STEPHEN F. AUSTIN STATE UNIVERSITY VOLUNTEER COACH AGREEMENT

I, , subject to the terms and conditions stated in this Volunteer Coach Agreement ["Agreement"] agree to serve as a Volunteer Coach in the Division of Intercollegiate Athletics of Stephen F. Austin State University ["University"] in the sport of for the academic year . I hereby agree as follows: 1. I understand that the Head Coach in any sport and his/her assistants and all volunteer coaches are directly responsible, separately and collectively, to the Director of Intercollegiate Athletics for compliance with the policies and procedures of the Division of Intercollegiate Athletics, the policies and procedures of the University, the rules and regulations of the Southland Conference of Faculty Representatives and the constitution and bylaws (and official interpretations) of the National Collegiate Athletic Association (NCAA). 2. I further understand that all funds collected or used in the interests of the University Intercollegiate Athletics Program will be administered from source to expenditure in accordance with the policies of the University and the rules and regulations of governing bodies for intercollegiate athletics with which the University is affiliated. Any violation of this paragraph is cause for immediate termination of my appointment as a Volunteer Coach. 3. I understand that the Head Coach is my direct supervisor, and I will perform duties as assigned by the Head Coach and his/her designee and within the confines of this Agreement. 4. I agree to conduct myself in a manner that reflects sportsmanship

and honesty at all times.

5. I agree to comply with the rules and regulations of the National Collegiate Athletic Association and will not receive compensation or remuneration from the University's Division of Intercollegiate Athletics or any organization

funded in whole or in part by the athletics department

or that is involved in the promotion

of the

University's athletics program (e.g., Varsity Club, Alumni Association, etc.) 6. As a volunteer coach I am not prohibited from receiving compensation from outside the athletics department for performing duties for another department or office of the institution provided: •

The compensation received for those duties is commensurate those same or similar assignments;

with that received by others performing



The time devoted to those duties is consistent with the time devoted by others receiving commensurate compensation for the same or similar assignments;



The individual is qualified for and is performing

By NCAA regulations, as a volunteer coach I may receive complimentary meals incidental to organized team activities (e.g. pre- or post-game meals, occasional meals, but not training table meals) or meals provided during a prospective student-athlete's visit, provided I dine with the prospective student-athlete. 11. I understand that public information in respect to the team, players and coaches will be provided through the Athletics Media Relations Office and in accordance with University policy. I agree to retain in confidence all confidential matters including information concerning student-athletes (other than student directory information as allowed by law or policy). I further agree, upon termination of this Agreement, to return to the University all documents or copies thereof or any other materials supplied to me by the University pursuant to this Agreement which may be designated as confidential or proprietary to the University. 12. I agree to report any suspected violations of Southland University to athletics department compliance personnel.

13. I understand that I am not an employee of the University and shall not be entitled to wages, salary or any benefits applicable to employees of the University. I do understand that I will be permitted to obtain keys to facilities as necessary to fulfill my assigned duties and, at my expense, a parking permit. I further understand that such parking permit and keys must be returned to the Athletics department upon my termination for any reason. 14. I understand that I am permitted to drive a University owned vehicle or a vehicle rented by the Head Coach for approved travel to and from a competition site provided I have received an "Approved Driver Certificate" issued by the University based on prescribed training, demonstrated proficiency and satisfactory driving record. 15. I understand that I am neither authorized nor empowered to act as agent for the University for any purpose and shall not on behalf of the University enter into any contract, warranty, or representation as to any matter. 16. I agree to be liable for my own negligent acts or omissions. 17. This Agreement shall be governed and construed in accordance with the laws ofthe

State of Texas.

18. This Agreement may be terminated at any time for any or no reason, with or without cause, with or without notice. Once the head coach designates a volunteer coach, the head coach may release the volunteer coach, but may not replace the volunteer coach with another volunteer coach until the following academic year. 19. This Agreement and all applicable

laws, policies and regulations

between the University and me with respect to volunteer

coaching.

WAIVER AND RELEASE: 1. In consideration of being permitted to serve as a volunteer athletic coach at Stephen F. Austin State University, I hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE Stephen F. Austin State University, the Board of Regents, the State of Texas, their officers, servants, agents, and employees (hereinafter referred to as RELEASEES)from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES,or otherwise, while participating in such activity, or while in, on or upon the premises where the activity is being conducted or in transportation to and from said premises. 2.

To the best of my knowledge,

I can fully participate

in this activity.

I am fully aware of risks and hazards

connected with the activity and I hereby elect to voluntarily participate in said activity, and to engage in such activity knowing that the activity may be hazardous to me and my property. I VOLUNTARILY ASSUME FULL RESPONSIBILITYFOR ANY RISKSOF LOSS, PROPERTYDAMAGE OR PERSONAL INJURY, INCLUDING DEATH, that may be sustained by me, or any loss or damage to property owned by me, as a result of being engaged in such an activity, WHETHER CAUSED BYTHE NEGLIGENCEOF RELEASEESor otherwise. 3.

It is my express intent that this Release and Hold Harmless Agreement shall bind the members of my family and spouse (if anv), if I am alive, and my heirs, assigns and personal representative, if I am not alive, shall be deemed as a RELEASE,WAIVER, DISCHARGE AND COVENANT NOT TO SUE the above named RELEASEES. I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of Texas. 5. I UNDERSTAND THAT THE UNIVERSITY WILL NOT BE RESPONSIBLEFOR ANY MEDICAL COSTS ASSOCIATED WITH AN INJURY I MAY SUSTAIN. 6. I also understand that I should and am urged by SFA to obtain adequate health and accident insurance to cover any personal injury to myself which may be sustained during the activity or the transportation to and from said activity. IN SIGNING THIS RELEASE, I ACKNOWLEDGE AND REPRESENTTHAT I have read the foregoing Waiver and Release, understand it and sign it voluntarily as my own free act and deed; no oral representations, statements or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this Release for full, adequate and complete consideration fully intending to be bound by same.
