Customer Service Agreement Snow Removal Contract 2014/2015 Season

After a minimum 2” snowfall, Aqua Pro Snow Division (hereby known as “contractor”) will remove the snow from the below agreed areas beginning as soon as possible after each snowfall. In the event that it snows on Christmas Eve or Day or New Year’s Eve, snow removal may be delayed.

“Very heavy and continuous snowfall” – During a heavy and continuous snowstorm, we shall remove the snow on one occasion during the storm and one further occasion at the end of the storm. Each visit to the property to clear snow is a chargeable visit visit. In the event of a severe storm (12” or more) we will remove the snow as quickly as possible while maintaining the safety of our operators. It is also agreed that during these heavy conditions, more time is required to complete our route. It is further agreed that the undersigned will have no obstacles in the area to be plowed as the Contractor is not liable for any damages. We also assume no liability for any injury resulting from a slip and fall.

Scope of Work--- Contractor will plow when 2” of snow has accumulated. Snow

events over 6” shall constitute an additional charge. (We will have to plow twice, or it takes twice as long to remove) Often times roadway snow plows will fill driveway aprons with an excess rift of snow after driveways have been cleared causing a hazard or inconvenience. If this occurs, kindly contact us and we will attempt to clear this within a reasonably agreed upon time frame.

Property Damage – The undersigned will report, in writing, any property damage cause by the Contractor within 48 hours. The Contractor will repair any timely and reported property damage in the Spring of which this contract was signed and the property damage occurred. Notwithstanding anything herein to the contrary, the contractor will have no obligation, and the undersigned waives any damages for any property damage not timely and properly reported.

Limitation Limitation of Liabilty – The contractor will exercise reasonable care to avoid damage to pavement, curbs, trees and shrubs. However, the contractor is not responsible for any damage to landscaping caused by the piling of snow; damage to items that are snow covered or not visible; damage caused by equipment when trees, shrubs or sidewalk areas are not reasonably delineated due to snow accumulation; personal injuries resulting from slip and fall accidents and/or acts of God including but not limited to extraordinary weather conditions. The undersigned is aware that plowing may not clear their property to the bare pavement and that slippery conditions may prevail even after plowing. The contractor assumes no responsibility for accidents as a result of this naturally occurring condition. Sidewalk defined - Entry to front of house, not to include boulevard walks. Either party may cancel this agreement at any time with a ten (10) day advance written notice. Cancellation date will be the day such notice is received. In the event of cancellation, the undersigned will be responsible for all costs of services rendered up to the cancellation date. A final invoice will be sent to the undersigned within 30 days of the written notice being received. There will be no refunds issued for unused time or services set forth by this agreement.

(De-icing material is of the contractors’ choice. Ice melt is applied as a courtesy service and contractor assumes no liability as to its effectiveness, damage caused or slip and fall injury that may occur)

**Contractor will not plow or salt within 3 feet of any parked vehicles, equipment or other obstructions in the areas agreed to be cleared. Please attempt to move obstructions prior to our services being completed. The contractor is not responsible for damage to pavement or other surfaces contracted for the plowing of snow. Damage can occur but we will make every reasonable effort to avoid this. Depressed areas of the pavement may accumulate snow that may not be able to be removed as well as snow that has been packed down by vehicle or foot traffic. The contractor is not responsible for these accumulations that cannot be removed, but we will make every effort to remove them. The undersigned is responsible for boundary markers or flags (Contractor can provide them for a nominal fee). Removal of snow piles are not available through this contractor. Please contact a snow REMOVAL contractor for this.
