CITY OF DERBY LEASE AGREEMENT COON HOLLOW PICNIC GROVE AND PAVILION This agreement is entered into by and between the CITY OF DERBY (Derby) and Name of Organization or Name :

Derby shall allow Lessee exclusive use of the Coon Hollow Picnic Grove and Pavilion between the hours of 9:00 a.m. and 7:00 p.m. on the date of event indicated above. Lessee shall pay to Derby the sum of: Derby Resident or Derby Organization
$150.00 (for park use) – due with contract signing. $250.00 (for security) – due with contract signing. $400.00 Total
Non Resident or Organization
$400.00 (for park use) – due with contract signing. $400.00 (for security) – due with contract signing. $800.00 Total
Lessee shall be responsible for the actions of all guests and persons attending the above-described event. The security deposit shall automatically be forfeited to the City of Derby if the Derby Police Department responds to two documented noise complaints during the event. Also, the security deposit shall automatically be forfeited to the City of Derby if the Picnic Grove has not been vacated by 7:00 pm on the day of the event. Lessee shall pay the cost of any damage caused to say premises during said event. Theses damages may include, but are not limited to, any damage caused to the plumbing in the rest room facilities at said premises. In the event Derby must commence legal proceedings in order to secure payment of any damages to said premises, the lessee shall pay for costs of collection including Attorney fees. It is expressly understood that the City of Derby assumes no liability for any activities conducted on said premises during the time of said event. It is further understood and agreed to by the Lessee that, in signing this document that he/she on behalf of the Lessee, waives any or all rights of claim for any injuries incurred by participants at said event. PAYMENT: 2 checks made payable to the City of Derby – (One for the Rental Fee and One for the Security Deposit) MUST BE RECEIVED IN FULL, WITH THE SIGNED CONTRACT TO SECURE A VALID RESERVATION. FULL REFUND WILL BE ISSUED ONLY WITH A ONE-MONTH NOTICE OF CANCELATION. After signing this agreement mail the original AND 2 checks made payable to the City of Derby (No Cash Please) to: Derby Public Works Department, 49 Coon Hollow Road, Derby, CT. 06418 Keep a copy of this Agreement for your records.
