WHEREAS, Tooles Contracting Group, LLC (hereinafter "TOOLES) and Detroit Medical Center (hereinafter "OWNER"), which term shall cover all Owners' representatives including, as appropriate, the Architect or Construction Manager) have entered into a contract for the construction or improvement of: DMC - 27 Bed Observation Unit
1. PAYMENT
$37,780.00

And, WHEREAS, TOOLES desires to subcontract certain work specified in the Contract Documents , and SUBCONTRACTOR desires to perform said work at the prices and upon the terms and conditions hereinafter expressed, including the Contract Documents which are expressly incorporated herein by reference as if restated in full.

2. PERFORMANCE AND PAYMENT BONDS

No bond is required.
3. CONTRACT DOCUMENTS

Bond is required. Immediately upon receipt of this agreement, SUBCONTRACTOR shall at the expense of SUBCONTRACTOR furnish to TOOLES performance and payment bonds in a form, and from a surety, acceptable to TOOLES in the full amount of this agreement .
