The Osnaburg Local Board of Education met in Special Session on Tuesday July 29, 2014 in the Carmela Lioi Media Center. The meeting was called to order at 6pm. Upon roll call the following board members were present: Henry Boyle, Linda Motts, Randy Pero and Dorothy Yohe. Stephen Kimbel was absent.
NEW BUSINESS District Business RESOLUTION OF NECESSITY 07-138-14 Mrs. Yohe moved and Mr. Pero seconded a motion to approve the following resolution: RESOLUTION DECLARING IT NECESSARY TO LEVY AN ADDITIONAL TAX IN EXCESS OF THE TEN-MILL LIMITATION (Ohio Revised Code Section 5705.21) Operating Levy WHEREAS, the amount of taxes which may be raised within the ten-mill limitation will be insufficient to provide an adequate amount for the necessary requirements of the School District; and
WHEREAS, a resolution declaring the necessity of levying an additional tax outside the ten-mill limitation must be passed and certified to the County Auditor of Stark County in order to permit the Board to consider the levy of such a tax and must request that the County Auditor certify to the Board the total current tax valuation of the School District and the dollar amount of revenue that would be generated by the tax; NOW, THEREFORE, BE IT RESOLVED by the Board of Education of the Osnaburg Local School District, Stark and Carroll Counties, Ohio, two-thirds of all of the members elected thereto concurring, that: Section 1. It is necessary to levy an additional tax in excess of the ten-mill limitation for the purpose of paying the current operating expenses of the School District. Section 2. The question of such additional tax levy shall be submitted to the electors of the School District at the election to be held therein on November 4, 2014. Section 3. Such additional tax levy shall be at a rate not exceeding 2.90 mills for each one dollar of valuation, which amounts to $0.29 for each one hundred dollars of valuation, for the purpose of paying current operating expenses of the School District for a continuing period of time.
Section 4. Such additional tax levy shall be placed upon the tax list and duplicate for the current tax year (commencing in 2014, first due in calendar year 2015), if a majority of the electors voting thereon vote in favor thereof. Section 5. The Treasurer of this Board is hereby authorized and directed to certify a copy of this Resolution to the County Auditor and the Board of Elections of Stark County, Ohio. This Board hereby requests that the County Auditor certify to this Board the total current tax valuation of the School District and the dollar amount of revenue that would be generated by the levy if approved by the voters of the School District. Section 6. It is hereby found and determined that all formal actions of this Board concerning and relating to the passage of this Resolution were taken in an open meeting of this Board, and that all deliberations of this Board and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements, including Ohio Revised Code Section 121.22.
