FRANCIS CITY Planning Commission Meeting Wednesday December 4, 2013 Recreational Building 2319 South Spring Hollow Road Francis, UT

The Francis City Planning Commission convened in regular session Wednesday, December 4, 2013 in the Francis City Recreation Building. PRESENT: Chair Julie Keyes, Commissioner Byron Ames, Commissioner John Barclay, Commissioner Jill Jacobson, City Planner Rae Prescott, City Attorney Kraig Powell and Secretary Susan Moses NOT PRESENT: excused Commissioners Mickey Grames and Commissioner Dorothy Sullivan Others Present: Collins Prescott Call meeting to order Julie Keyes called meeting to order at 7:00 pm Welcome New Planning Commissioner Julie Keyes welcomed Jill Jacobson to the Planning Commission. Jill Jacobson introduced herself, she moved to Francis a year ago, her husband is a builder and she is a real estate agent and they are developing Summit Haven a twelve lot subdivision. Collins Prescott CUP – Discussion Planner Prescott read through staff report (see attachment) Julie Keyes asked is the building inspector recommending the water and sewer be hooked up prior to Mr. Prescott doing business. Planner Prescott answered no, the inside needs to be sheet-rocked. Julie Keyes asked for clarification of what needs to be done before we issue a Conditional Use Permit. Attorney Powell answered since the building inspector was only insistent upon the sheetrock being up before the owner begins work in the shop. Powell told the Planning Commission they need to make a recommendation that the Conditional Use Permit be issued and then you list the conditions and a time line. Tonight’s meeting is to get a recommendation from the Planning Commission then send it to the City Council. Julie Keyes commented last time we talked about the possibility of a port-a-potty for Collins’ use.

Francis City Planning Commission December 4, 2013 Byron Ames asked Collins Prescott how far is your shop from your house. Collins Prescott answered 4 miles. Planner Prescott added Collins Prescott’s father lives across the street and Collins could use the facilities there. Byron Ames commented that the port-a-potty is less of an issue if it is just Collins and he does not have employees and he has access at his dads. If the City inspector thinks the sheetrock is the most important thing I would go along with that, but I agree we need to have a timeline set. John Barclay asked what is the intention of the business. Collins Prescott answered building custom cabinets; primarily kitchens, new construction and remodels. Jill Jacobson asked if Collins was planning on having a showroom. Collins Prescott answered someday in the future. Planner Prescott stated the building inspector also recommended putting a wrap on the outside of the building and then in the spring put siding on the outside of the building. Public Hearing Public Hearing Opened. No Public in attendance. Public Hearing Closed. Julie Keyes asked the Planning Commissioners if they were in favor of moving forward with Collins Prescott’s Conditional Use Permit. The Planning Commission was unanimous in moving forward. Julie Keyes commented that her concern before was the Fire Marshal going in and checking out the exhaust system, I am assuming he approved the system. Collins Prescott responded that the Fire Marshal did not specifically look at the exhaust system because he said he was not qualified to; however Collis bought a book that described how to put in an exhaust system, the book gave some really good information on how to do it and not to do it. Collins Prescott stated there are two kinds of exhaust systems, steel or plastic pipe, Prescott went with the steel pipe. Attorney Powell asked Collins Prescott when he planned on putting in the exhaust system. Collins Prescott answered it is partially in. Attorney Powell asked who would inspect the exhaust system. Would the build Inspector? Collins Prescott answered he never specified that.

Francis City Planning Commission December 4, 2013 Collins Prescott stated he had OSHA come in like the Planning Commission requested earlier, and they stated there were no employees working here and that they need to test the dust particles in the air to determine whether or not it is sufficient, they would be happy to come out again. Attorney Powell commented if we are doing the difference between no employees and employees in the future, we could put in the future timeline have OSHA come back and inspect. Julie Keyes stated the inspector was adamant about having the sheetrock done sooner rather than later. We need to decide on a timeline for the sheetrock. Byron Ames commented it sounds to me like prior to operating even as a sole proprietor, the sheetrock needs to be finished. Attorney Powell suggested granting the Conditional Use Permit upon inspection of sheetrock. Attorney Powell stated that for your finding it is important that we state that Collins Prescott has satisfied the Fire Department review and the fire hydrant location. Julie Keyes commented that Oct 15th is the cutoff date to cut the road. Byron Ames asked Collins when he could have the sheetrock done. Collins Prescott answered January or February. Byron Ames suggested we give Collins Prescott until October 15th to have the water and sewer done. Collins Prescott purposed giving him 7 months after the sheetrock is done to have the water and sewer hooked up. Julie Keyes stated that the sketch has been satisfied, Fire Marshal has been satisfied, it was suggested we make a recommendation as soon as the tyvek and sheetrock are inspected then the Condition Use Permit will be in place so then the Business License can be issued. Byron Ames stated for the record it does not have to be tyvek, any brand will work. Attorney Powell stated looking into the future, traffic, signage, dust, noise ect. These are usually things that are considered when issuing a Conditional Use Permit. Jill Jacobson asked Collins what he did with the waste materials like sawdust and wood scraps. Collins Prescott answered he is still working through that, he has a dumpster on site, takes wood scraps home and burns them in the fireplace. Jill Jacobson asked if he plans on stock piling on the property. Collis Prescott answered no, and stated the locating is very visible from the road and he wants to make as appealing as possible.

Francis City Planning Commission December 4, 2013 Julie Keyes commented the ingress and egress is open, should not be a concern. If he is not having a showroom we don’t have to worry about parking. Attorney Powell commented this could turn into a place with a showroom. Julie Keyes stated he does have a lot of parking area. She asked Collins if everything that is not fenced basically goes with that building. Collins Prescott answered yes, there is about 30 feet. Collins Prescott added that he could move the fence and have more parking if needed. Attorney Powell asked where the access is. Collins Prescott answered straight off SR 32. Collins Prescott asked if he had a port-a-potty, could he have employees. Rae Prescott answered not until you meet all of the building codes. Byron Ames responded if the building is not up to code the risk is very high. Planning Commission recommended approval of Conditional Use Permit subject to the following conditions: Requirements for Phase 1: Fire department review (completed) Sketch of building layout (completed) 1. Install building wrap on exterior of building. 2. Install sheetrock on interior of building. 3. Install exhaust systems All of the above inspected by building inspector when completed. No employees allowed during phase 1 until phase 2 requirements are completed. When above requirements are completed, Conditional Use Permit and Business License may be issued. Requirements for Phase 2: 1. Connected to water 2. Connected to sewer 3. Install siding on exterior of building All of the above must be completed by October 15, 2014. If not completed by October 15, 2014 Conditional Use Permit and Business License will be revoked and owner will be required to report to the Planning Commission for renewal of Conditional Use Permit and Business License. General Conditions:

No stockpiling of waste Signage to be incompliance with City Code If additional parking is needed, owner will move fence. Owner will comply with City Building Inspector requirements based on building codes.

When all requirements are met owner will have a permanent Conditional Use Permit. Julie Keyes motioned so moved. Byron Ames seconded the motion. Motion passed unanimously.
