Card Key Use Agreement
PERMISSION FOR USE. WCA hereby grants permission to the above named Assignee (resident/tenant/owner) for the use of the East West Legacy Park marina and/or bathrooms, to be accessed by use of a WCA-programmed card key. The WCA may, at its discretion, revoke access to any or all facilities via the issued card key at any time. ASSIGNMENT. The right to use of the issued card key is granted to the Assignee, his/her immediate family members living full-time at the property address named herein, and by accompanied guests of the Assignee. The right to use is not transferrable. Violation of this provision shall result in immediate termination of use of the card key and/or permanent loss of card key priveleges in the future, at the discretion of the WCA. Use of the card key by any other person is not permitted. Assignee shall also be responsible for any damage to the facility that can be determined to have occured while the Assignee’s card key was in use at that facility. Card key use dates and times will be tracked by the card key software. USER STATUS. Assignee must be a Member in good standing of the Woodlake Community Association, Inc. during the use period. A Member in good standing is a Member who is not delinquent in payment of assessments, boat storage/registration fees, or other fees, or is not in violation of the rules and regulations of the Covenants of the Assciation. USE PERIOD. The period of use for the issued card key is one year, to commence on March 1 and end on the last day of February. For card keys requested after March 1, the period of use will commence on the date of issue and end on the last day of February of each year, and the use fee will be reduced or pro-rated only in the event that fewer than ten (10) full months remain in the agreement period. USE FEE. A fee of $75 shall be assessed for first-time registration and issue of the card key; thereafter, the fee shall be $50 per year and shall renew automatically, as described below in “RENEWAL.” Should the renewal fee be changed at any time, Assignees will be notified, in writing, 60 days prior to the renewal date. A fee of $75 will be charged to replace a lost, stolen, or damaged card, and the previously issued card will be deactivated. RENEWAL. Card key renewal will automatically occur on March 1 of each year for an additional one (1) year, upon payment of the then applicable use fee. If the Assignee has one or more boats registered with WCA, the renewal fee will be included as a line item on the Assignee’s annual boat storage/registration invoice, with payment due in full no later than March 1. Assignees who do not have a boat(s) registered with WCA will receive a separate invoice, mailed February 1 (or the first business day of February), with payment due in full no later than March 1. DEFAULT. Payment in full for card key renewal must be received no later than close of business at 5:30 p.m. on the last business day of February, in the WCA office located at 14900 Lake Bluff Parkway, Midlothian, VA 23112. Card key accounts that are not paid in full by that date and time shall be deactivated, and a $20 fee will be assessed for reactivation. TERMINATION. The WCA may terminate Assignee’s use of the card key in the event that any of the rules of this agreement are violated. Additionally, WCA may terminate the agreement with or without cause by providing ninety (90) days written notice to the Assignee. LIABILITY. WCA does not assume any liability for risks associated with the use of the facilities when accessed via Assignee’s card key. Assignee will indemnify and hold harmless the WCA, its officers, directors, agents, and employees against any and all claims, causes of action, fines, penalties, damages (including consequential damages), losses, connection with or arising from use of the facilities when accessed via Assignee’s card key. In consideration of the privilege of access via card key to the East West Legacy Park bathrooms and/or marina, I hereby acknowledge that the WCA accepts no responsibility for the safety and welfare of myself or any member of my group. I also acknowledge that the WCA makes no guarantee as to the condition of the property or as to the safety of the use thereof. In further consideration of such privilege, I for myself, my heirs and personal representatives, hereby assume all risks associated with such use, and release the WCA from all liability for any and all loss, injury, or damages to person or property. Furthermore, I have read, understand, and agree to abide by the WCA rules and regulations stated herein and release the WCA from any liability incurred from enforcing these rules and regulations.
