Francis City Planning Commission Meeting Thursday February 19, 2015 Francis City Community Center 2319 South Spring Hollow Road Francis, Utah 84036 Present: Chair Jill Jacobson, Commissioner Loraine Flygare, Commissioner Shauna Bushman, Commissioner Trent Handsaker, Commissioner Kevin Cannon, Planner Marcy Burrell and Secretary Susan Moses, Others Present: Meg Ryan from the Utah League of Cities and Towns Call Meeting to Order Chair Jill Jacobson called meeting to order at 6:30 pm Approval of Annual Meeting Schedule: Commissioner Kevin Cannon motioned to approve the 2015 Meeting Schedule; Commissioner Loraine Flygare seconded the motion. Motion passed unanimously. Approval of Minutes: November 20, 2014 Chair Jill Jacobson and Commissioner Kevin Cannon are the only eligible ones to vote on the November 20, 2014 minutes. Commission Kevin Cannon motioned to approve the minutes for November 20, 2014 as presented. Chair Jill Jacobson seconded the motion. Motion passed unanimously. Approval of Minutes: January 15, 2015 Commissioner Trent Handsaker motioned to approve the minutes for January 20, 2015 as presented. Commissioner Shauna Bushman seconded the motion. Motioned passed unanimously. CERT Training update: Planner Marcy Burrell stated the City Council has tabled the CERT training for everyone except for staff, staff will start training March 3, 2015 in the office from 9 to noon.

Land Use Training by Meg Ryan Meg Ryan handed out: 1. Handbook for Planning Commissions and Land Use Authorities 2. Handbook for Appeal Authorities 3. Land Use Training Handbook. Meg Ryan stated you have the option to have a place on the agenda for Public comment. Meg Ryan stated when voting on a project, the Planning Commission should do a formal vote: all in favor, not in favor, abstentions. Meg Ryan stated her role is to tell the Planning Commission what the State and Federal Laws are. The Policy Choices are ultimately the Cities decision. Every City and Town has a different policy choice and visions. Meg Ryan stated it is important for the Planning Commission to know the General Plan and Development Codes and what is being asked of you. Meg Ryan added you need to articulate that to the Applicant and to the Public. Planner Marcy Burrell stated the Planning Commission has a copy of the General Plan and Development Code. Marcy will send out a staff reports before Planning Commission meetings with the research and with the codes you can review to help in making your decision. Meg Ryan stated the code at the State level changed over the last six year, what use to be very formal has changed, it has been given authority to the Cities and Towns to decide what works best for them. Zoning is not static. It is something you need to look at and update as needed. Meg Ryan stated there are Federal Laws, State Laws and the Land Use Development Management Act (LUDMA) and then your own City Code. You don’t create codes out of context of these other rules and regulations. Meg suggested the Planning Commission know Title 10 Chapter 9a in the Land Use Training Handbook. Meg Ryan stated on page 175 of the Land Use Training Handbook is the top ten websites for Land Use. Meg Ryan stated Cities and Town are created by the State, they can take away your power or they can give you the power. Meg Ryan stated the Council is the legislative body; they are the ones that make the decisions and delegate responsibility. You have to have a Planning Commission; you are an advisory body only unless the Council decides to give you the authority to act on applications. Page 2 of 4

Meg Ryan stated in Chapter 4 of the Development Code section 4.2.3 list the Duties and Responsibilities of the Planning Commission. Suggest the Planning Commission read chapter 4 and also read the Planning Commission By-Laws, so we understand our responsibilities. Meg Ryan stated basic theme of LUDMA is: 1. A balance of private property and community rights 2. You have to write it down 3. You have to abide by it 4. Must act with reasonable diligence You may not like it, but there is a process to change it, if that is the consensus of the Community. Meg Ryan stated the Land Use Tools are: 1. General Plan 2. Development Code Meg Ryan talked about the General Plan. 1. It is the vision a. Needs to be CLEAR b. Work with the Development Code and Zoning 2. Use to create Zoning Code 3. Need to look at every year and update Meg Ryan stated the State gives you a Temporary Zoning Ordinance; there is an example on page 133 of the land Use Training Handbook. It states you can take a six (6) month break, you do not have to except permits or deal with applications if you are updating your Development Code or General Plan. Chair Jill Jacobson asked if the Planning Commission makes changes to the General Plan does the City Council need to vote on it. Meg Ryan answered the process for the General Plan and Development Code is: 1. Planning Commission creates the changes or draft. 2. Holds a Public hearing. 3. Recommends to the City Council. 4. City Council approves, modifies or denies. Important to communicate with City Council before starting. Land Use Authority Meg Ryan stated the Planning Commission is advisory; you make recommendations to the City Council. The City Council takes final action. Page 3 of 4

Appeal Authority deals with two things; Appeals and Variances. For a Variance the State has 5 criteria that must be met, very narrow rules and if applicant does not met the criteria; you cannot vary from the Code. (see page 66 & 67 of the Land Use Training Handbook) Meg Ryan stated the Appeal Authority can be one person or a board, the City makes that decision. Meg stated variances should be few and far between. Meg Ryan talked about Agenda Items: (see page 60 of Land Use Handbook) 1. Legislative – a. Very Broad Authority b. Broad public input taken 2. Administrative – a. Much More Restrictive b. Limited public input for information only 3. Quasi-Judicial – a. Very Restrictive b. Public input for information only Meg Ryan stated on page 14 and 15 of the Land Use Handbook is the State requirements for Public Notices. Meg Ryan recommended we look at our requirements for Public Hearings and Public Notices and ask is it required? Why are we doing this and does it make senses? Commissioner Trent Handsaker motioned to adjourn. Commissioner Loraine Flygare seconded the motion. Motioned passed unanimously. Adjourn at 8:00 p.m.
