When should you update your estate plan?
Congratulations if you have taken care of your estate plan and have put in place the means by which to deal with your incapacity and death. If you do have an estate plan in place, when is the last time you reviewed it? Your estate plan should be reviewed regularly. Some circumstances that may require you to re-visit your plan include: -You’ve moved to a state other than that in which you lived when your plan was designed; -You have bought or sold real estate; -You haven’t updated your plan since the Healthcare Insurance Portability and Accountability Act (HIPAA) became effective in 2003; -There have been changes in your family circumstances such as birth, death, remarriage, divorce, bankruptcy and inheritance; -Your general powers of attorney have grown stale (i.e. signed more than three years ago); -Changes in the estate planning and tax laws in the last ten to twenty years; -The people you have named to act on your behalf are no longer the best choice.
