DEED THIS DEED OF CONVEYANCE, made and entered into by and between CHARLES B. FRALEY, single, of P.O. Box 718, South Shore, Kentucky 41175, party of the first part, and CHARLES B. FRALEY, of P.O. Box 718, South Shore, Kentucky 41175, party of the second part, WITNESSETH: That for and in consideration of the sum of ONE ($1.00) DOLLAR, cash in hand paid, and other good and valuable considerations, the receipt of which is hereby acknowledged, the party of the first part has granted, bargained and sold, and by these presents does hereby grant, bargain, sell and convey unto the party of the second part, his/her heirs and assigns, forever, the following described real estate lying in Greenup County, Kentucky, to-wit: Tract I: Beginning at a stake on the South side of a lane, corner to Frank Hardin; thence along the west side of a 25 foot lane S. 22 degrees 35 minutes East 672 feet to a creosote post, corner to C.B. Kiser; thence with C.B. Kiser's line S. 77 degrees 16 minutes West 603.10 feet to a point in the Chesapeake and Ohio Railroad's East right of way line: thence along said East right of way line North 21 degrees 25 minutes West 400 feet, North 13 degrees 17 minutes West 268.20 feet to a stake on the South side of a lane: thence along the South side of said lane North 77 degrees 16 minutes East 556.30 feet to the place of beginning, containing 8.90 acres, more or less. Tract II: Beginning at a stake in the East right of way line of the C&O Railroad corner to Ballard May; thence with the line of said Ballard May, North 80 degrees 12 minutes East 780.10 feet to a point, corner to Frank Hardin; thence with the line of said Frank Hardin, South 12 degrees 09 minutes East 1122.00 feet to a stake in the North side of a lane; thence along the North side of lane, South 77 degrees 16 minutes West 869.60 feet to the East line of the right of way of the C & O Railroad; thence along said East right of way line North 13 degrees 17 minutes West 321 feet, North 8 degrees 29 minutes West 428.60 feet; North 3 degrees 35 minutes West 226.50 feet, North 0 degrees 50 minutes West 196.20 feet to the place of beginning, containing 22.10 acres, more or less. Tract III: Beginning at a point in the North side of a lane, corner to Frank Hardin; thence with the line of said Frank Hardin, North 19 degrees 33 minutes West 1117 feet to a point; thence North 80 degrees 12 minutes East 1671.90 feet to the West side of a lane; thence North 80 degrees 12 minutes East 16 feet to the East side of lane and continuing on 590 feet in all 606 feet to t a point in the West side of the river; thence along the West side of the said river South 17 degrees 20 minutes East 1053.00 feet to the line of Mrs. William Scott McKell; thence along the line of said McKell South 76 degrees 40 minutes West 272.60 feet to an elm tree 30 inches in diameter, 79 degrees 44 minutes West 412.30 feet to a point on the East side of a 16 foot lane; thence crossing the said lane and with the North side of another lane South 78 degrees 49 minutes West 802.60 feet and South 78 degrees West 750.80 feet to the place of beginning, containing 54.70 acres, more or less, subject to the aforesaid 16 foot lane (Plat Book 2, Page 145, Greenup County Court Clerk's Office.) Tract I, Tract II and Tract III containing in all 85.70 acres, more or less. Tract I, II and III being the same real estate conveyed by W.F. Hardin, et al, to Anthony D’Antuono and Lewis D’Antuono by Deed dated July 8, 1954, recorded in Deed Book 140, Page 459 and thereafter conveyed by Lewis D’Antuono, et ux, to Anthony D’Antuono and Pauline D’Antuono by Deed dated April 7, 1956, recorded in Deed Book 148, Page 235, all in the Office of Greenup County Clerk.

It is the intention of this conveyance to convey to the grantee herein whatever riparian rights grantor has immediately Northeast of that part of said tract which binds upon the Ohio River Bank and between the side lines thereof as projected. Tract IV: Farm #4 in the Subdivision of Tract No. 3, W.F. Hardin Farms, Plat recorded in Plat Book 2A, Page 145, Greenup County Plat records. Beginning at a creosote post near a barn; thence N. 12 degrees 9 minutes W. 1122 feet to a creosote post in the line of Ballard May; thence with the May lin S. 80 degrees 12 minutes E. 182.7 feet to a creosote post; thence leaving the line of Ballard May S. 19 degrees 33 minutes E. 1117 feet to a creosote post in a roadway; thence S. 77 degrees 44 minutes W. 330.9 feet to the beginning, containing 6.6 acres, more or less. Being the same real estate conveyed by Elic Hunt, et ux, to Lewis D’Antuono and Kathryn D’Antuono, his wife, and Anthony D’Antuono and Pauline D’Antuono, his wife, by deed recorded in Deed Book 146, Page 311, and thereafter conveyed by Lewis D’Antuono and Kathryn D’Antuono, his wife, to Anthony D’Antuono and Pauline D’Antuono, his wife, by Deed recorded in Deed Book 148, Page 235, all in the Office of Greenup County Clerk. Anthony D’Antuono having died intestate 9/2/72 and portions of his interest in the above described real estate having passed to Pauline D’Antuono by virtue of the survivorship deed referenced above, and other portions of his interest in the real estate having passed to his heirs at law, Pauline D’Antuono, spouse and Anthony David D’Antuono, son, and Donna Jean Fraley, daughter. For Affidavit of Descent of Anthony D’Antuono see Deed Book _____, Page _____, in the Office of Greenup County Clerk. Thereafter, Pauline D’Antuono having conveyed portions of the above described real estate or her interest therein to David D’Antuono (aka Anthony David D’Antuono), her son and Donna Fraley (aka Donna Jean Fraley), her daughter, by Deeds recorded in Deed Book 334, Page 566; Deed Book 335, Page 249; Deed Book 345, Page 405; Deed Book 351, Page 323. Pauline D’Antuono having died testate and devised her interest in all unconveyed portions of said real estate to Anthony David D’Antuono, her son, and Donna Jean Fraley, her daughter, by Will recorded in Will Book 41, Page 285 and thereafter Anthony David D’Antuono having died testate and devised all his interest in the above real estate to Donna Jean Fraley, his sister, in Will Book 44, Page 394, and thereafter Donna J. Fraley, who is the same personal also known as Donna Jean Fraley having died testate February 7, 2009, as the full owner of the above described real estate and conveyed all of her property, including the above described real estate to Charles B. Fraley, her husband, in Will Book 57, Page 568, all in the Office of the Greenup County Clerk. The above described real estate is subject to a flowage easement in favor of the United States of America recorded in Deed Book 192, Page 489, in the Office of the Greenup County Clerk. This is a transfer of the present owner to himself in order to document record title, there is no monetary consideration for the conveyance herein. The Fair Market Value of the conveyance herein is $______________.
