Background ‐ RFP from LIPA for 50MW PV Energy (2008) ‐ DOE committed to host winning proposal (LIPA selected developer) ‐ Utility‐scale solar farm to be built on DOE‐BNL Property ‐ Up to 200 Acres: NOT Contiguous (beware of Tiger Salamander) ‐ Power for LIPA residents, not BNL

Background (continued) DOE developed a set of conditions: – DOE will continue to own the land, but will provide access – Small research array for BNL’s use will be provided (by developer) – Project designed to protect and enhance local environment; and will follow natural terrain – Irregular boundaries must avoid most sensitive areas – Protect tiger salamander habitat and improve tiger salamander pond – Fencing to protect LISF site from deer while special design to allow small mammals to enter and exit the site freely 3

DOE – BP Agreement • Structure of the agreement to provide access is a 21 year easement • Consideration for the access rights is in the form of a research program – Dedicated array for BNL (up to 1 MW) – Access to equipment & data on the large array
Fair market value for the consideration was developed through an real estate appraisal
BP has sold a majority of its stake in LISF to METLife
