By signing below, the artist (s) grant non-exclusive rights to the Canadian Cancer Society and Owen Sound Attack to publish, display, or otherwise make the design available for viewing, whether on the internet, within the company or other venues. These rights will not expire but will exist for as long as the company continues to use the design. Additionally by signing this release you acknowledge that you have read the Jersey Design Contest guidelines, rules and fine print and that your submission is original, non-copyrighted work. Cubs for Cancer Design a Jersey Contest Official Contest Rules By entering the Cubs for Cancer Jersey Contest (the “Contest”) you agree to be bound by these Official Rules. No purchase or payment necessary to enter or win. The Contest is void outside of the Canada and where prohibited or restricted by law. 1. Eligibility This Contest is open to all persons ages 17 and under (each a “Contestant”) who are Canadian residents at the time of entry. Each Contestant shall submit a design for a Cubs for Cancer jersey (the “Jersey Design”) using the official Contest entry form (“Entry Form”) The Contestant’s parent or guardian must complete and submit the Entry Form and Jersey Design on behalf of the Contestant. 2. Contest Dates The Contest begins August 1, 2017, and ends September 8, 2017. All entries must be received by 11:59:59 p.m. PST on September 8, 2017. It is the responsibility of each Contestant or persons entering on behalf of a Contestant to ensure timely submission of entries. No submissions will be accepted after the deadline for any reason. Contestants entering close to the posted deadline do so with this information in mind. The Canadian Cancer Society and other sponsors of the Contest are not responsible for lost, late, stolen, mutilated, damaged, incomplete, illegible or misdirected or garbled entries or for malfunctions of electronic equipment, computer hardware or software, or any other technical problems related to online entries. Multiple entries by the same person on behalf of the same Contestant may result in disqualification of all entries. 3. Entry Guidelines Entry Process - All Contestants or persons entering on behalf of a minor Contestant must submit a completed Entry Form and Jersey Design in accordance with the Entry Form. 4. Judging Submissions will be judged on the basis of visual impact, creativity, style, and relevance to the theme. The judging panel consists of Cubs for Cancer committee members. 5. The Prize The winning Contestant will receive the following prize (the “Prize”): Two (2) tickets – the winner and up to three (1) guests (collectively, the “Group”) to the November 25, 2017 Owen Sound Attack game at The Harry Lumley Bayshore Arena in Owen Sound, Ontario as well a commemorative jersey. The potential winner will be notified by phone, mail, or email. 6. Conditions of Participation Original Work – By submitting an entry the Contestant (or if the Contestant is a minor, his/her’s parent or legal guardian) represent and warrant that (i) the Jersey Design is an original work that has not been previously published or distributed; (ii) the Jersey Design is owned and controlled by the Contestant; and (iii) that no other party has any right, title, claim, or interest in the Jersey Design and the Canadian Cancer Society and Owen Sound Attack exercise of any rights granted to it pursuant to the terms of these Official Rules do not and will not infringe the rights of any third party, including, without limitation, any intellectual property rights, rights of publicity, rights of personality, rights of privacy, rights to payment of royalties, or any other rights of third parties. Use of Submissions – Contestant (or Contestant’s parent or legal guardian) grants the Canadian Cancer Society and Owen Sound Attack a perpetual, royalty free irrevocable, sub-licensable, worldwide right and license to reproduce, distribute, transmit, create derivative works of, publicly perform, and publicly display the submitted Jersey Design for any and all uses in all media now known or hereinafter devised. The use of the submitted Jersey Design shall be royalty-free and Contestant is not entitled to any compensation in connection with the use of the Jersey Design. As a condition of participation, Contestant waives any claim of infringement against the Canadian Cancer Society and Owen Sound Attack based upon use of the submitted Jersey Design, and agrees to hold the Canadian Cancer Society and Owen Sound Attack harmless from any claims or expenses arising as a result of the use of the Jersey Design. Conduct- By entering the Contest, the Contestant agrees (i) to be bound by these Official Rules, and the Canadian Cancer Society Privacy Policy; (ii) that the decision of the applicable judges is final and binding on all matters relating to this Contest; (iii) to be contacted by the River Cats by email, telephone, text message or mail; (iv) not to use obscene, libelous or slanderous language, or language that infringes upon a third party's copyright, trademark, trade name or other intellectual property right or right of
privacy in the materials submitted in order to participate in this Contest; (v) to indemnify and hold harmless the Canadian Cancer Society and its respective subsidiaries, parents, partners, consultants, agents, and employees against and from all claims, damages liabilities, costs and expenses asserted by third parties alleging that the Contest includes obscenity, libel, slander, or infringes upon the third party's intellectual property or privacy rights, as a direct result of your actions in the use connection with the Contest; and (vi) not to knowingly damage or cause interruption of the Contest or to prevent others' participation in the Contest. 7. Limitations Of Liability Contestant assumes liability for losses or injuries caused or claimed to be caused by participating in the Contest. The Canadian Cancer Society and Owen Sound Attack are not responsible: (i) for any lost, late, illegible, incomplete, misdirected or mutilated entries or entry information; or (ii) for any incorrect or inaccurate information, in the Contest or by any technical or human error that may occur in the processing of submissions in the Contest. The Canadian Cancer Society and other Contest sponsors assume no responsibility for an error, omission, interruption, deletion, defect, theft or destruction of authorized access to, or alteration of, entries. If, for any reason, the Contest is not capable of running as planned, including tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Canadian Cancer Society or other Contest sponsors that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, the Canadian Cancer Society reserves the right to cancel, terminate, modify or suspend the Contest.
