Dear Mr. VanBuskirk: The North Carolina Hazardous Waste Section (HWS) has reviewed the Draft Remedial Action Plan (RAP) submitted September 23, 2016 for the DuPont Facility in Brevard (Facility). The HWS has determined the RAP meets the requirements of 15A NCAC 13A Article 9 - Part 8 and is complete. When implemented, the Corrective Actions proposed in the RAP will address contamination from Solid Waste Management Units (SWMUs) and Areas ofConcern (AOCs) at the Facility. The RAP will meet the requirements in N.C.G.S. Article 9- Part 8, 40 CFR 264.101 as adopted in l 5A NCAC 13A .0109, and the RCRA Permit and will protect future users and receptors at the site. The RAP is considered a Final Remedy and will be incorporated into the existing Resource Conservation and Recovery Act (RCRA) Permit through a Class 3 Modification. To accomplish this Permit Modification and as required by 40 CFR 270.42 as adopted in l 5A NCAC .0113 a modified Draft Permit has been prepared and is enclosed. Also enclosed are a Public Notice for the Draft Permit including the scheduling ofa Public Hearing and a Fact Sheet describing the Permit Modification. Please note that the following changes are proposed to the Facility's existing RCRA Permit in order to incorporate the RAP as a Final Remedy: a. Change in the issue and effective date of the Permit to reflect proposed issuance and effective dates (Note: there is no change to the Permit expiration date of September 3, 2018.); b.
