TITLE
Construction Industry Experience Rating (“ER”) Program 2.
ISSUE
At issue is whether WorkSafeBC should continue the Construction ER Program, or conclude it and move construction industry firms into the ER plan applied to all other industries. Also at issue is if WorkSafeBC was to conclude the Construction ER Program, whether construction firms should be moved into the ER Plan with no transition, or if construction firms should be stepped into the ER Plan. 3.
BACKGROUND
3.1
Law and Policy
Section 42 of the Workers Compensation Act (“Act”) authorizes WorkSafeBC to adopt a system of ER. Under the authority of this section, the Panel of Administrators (“POA”) approved the ER Plan and the Construction ER Program. Assessment policy outlines the main features and principles of the ER Plan.1 3.2
The Experience Rating Plan
The ER Plan adjusts individual firms’ base rates based on their claim cost experience, relative to the claim cost experience of other firms in their industries. A firm with lower than average claim costs may receive a discount of up to 50% off its base rate. A firm with higher than average claim costs may pay a surcharge of up to 100% on top of its base industry rate, gradually over time. The ER Plan was introduced on January 1, 2000, replacing the old Experience Rated Assessment (“ERA”) Plan that had discount and surcharge limits of 33.3%. The aim of the ER Plan is to provide employers with an incentive to reduce their claim costs, through return to work and occupational health and safety programs. In 2006 a WorkSafeBC review of the ER Plan demonstrated that: it provides employers with financial incentives and motivation to continue to improve health and safety in the workplace and implement effective return to work programs, and it has addressed the shortcomings identified with the ERA plan and met the objectives outlined in the original policy proposal.

The Construction ER Program
During the 1999 consultations on the ER Plan, the Council of Construction Associations (“COCA”) expressed concerns that the maximum rate modifications of the ER Plan were not appropriate for the construction industry. At its December 1999 meeting, the POA approved an interim ER program for firms in the construction industry. The POA’s Resolution, dated March 15, 2000, authorized a three-year Pilot Program that capped the industry's discounts and surcharges at 33.3%, consistent with the maximum discounts and surcharges of the ERA Plan.2 It also called for industry participation in prevention programs, and an evaluation of the success of the Pilot Program. The POA Resolution that initiated the Construction ER Pilot Program identified several requirements, including: The construction industry must participate throughout the term of the Pilot Program in other WCB initiatives and/or special programs which have the purpose of reducing the frequency and/or cost of work-related injuries, diseases and deaths. All other components of the new ER Plan will apply to firms in the construction industry. The Assessment Department will track what the assessment rates would have been for all firms in the construction industry if they had been subject to ER maximums of a 50% discount and a 100% surcharge. In October 2002, the POA approved an extension of the Construction ER Pilot Program to the end of 2003. This extension was granted to enable WorkSafeBC to evaluate the impact of the Construction ER Pilot Program and to "allow the construction sector employers sufficient time to prepare for the transition to a new ER Plan".3 The Resolution required the Assessment Department to evaluate the Construction ER Pilot Program and report its results to the POA in May 2003.4 The extension also required the Assessment Department, with the assistance of the Policy and Regulation Development Bureau, to consult with stakeholders in 2003 on the Construction ER Pilot Program. On February 17, 2003, WorkSafeBC staff met with the President of the COCA to discuss and identify ways to evaluate the Construction ER Pilot Program. At that meeting, WorkSafeBC and the COCA agreed upon four main questions by which the success of the Pilot Program could be measured:

Did the Construction ER Pilot Program meet the obligations imposed by the POA Resolution that created it? What was the Construction ER Pilot Program’s impact on the construction industry, from both a financial and a workplace health and safety perspective? Is the Construction ER Pilot Program consistent with the principles of ER? What is the preference of the construction industry concerning the Construction ER Pilot Program? To provide the COCA with more time to respond to WorkSafeBC’s 2003 consultation, at its meeting of August 12, 2003 the BOD approved the extension of the Construction ER Pilot Program for a further year to December 31, 2004.5 At its March 2005 meeting, the BOD approved the Construction ER Program, limiting discounts and surcharges available to construction industry firms to 33.3%, effective January 1, 2006. The 2005 BOD Resolution establishing the Construction ER Program set out that:6 Surcharges and discounts for construction industry firms would be limited to 33.3%, consistent with the limits of the ERA Plan that the ER Plan replaced. WorkSafeBC’s Assessment Department would evaluate the effectiveness of the Construction ER Program, and report the results of the evaluation to the BOD by no later than December 31, 2010. The Construction ER Program was “Contingent upon firms in the Construction Sector participating fully in WCB initiatives and/or special programs which have the purpose of reducing the frequency and/or cost of work-related injuries, diseases, and deaths…” WorkSafeBC’s administration would identify firms in the construction industry with significantly higher than average claim costs. The industry will be required to work proactively with WorkSafeBC to improve health and safety in those firms’ workplaces through education and enforcement, with a view to reducing their injury rate and claim costs. 4.
DISCUSSION
The following four sections discuss the questions agreed on by the COCA and WorkSafeBC in 2003 to evaluate the Construction ER Program.

4.1
Does the Construction ER Pilot Program meet its POA Resolution obligations?
4.1.1 Participation in Prevention Programs The original POA Resolution in 2000 required the construction industry to participate in "other Board initiatives and/or special programs which have the purpose of reducing the frequency and/or cost of work-related injuries, diseases and deaths". Since 2000, the construction industry has established safety associations and programs, including: The COCA established the Construction Safety Association of BC (“CSABC”) in late 2002. The CSABC was involved with the development of the Certificate of Recognition (“COR”) program and the Safety Training, Accountability and Recognition (“STAR”) program.7 The BC Road Builders and Heavy Construction Association established the BC Road Construction and Maintenance Safety Network (also called the Construction Safety Network or “CSN”) in December 2001. In addition to developing various workplace safety programs and educational packages, CSN is also a COR certifying partner. In 2010 CSABC and CSN merged to form the British Columbia Construction Safety Alliance (“BCCSA”). The BCCSA is a non-profit safety association that develops health and safety programs, tools and resources for employers and workers in the construction industry. 4.1.2 Addressing Firms with High Costs The 2005 BOD Resolution establishing the Construction ER Program directed that WorkSafeBC would identify construction firms with significantly higher than average claim costs, and that WorkSafeBC would use education and enforcement to assist these firms to reduce their injury rate and claim costs.8 In 2006, WorkSafeBC established the Construction High Risk Strategy, an initiative designed to effect change and reduce injury, illness and death in the construction industry.9 As part of this strategy, WorkSafeBC identifies construction CUs using claim volumes and costs to target areas where better injury prevention outcomes and reductions in claims and claim durations are possible. The Construction High Risk Strategy is a multi-year Prevention Program, and focuses resources on identified high 7

exposure and problem areas within the construction industry. It is based on four key pillars: communication, consultation, education, and compliance. As part of this strategy, WorkSafeBC works with industry groups and firms in high-risk CUs, helping them to increase their compliance with the Occupational Health and Safety (OH&S) Regulation and to reduce claims and the durations of workers’ injuries. The strategy also addresses: Setting goals for site inspections for higher-risk CUs and employers; Awareness campaigns and education on the proper handling and exposure controls for asbestos, silica, and isocyanates; Development of a web portal to reach young and new workers, with material on apprenticeships and exposures to asbestos and silica; Continuing the Crane Inspection Program to improve best practices and ensure the consistent application of regulations and standards; Establishing a residential construction team; and Supporting construction employers by providing information on the Construction Nurse Line, and claims management, duration and return to work programs. While the Construction High Risk Strategy has had some successes, further work is required to help high-risk construction CUs achieve increased compliance with the OH&S Regulation and reduce claims and injury durations. The strategy continues to be a focus of WorkSafeBC’s Prevention Services Division in 2011. 4.1.3 Construction Industry Injury and Cost Rate Performance The following two tables show the changes in the industry’s injury rate and cost rate over the duration of the Construction ER Program, as compared with other industries.10 It is important to note that there are many factors that influence these measures, including: the relative economic performance of the industries, the economy of the province as a whole, changes in the distribution of payroll between industry sectors, changes in medical costs and claim durations, and WorkSafeBC and each industry’s efforts to prevent injuries and return workers to work.

The following points summarize the data from these tables: Both the injury rate and the cost rate for construction have dropped by 39% and 31% respectively over the ten year period, but not at the level of other high-risk industry sectors that are experience rated under WorkSafeBC’s ER Plan. Construction remains a high-risk industry. As of 2009, the construction industry has the second-highest injury rate (4.60 non-health-care-only claims per 100 person-years of employment) and highest cost rate ($2.70 of estimated fully reserved claim costs charged to employers per $100 of assessable payroll) of all industry sectors. 4.2
What is the impact of the Construction ER Program on the industry?
As of the 2011 rate year, the capped discounts and surcharges of the Construction ER Program directly affect almost 4,000 firms, representing about 9% of firms in the

construction industry, and about $1.28 billion in payroll, about 20% of the payroll for the whole industry. The other 91% of firms in the construction industry do not have capped surcharges or discounts, and thus would see the same discounts or surcharges regardless of whether the Construction ER Program was in place. However, these firms are paying premiums at increased base rates as a result of the capped surcharges of firms with higher than average costs, as part of the Construction ER Program. 4.2.1 Cost transfers and cross-subsidization The following table sets out the financial effects of the Construction ER Program over the eleven years it has been in existence. The following points summarize the data from the table: In 2011, there are 3,678 firms with capped discounts, and 259 firms with capped surcharges. If the capping is continued, the number of employers affected will continue to increase each year. Every year the Construction ER Program has been in place, base rates for construction CUs have been increased to account for surcharges that are not collected because of the capping, as illustrated in the bottom row of the table. In 2011, a shortfall of about $2.9 million resulted from capped surcharges (see the

row labelled “Net effect ($ millions)”), and as a result an average of $0.05 was added to the base rate of all construction CUs. The average base rate for all construction industry CUs has declined while the Construction ER Program has been in effect. Many things can affect an industry’s rates over time, including WorkSafeBC’s investment income being returned to employers in the form of lower rates, changes in payroll distribution between low- and high-rated CUs, and overall reductions in claim costs. The following tables show what the rates would have been in 2011 for construction firms with capped discounts and surcharges, if the ER Plan had been applied. The tables show the total number of firms with different discount and surcharge levels, as well as groups of firms with high payrolls in each surcharge or discount category. All of the firms with capped surcharges are paying less than they would under the ER Plan. If the 33.3% limit was removed, the majority of those would see their surcharges increase by up to 16.6%. In both tables, firms with high payrolls (over $2 million) make up a larger proportion of firms with higher discounts and surcharges. This is because ER is more responsive for larger firms, in any given industry. For information on how individual firms are affected by the Construction ER Program caps, see Appendix C. In summary, firms with consistently higher than average claims cost experience do not receive as high a surcharge as they would under the ER Plan. Firms with lower than average claim cost experience do not receive as high a discount as they would under the ER Plan. The number of firms in either of these situations grows each year the Construction ER Program is maintained. Each year it is estimated that up to several hundred more firms would have capped discounts, and up to about 40 more firms would have capped surcharges. Furthermore, WorkSafeBC has increased the base rate for all construction firms each year to cover the premium losses resulting from the Construction ER Program caps. If the ER Plan was applied to the construction industry, firms that are currently protected from surcharges of more than 33.3% would see increased surcharges, while those with discounts limited to 33.3% would see increased discounts. In addition, WorkSafeBC would no longer need to raise base rates to accommodate for premium shortfalls stemming from capped surcharges. 4.2.2 Sensitivity to firm size Until 2010, the most significant impact the Construction ER Program limits had on small construction firms was the increase to their base rates each year to accommodate for lost revenues caused by capped surcharges.12 However, by 2010 over 2,500 small firms had calculated discounts in excess of 33.3%. Firms with capped discounts pay higher base rates and lose part of the discount they would earn under ER to subsidize the costs of firms with capped surcharges. In addition, about 700 additional firms have been capped at the 33.3% discount for 2011, and it is anticipated that the number of firms at capped discounts will grow by a similar amount in future years. A prevalent misconception is that removing the 33.3% limits would expose construction firms, particularly smaller firms, to unreasonable rate changes if they were to have a single claim. The ER Plan protects small firms from significant changes to their discounts – only sustained claim cost trends can cause a small firm to lose its discount. For example, if a small firm with a 2011 experience rating discount of 36% had a 2010

claim with costs of $6,000 (or any higher amount), the firm’s 2012 discount would drop, but it would still retain a 29% discount. The ER Plan was designed to be sensitive to firm size. Unlike the pre-2000 ERA Plan, which offered larger discounts and surcharges only to larger firms, the ER Plan offers the same discounts to all employers regardless of size but uses a device referred to as graduated participation to adjust the responsiveness of the plan to the size of each firm’s annual assessment. Consequently, small firms generally would have their discounts protected should they have an isolated claim, while large firms would see more responsive changes to their ER because of a recent change to their relative claim cost performance. For example, a large firm with a 2011 surcharge of 83% could find itself just about at base rate in four years if, starting in 2010 it reduced its claim costs to near the average of its industry. In summary, the capping of discounts and surcharges in the Construction ER Program reduces the sensitivity of ER for construction firms. In addition, it would not be anticipated that moving construction firms to the ER Plan would result in small firms experiencing large changes in their rates due to an isolated claim. 4.3
Is the Construction ER Program consistent with the principles of ER?
The Construction ER Program deviates from the following two aspects of the ER Plan, as set out in policy: The same ER Plan applies to all employers and independent operators in ratable classes. The maximum ER discount is 50%. The maximum ER surcharge is 100%. The Construction ER Program limits the maximum discounts and surcharges possible for construction firms to 33.3%, making the construction industry different from any other in the way that it is experience rated. While this is the only difference in the way construction firms are experience rated from other industries, WorkSafeBC has found it has some effects, most notably on base rates, as described above. The following points itemize some of the main objectives of the ER Plan and evaluate the effectiveness of the Construction ER Program in meeting these objectives. 1) Reducing cross-subsidization between firms The Construction ER Program causes firms with capped discounts to crosssubsidize firms with capped surcharges more than under the ER Plan. Firms with capped discounts pay higher base rates and lose part of the discount they would earn under the ER Plan to subsidize the costs of firms with capped surcharges.

2) Participation by all firms: ER applies to almost all firms in rated classifications, with the exception of employers in fishing.13 3) Financial incentive to reduce claim costs: A major goal of the 100% maximum surcharge is to increase equity between firms in an industry, in that firms with higher than average claim cost experience bear more of the costs they impose upon the collective insurance pool, by paying higher than average premium rates. The higher premiums are an incentive for these firms to invest in safety and improve return to work outcomes, which would then benefit all firms in the rate group. Conversely, the 50% maximum discount motivates firms with very low costs to preserve their commitment to workplace safety so that they achieve and maintain significant discounts. The capped discounts and surcharges of the Construction ER Program reduce firms' access to the incentives provided by the ER Plan. Every year more firms will reach the capped discount and surcharge amounts of the Construction ER Program, further eroding the possible effectiveness of the rate incentives. The continuance of the Construction ER Program increases inequity, in that: firms with higher than average cost experience will continue to benefit from a dampened financial consequence, and firms with lower than average cost experience will continue to have the full financial benefit available to them under the ER Plan withheld. 4.4
What is the Preference of the Construction Industry?
4.4.1 The 2002-2003 Consultation Results In 2003, WorkSafeBC received 161 responses to the Construction ER Pilot Program consultation paper sent out in March of that year. Of the 161 responses, 35 indicated that their preference was to keep the 33.3% discount/surcharge caps, 112 preferred the 50% discount and 100% surcharge limits of the ER Plan be applied, and 14 suggested transitioning towards the standard discounts over several years and/or adopting other measures. Of these firms, those capped at a 33.3% surcharge supported keeping the limits, and firms capped at a 33.3% discount supported eliminating the limits. 4.4.2 Current Consultation WorkSafeBC is again seeking stakeholders’ opinions on whether the Construction ER Program should be maintained or discontinued, and if it should be discontinued, whether a transition plan should be implemented. The current consultation is scheduled 13

to run until April 30, 2011. WorkSafeBC’s BOD will consider stakeholder feedback before it issues a formal decision on whether the Construction ER Program should be continued. 5.
OTHER JURISDICTIONS
The Ontario Workplace Safety and Insurance Board ("WSIB") is the only other Canadian workers' compensation board that has a separate ER program for the construction industry. The WSIB's ER program for the construction industry is the Council Amended Draft 7 (the "CAD-7"). This program has been in place since 1984. As of 2005 CAD-7 covered less than 4,000 large firms that pay more than $25,000 in annual premiums.14 Other features of the CAD-7 include: A retrospective award system Discounts that vary from year to year from 30% to 45% and surcharges that vary from year to year from 65% to 90%, depending on the forecasted cost performance of the construction industry as a whole A consideration of cost awards in the prior two years relating to accidents dating back five years A consideration of both claims cost experience and injury frequency Participation after one full year of experience In response to stakeholder criticisms, the WSIB made changes to the CAD-7 program effective in 2004. These changes lessened the effects of minor claims on the ER calculation, and improved the plan’s response to actual claim costs and frequency rates. The results of these changes increased the responsiveness of the CAD-7 program to make it more like WorkSafeBC’s ER Plan, in that firms are more accountable for their performance. Ontario is contemplating further reviews of its ER systems in the future. 6.
OPTIONS AND IMPLICATIONS
Option 1: Status quo Under this option, the Construction ER Program would be continued. Implications Firms with higher than average costs would continue to benefit from a dampened financial consequence, while firms with lower than average costs would continue to have the full financial benefit available to them under the ER Plan withheld. All construction firms would continue to pay inflated base rates, subsidizing firms with capped surcharges. 14

Over time, the number of firms with capped discounts and surcharges would continue to grow, possibly increasing upward pressure on construction base rates. The reduced incentives for firms to adopt occupational health and safety and return to work programs would continue, and the construction industry may continue to lag behind other high risk industry sectors in terms of improving injury and cost rates. Option 2: End the Construction ER Program with no Transition Under this option, the Construction ER Program would be ended as of January 1, 2012. Implications The full range of incentives possible under the ER Plan would be applicable to all construction firms for the 2012 rate year. Firms with lower than average claim costs would no longer lose part of their discount. Firms with higher than average claim costs would pay an increased proportion of their higher costs. Some firms in the construction industry would experience significant rate changes between 2011 and 2012 as a result of this approach; some firms with capped surcharges would experience significant rate increases. All construction firms would no longer subsidize firms with capped surcharges, and construction industry base rates would no longer have to be inflated as a result of the cost transfers associated with the Construction ER Program. There would be increased incentive for firms to adopt occupational health and safety and return to work programs. Option 3: End the Construction ER Program with a Stepped Approach Under this option, the Construction ER Program would be ended using a stepped approach, starting January 1, 2012. For the 2012 rate year, the maximum discount possible for the Construction ER Program would be 41.7%, and the maximum surcharge possible would be 66.6%. These amounts are halfway between the current maximum discounts and surcharges (33.3%) for the Construction ER Program and the discounts and surcharges of the ER Plan (50% discounts, 100% surcharges). For the 2013 rate year, the ER Plan would apply to all construction firms. Implications Firms with calculated discounts or surcharges below the proposed 41.7% and 66.6% maximums for 2012 would pay the same rate as they would under the ER Plan for the 2012 rate year. Firms with calculated discounts higher than the proposed maximum for 2012 would pay premiums at a higher rate than they would under the ER Plan for the 2012 rate year. Firms with calculated surcharges higher than the proposed maximum for 2012 February 25, 2011

would pay premiums at a lower rate than they would under the ER Plan for the 2012 rate year. Some firms in the construction industry would experience significant rate changes between 2011 and 2012 as a result of this approach. However, firms with the largest potential increases in discounts and surcharges would not see the full effect of the ER Plan until 2013. Based on information for the 2011 rate year, there are 39 firms that would have surcharges above 66.6% under the ER Plan, and 103 firms that would have discounts above 41.7%. All construction firms would no longer subsidize firms with capped surcharges, and construction industry base rates would no longer have to be inflated as a result of the cost transfers associated with the Construction ER Program. As a result of the transition, the full effect of this would not be seen until 2013. There would be increased incentive for firms to adopt occupational health and safety and return to work programs. 7.

BACKGROUND 1.
EXPLANATORY NOTES
Experience rating is a means of adjusting individual employers’ assessment rates to reflect their actual claims cost experience. Employers whose experience is better than their rate group average receive a discount. Employers whose experience is worse than their rate group average pay a surcharge. The experience rating program attempts to promote positive safety attitudes and to provide equity through a system of recognition and accountability for claims costs. The goal is to encourage employers with high injury costs to reduce them, and to encourage employers with low injury costs to keep them low. The desired outcome is a reduction in the social and economic costs of work-related injuries and diseases. 2.
THE ACT
Section 42: The Board must establish subclassifications, differentials and proportions in the rates as between the different kinds of employment in the same class as may be considered just; and where the Board thinks a particular industry or plant is shown to be so circumstanced or conducted that the hazard or cost of compensation differs from the average of the class or subclass to which the industry or plant is assigned, the Board must confer or impose on that industry or plant a special rate, differential or assessment to correspond with the relative hazard or cost of compensation of that industry or plant, and for that purpose may also adopt a system of experience rating.

The ER plan is prospective in application. ER adjustments are calculated on the basis of past claims costs and payroll and are applied to employers’ assessments. Thus, a firm’s experience is a measure of a firm’s performance relative to its rate group based on information derived by the Board from appropriate past claims costs and payroll.
(3)
ER adjustments are based solely on claims costs. The costs used are those directly associated with compensation claims, including the capitalized value of pensions awarded. The cost used for fatal claims is the five-year moving Boardwide average rather than the actual cost of each claim.
(4)
The Board’s administrative costs are not included in the ER calculation.
(5)
The ER plan uses claims costs arising from claims commenced in the three calendar years prior to the year in which the calculation is made (the “ER Window”). This includes all costs of those claims up to and including June 30 th of the year of calculation.
(6)
The costs included are subject to maximum limits for each claim as follows: 100% of the first $70,000; 50% of the next $50,000; and 10% of all costs above $120,000.
(7)
An employer’s cost to assessable payroll ratio is compared to the cost to assessable payroll ratio of the rate group to which the employer is assigned.
(8)
The payroll used is the total assessable payroll used to calculate employers’ assessments in the ER Window. This amount excludes earnings above the maximum wage, and includes Personal Optional Protection amounts.
(9)
In determining the cost to assessable payroll ratio in the ER Window, the most recent year is weighted at 50%, the prior year at 33.3%, and the most distant year at 16.7%.
(10)
The calculation involves combining an employer’s cost experience in the ER window with its ER factor for the previous year. The ER factor reflects the fact that employers participate at different levels, based on the size of the employer’s assessment before the ER adjustment. The higher an employer’s base assessment, the higher its level of participation in the plan. A higher level of participation means an employer’s ER adjustment is more responsive to its claims costs experience in the current ER window.

The maximum ER discount is 50%. The maximum ER surcharge is 100%, except where an excess cost surcharge applies.

Employers enter the plan for the first time when they have had some payroll within the current ER window.

Where any part of an employer’s payroll has been estimated, any resulting discount will not be applied. If a surcharge results, it will be applied. If an estimate is replaced by the actual payroll information, the experience rating will be recalculated.
(15)
The employer for experience rating purposes is the legal entity operating the business. If an employer operates divisions, whether they are separately registered with the Board or not, the employer’s combined experience determines the rating for all the employer’s operations.
(16)
Employers registered voluntarily under sections 3(5) to (7) of the Act or by a variance from a general exemption order under section 2(1) of the Act are excluded from participating in the experience rating plan.
(17)
For simplicity, ER discounts or surcharges are generally expressed as percentage adjustments to employers’ base assessment rates.
(b)
The Excess Cost Surcharge
The excess cost surcharge is a component of the ER plan allowing the Board to more properly rate firms with ongoing high costs. A firm qualifies for an excess cost surcharge where: the firm is active and its average claim cost to payroll ratio, as calculated by the Board, is three or more times that of its rate group for three consecutive assessment years; the firm has a calculated ER surcharge adjustment of 90 percent or more; and, the firm has had 50 or more non-health care only claims in the five consecutive years ending with the most recent year in the ER window. The Board will determine a required rate for a qualifying firm to enable calculation of the firm's excess cost surcharge. The required rate will be set annually based on the following: (1)

After the first year the required rate will be the lower of: (i) a rate set as described in section (1), above; or (ii) a rate set using a weighting determined by the Board that blends a rate using: claims costs arising from claims commenced in the five years prior to the year in which the calculation is made, and, a rate set as described in section (1), above, where the five-year rate is lower than the rate set as described in section (1). Since the required rate is set annually, subsequent changes in claim cost or payroll information will be reflected in the next year's required rate calculation. The required rate is capped at 500 percent of a firm's yearly-established classification base rate.

Contingent upon firms in the Construction Sector participating fully in WCB initiatives and/or special programs which have the purpose of reducing the frequency and/or cost of work-related injuries, diseases, and deaths, effective January 1, 2006, firms in the Construction Sector will be placed into the Construction Industry Experience Rating Program. 4. The WCB Administration will identify firms in the Construction Sector with significantly higher than average claim costs.
