LATESTINBEAUTY.COM PROMOTION TERMS AND CONDITIONS 1.
PROMOTION AND RESTRICTIONS
1.1
This LUCKY EGG promotion (the Promotion) is open to permanent residents of the UK (but excluding Northern Ireland) aged 18 years or over at the date of their entry. The Promotion is not open to employees or agents of either the Promoter or Lucky Cycle Ltd (LuckyCycle) or their immediate families.
1.2
By participating in the Promotion you agree to be bound by these terms and conditions (the Terms).
1.3
The Promotion will be open for entries to those purchasing a product of minimum £10 from 10:00:01 24th of March 2015 until 23:59:59 on 6th of April 2015 (the Entry Window). Any entries received before or after the Entry Window (for whatever reason) will be invalid.
1.4
Entrants may only enter the Promotion once every twenty-four (24) hours. The first participation within this time window will be taken into account.
2.
IDENTITY OF THE PROMOTER OF THE PROMOTION
2.1
The promoter of the Promotion shall be Latestinbeauty.com, 1-9 Hardwick's Square, London SW18 4AW, United Kingdom (the Promoter).
3.
ENTRY
3.1
Entry to the Promotion is free. To enter, entrants must visit the Promoter's site at www.latestinbeauty.com, and make a purchase of minimum £10 during the Entry Window. For the avoidance of doubt, several items purchased together in one transaction shall constitute a single purchase.
3.2
Once a purchase has been made the entrant shall receive a participation form via a hyperlink in the order confirmation page or via email. The entrant shall have until 23:59:59 9th of March 2015 to complete the participation form. Entrants may only enter the Promotion once every twenty-four (24) hours. For the avoidance of doubt, entrants may make as many purchases during the Entry Window as they may wish, but entry to the Promotion shall be limited to once every twenty-four (24) hours.
3.3
Following an applicable purchase as set out above, an automatic draw shall take place where the entrant has a 1 in 10 chance of being selected to be reimbursed for their original purchase (up to £200). This draw shall be performed by computer, instantaneously, randomly and without human intervention.
3.4
Participation in the Promotion shall be free but shall only be taken into account after payment for the products purchased on the Promoter's site (for the avoidance of doubt, the entirety of the sum paid during each purchase relates to the item purchased and not to participation in the Promotion).
3.5
Prizewinners and unsuccessful entrants (i.e. unsuccessful in the draw) shall be informed in real time on the Promoter's site.
3.6
The Promoter reserves the right to reject any deficient, fraudulent or inaccurate entries.
4.
ELIGIBILITY RULES FOR THE PROMOTION
4.1
It will be the Promoter's sole decision as to whether any eligibility requirement has or has not been met and the Promoter may require evidence or confirmation from entrants before awarding prizes. The Promoter reserves the right to disqualify any entry which does not comply with the Terms.
5.
PRIZES
5.1
Prizewinners shall be reimbursed for their original purchase made upon entry (up to £200) by the Promoter. All prizewinners will be notified immediately if they have won a prize via e-mail or other applicable method provided that the prizewinners has provided such contact information accurately. The Promoter shall transfer the prize to the prizewinners within 60 days of the entrant being notified they has won a prize.
5.2
A list of prizewinners for the Promotion can be obtained by e-mailing [email protected] and quoting the name of the Promotion.
5.3
The Promoter reserves the right to request proof of a prizewinner's identity, age and address. In the event that a prizewinner cannot provide the Promoter with proof of identity and age the Promoter may withdraw the prize.
5.4
All prizes are non-transferable and non-exchangeable.
5.5
Participation in the Promotion shall involve no waiver by the entrant of their legal rights (including any right to return goods). It is acknowledged by the entrant, however, that the prize is a reimbursement of the product price in relation to the applicable purchase. Therefore the exercise of any right to return goods purchased as part of the Promotion shall negate the value of any prize and as such entry to the Promotion shall be cancelled.
5.6
Any tax payable as a result of a prize being awarded or received will be the responsibility of the prizewinner. Prizewinners should seek independent financial advice prior to accepting a prize if this is a concern.
5.7
The Promoter makes no representation or warranty in relation to prizes provided.
5.8
All stated prize values are at our recommended retail price in pounds sterling and are correct at the time of printing. The Promoter takes no responsibility for any fluctuations in prize values.
6.
PERSONAL INFORMATION
6.1
By entering the Promotion entrants warrant and undertake that the information submitted is true, accurate and complete.
6.2
It is a condition of entry to the Promotion that the Promoter has the right to communicate to the public the names and counties of prizewinners. Entrants hereby agree to such communication of their information.
6.3
The Promoter may use information (including personal data) entrants provide to it in entering the Promotion for the purposes of running the Promotion. This will include sharing such information with LuckyCycle Ltd.

7.
TAMPERING AND OTHER MATTERS
7.1
If for any reason the Promotion is not capable of running as planned as a result of any (including but not limited to) technical failures, unauthorised intervention, computer virus, mobile network failure, tampering, fraud or any other causes beyond our control which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion and/or any draws and/or to disqualify any individual who (whether directly or indirectly) causes the problem.
8.
TERMINATION OF THE PROMOTION
8.1
The Promoter has the right to vary these Terms, or terminate the Promotion, at any time at its absolute discretion without liability to any entrant or other person. The Promoter will not award any prize if the Promotion is terminated.
9.
DECISIONS FINAL
9.1
The Promoter's decisions relating to the Promotion and/or redemption of the prizes are final. No discussions or correspondence with entrants or any other person will be entered into.
10.
FAILURE TO ENFORCE TERMS AND CONDITIONS
10.1
A failure by the Promoter to enforce any one of these Terms in any instance(s) will not give rise to any claim or right of action by any entrant or prizewinner, nor shall it be deemed to be a waiver of any rights in relation to the same.
11.
EXCLUSION OF LIABILITY
11.1
Except as specifically set out herein and to the maximum extent permitted by law, all conditions, warranties and representations expressed or implied by law are hereby excluded.
11.2
To the fullest extent permitted by law, the Promoter hereby excludes and shall not have any liability to any entrant or prizewinner in connection with or arising out of the Promotion howsoever caused, including for any costs, expenses, forfeited prizes, damages and other liabilities, provided that nothing herein shall operate so as to limit or exclude the Promoter's liability for personal injury or death caused by negligence.
11.3
By entering the Promotion, the entrant indemnifies the Promoter against any and all actions, claims, damages, expenses or liabilities suffered or incurred directly or indirectly by the Promoter in consequence of any breach or alleged breach, non-performance or non-observation by the entrant of any agreement, conditions, obligation or warranty on the part of the entrant herein.
11.4
In the event that any provision of these Terms are held to be illegal, invalid, void or otherwise unenforceable, it shall be severed from the remaining provisions which shall continue in full force and effect.
12.
LAWS
12.1
These Terms shall be construed in accordance with and governed by the laws of England and Wales.
