Francis City Planning Commission Meeting May 21, 2015 Francis City Planning Commission Meeting Thursday, May 21, 2015 Francis City Community Center 7:00 p.m. 2317 South Spring Hollow Road Francis, Utah 84036

Present: Chair Jill Jacobson, Co-Chair Kevin Cannon, Commissioner Shauna Bushman, Commissioner Trent Handsaker, Commissioner Loraine Flygare, Planner Marcy Burrell, Engineer Scott Kettle and Secretary Susan Moses Others Present: Tim & Amanda Crittenden, Heather Fox, Flash Deros, John Woodard, Kayci Lily, Josh Lilly, Kim Woodard, Darren & Wendy Call Meeting to Order: Chair Jacobson called meeting to order at 7:05 pm Approval of Minutes: April 16, 2015 Commissioner Flygare motioned to approve the April 16, 2015 minutes as presented. Commissioner Handsaker seconded the motion. Motioned passed unanimously. Codification Revision Chapter 18.135 – 18.150.060 There was a brief discussion on Chapter 18.135 – 18.150.060 Chair Jacobson went through the changes made. Commissioner Cannon suggested on 18.145.020 number 5 and 6 be revised. Approval was table for future discussion Parks Plan Possible Revision Engineer Kettle explained the Parks Master Plan has been approved by the City Council and they intended to do the majority of the projects listed. Kettle stated we are in the process of doing the Parks Impact Fee Study. Kettle asked the Planning Commission to prioritize the projects so as money comes available we can work on projects. Commissioner Handsaker asked if we could apply for Grants and are there conditions as how we spend the money. Secretary Moses explained there are Grants we apply for and you have to write in your proposal what you will spend the money on and you have to stick to that plan.

Francis City Planning Commission Meeting May 21, 2015 Engineer Kettle stated we received a grant to put the restrooms in. Kettle added in the past we received grants to put in the rodeo bleachers. Commissioner Flygare commented we need to keep this park cleaned up; we need to spray the weeds and tall grass under the bleachers around the ball park. Flygare commented the flowers that were put in last year are fall flowers, suggested we put in spring flowers. Flygare would like to see a walkway all the way around the park. Flygare stated there is nowhere in Francis you can walk, you are talking your life in your hands out on these roads. Public Hearing: A Conditional Use Permit for a Business that Welds in the R-1 Zone J&J Fabrication – John Woodard and Josh Lilly Planner Burrell read the staff report. Public Hearing Opened Flash Deros commented he was a neighbor and he has seen their lights on late at night and knows they have been working, and it does not bother him one bit. Deros added he has never heard any of the neighbors complain. Josh Lillie partner in J & J Fabrication commented the hours of operation recommended in the Conditional Use Permit are 8 to 5 which are typical business hours, but for us we already have full time jobs so when we work in the shop it is after work and on weekends. The Plan in the future is to do this full time and work 8-5. Lillie stated they try and do the noisy work first. Commissioner Flygare asked the reason they cannot work on Saturdays. Planner Burrell answered normal businesses hours are 8-5 weekdays, but that is something the Planning Commission can decide on. Commissioner Handsaker commented our job is to clarify what the code is. Commissioner Cannon stated contractors are allowed to work 7-7. Suggested we allow J & J Fabrication to work 7-7. Commissioners Handsaker and Flygare agreed. Cannon stated he is the closest neighbor to J & J Fabrication and he has no issue with them working late. Commissioner Handsaker commented he could not find any restrictions about working 8-5 in the Development Code Heather Fox commented she is a neighbor, asked if J & J Fabrication was going to transition to working full time at this business. Josh Lillie answered yes. Heather Fox stated she has no issue with them working late.

Francis City Planning Commission Meeting May 21, 2015 Josh Lillie commented there is an exciting welding business in the shop and we could work under that business. Flash Deros commented knowing these two gentlemen, if someone had an issue they could talk to them and fix it. Chair Jacobson commented this is in a residential area, how do we make this comply for now and in the future as you grow it could turn into something else. Josh Lillie responded if it does grow, we only have two bays, so if we grow we would have to move to a bigger place. Commissioner Handsaker stated in the Development Code it states in a Home/Premise Occupation that you can have no more than one employee working a maximum of twenty hours per week, it does not have anything about working hours, just the noise ordinance 7pm to 7am. Chair Jacobson read from the Development Code “The home/premise occupation shall not interfere or disrupt the peace, quite and domestic tranquility of the neighborhood by creating excessive noise, excessive traffic, nuisance, fire hazard, safety hazard or other adverse effects of commercial uses.” Chair Jacobson stated you would need to follow this Code. Chair Jacobson asked if they needed the building inspector or the Fire Department to inspect. John Woodard answered it is up to code. Public Hearing Closed Commissioner Handsaker asked if we grant a Conditional Use Permit will the business have to comply with the Development Codes along with any restriction we put on. Planner Burrell answered yes. Chair Jacobson suggested: 1. Enforce noise ordinance. 2. Have Fire Marshal inspect business. 3. If more than one employee working, they must come back to the Planning Commission. Planner Burrell suggested: A Business license will be issued once the Fire Marshal has inspected the Business. Subject to following the Noise Ordinance and Development Code section on Home/Premise Occupations Commissioner Flygare motioned to approve to accept the Conditional Use Permit for J & J Fabrication with the Conditions: A Business license will be issued once the Fire Marshal has inspected the Business. Subject to following the Noise Ordinance and Development Code section on Home/Premise Occupation. Commissioner Cannon seconded the motion. Motion passed unanimously.

Public Hearing for Minor Subdivision – Tim & Amanda Crittenden Planner Burrell read Staff report. Commissioner Bushman commented that her concern is: are you looking to the future in case you want to subdivide the property? Amanda Crittenden responded we never intend to develop that land; it is going to be farm land. Engineer Kettle stated on the plat they need to show a ten foot easement for the ditch. Tim Crittenden asked if his driveway can go over the ditch. The Planning Commission responded they can put in a culvert. Chair Jacobson asked if they were hooking up to City water and sewer. Engineer Kettle answered yes they are required to. Planner Burrell stated on the plat map it needs to have a note that states if further developed the Arm Corp of Engineers needs to be contacted. Commissioner Flygare motioned to approve the Tim & Amanda Crittenden Minor Subdivision with Engineer Kettles recommendation. Commissioner Bushman seconded the motion. Motion passed unanimously.

City Business Planner Burrell gave an update on the Fire Code. Burrell stated the City Council and City Attorney felt we need a map of the Wild Land Urban Area. Council also took out the requirement of fire sprinklers. Planner Burrell stated the Luke Thomas will put together a schedule for flushing out the fire hydrants. He does not want citizens to flush out hydrants. Adjourn Commissioner Bushman motioned to adjourn. Commissioner Cannon seconded the motion. Motion passed unanimously. Adjourned at 8:25 pm
