Planning Commission Staff Report September 6, 2017 Laura Abernathy, Planning Coordinator Use on Review Renewal – Rachel Snow of 2349 Palisades Loop

Background/History Rachel Snow currently has a Use on Review issued for her property at 2349 Palisades Loop (described as Lot 6R of Block 5 of Palisades Subdivision) to operate an in-home daycare. The license came under review by the city following a complaint from the developer citing that the covenants in the Palisades Subdivision does not allow for in-home businesses (Article II – Use Restrictions of the Amended Declaration of Covenants, Conditions, and Restrictions). On March 6, 2017, Sturgis City Council approved that the Use on Review may continue, and will be reviewed after a six-month period, with the hope that the applicant can come into compliance with the covenants of her subdivision. The six-month review is coming to an end, and the applicant will need to update the Planning Commission and City Council on her efforts to amend the covenants of the Palisades Subdivision, as stated in Article IV - Amendments of the Amended Declaration of Covenants, Conditions, and Restrictions. Recommendations The applicant has garnered 75% of the required 90% signatures needed to amend the covenants. Based on the progress made by the applicant on working to amend the covenants, city staff would recommend approval that the Use on Review may continue for another six months at this location. If the Use on Review is approved by council at the September 18 meeting, the Planning Commission will review the use again in March of 2018 on a yearly basis. Budget Impact At this time there is no direct financial impact to the City budget.

Re: 2349 Palisades Loop Use on Review

Dear Ms. Snow, On March 6, 2017, the Sturgis City Council approved a Use on Review for an in-home daycare to operate on your property located at 2349 Palisades Loop. The Council issued the Use on Review with a six-month review period, which will expire on September 6, 2017. During this time, the Council requested that you come into compliance with the covenants of the subdivision, or show that you are actively working with the developer on amending the covenants to allow for in-home businesses. This letter is to inform you that the six-month review period for this Use on Review is coming to an end. The Use on Review will be reviewed at the next Planning Commission meeting to be held on Wednesday, September 6 at 5:30pm in the front conference room at Sturgis City Hall at 1040 Harley-Davidson Way. The Planning Commission will review the renewal and make a recommendation to the Sturgis City Council. The Council will then review the renewal at their meeting scheduled for Monday, September 18 at 6:30pm at the Meade County Erskine Building at 1300 Sherman Street. We request your presence at both of these meetings to update the Commission and Council on the status of efforts to come into compliance or amend the covenants of your subdivision.
