation, Standard or Statute. The Canadian National Exhibition reserves the right to STOP the work of any contractor or contractor employees where we deem it to be unsafe, or contrary to our safe work procedures. In these instances, work will not resume until the situation has been corrected to our satisfaction, and that of the appropriate CNE Manager or Project H&S Manager at the work location. This document is considered part of our continued contractual working arrangement, understanding that the Canadian National Exhibition reserves the right to STOP unsafe work at any time, if acceptable health and safety standards are not maintained.

Health and Safety At the 2015 Canadian National Exhibition The Canadian National Exhibition Association reminds all participants in the 2015 CNE that workplace and workers’ safety is everyone’s responsibility. The Canadian National Exhibition Association reminds all CNE Exhibitors, Concessionaires and Suppliers that they are responsible to comply with all applicable Ontario laws and particularly the Occupational Health and Safety Act R.S.O. 1990, Chapter 0.1 and regulations under the Act for both Construction Projects and Industrial Establishments. Parties should have particular regard to the provisions in Ontario Regulation 851 (Amended to O. Reg. 629/05) with respect to Industrial Establishments and Ontario Regulation 213/9 (Amended to O. Reg. 628/05) with respect to Construction Projects. The Act and its regulations are hereinafter collectively referred to as “OHSA”. The Canadian National Exhibition Association will be monitoring and insisting on compliance with OHSA through various methods including: 

CNEA Safety Consultants are authorized to intercede in any practice that in their opinion may contravene OHSA or compromise worker safety or the safety of others in the area. Work will be suspended until the safety concern is remedied and documented.



All exhibitors, concessionaires, and suppliers are reminded that certain areas during the set-up of the CNE may be deemed to be safety zones where personal protective equipment is mandatory. In addition “Construction Projects” may also exist during the move-in and move-out of the CNE where personal protective equipment is mandatory as per the OHSA. Only exhibitors, concessionaires, suppliers or their workers having business in these areas may enter these sites and must have proper personal protective equipment required under the OHSA. These zones or areas will be identified and cordoned off as per the OHSA. Persons found in these areas not complying with the above will be immediately removed.

It is the responsibility of all exhibitors/concessionaires to ensure that their staff are properly trained and aware of the appropriate safety responsibilities pertinent to their tasks and as outlined in the OHSA. 

The Canadian National Exhibition Association requires that all exhibitors/concessionaires acknowledge this policy and return the attached form stating that they have read and will ensure the implementation of these requirements.

Without limiting the generality of the foregoing, all Exhibitors, Concessionaires and Supliers shall ensure the following:  

 

That all persons comply with the OHSA That all persons involved in the erecting and dismantling of the show are competent to perform their assigned duties, i.e. they have training and knowledge in the legal and practical safety requirements relevant to their work That workers are provided with information, instruction and supervision to protect the health and safety of the worker That prescribed safety equipment (safety shoes-steel toe, eye protection, hearing protection, gloves, hard hat, etc.), materials and protective devices are maintained in good condition. Notwithstanding prescribed safety equipment, it is noted that working in sandals/flip flops/open-toe shoes/bare feet, etc. is strictly forbidden in all areas of the show floor during move-in and move-out That the equipment, materials and protective devices provided are used as prescribed That every precaution reasonable in the circumstance is taken for the protection of a worker That no person under the age of sixteen (16) years of age will be admitted or permitted in any area designated as a Safety Zone.

2015 Health & Safety Acknowledgement Form I, the undersigned, acknowledge that I understand the attached Health & Safety document. I agree to comply with and abide by all statutes and regulations that establish safety requirements, including, but not restricted to the Ontario Occupational Health & Safety Act, R.S.O. 1990, c.0.1 as amended. I also acknowledge that any employer (contractor) is required by Reg. 1101 to provide first aid provisions, and have a First Aid trained worker (to the standards required of the Regulation) in the immediate vicinity of the provisions. I will also cooperate with CNE Management in the enforcement of safe working conditions. In the event of a charge, prosecution, or any other legal proceeding arising out of or related to the Ontario Occupational Health & Safety Act, R.S.O. 1990, c.01 as amended, as an exhibitor/concessionaire, I agree to be liable for the actions of my staff and contractors as it applies to the situation.
