Authorizing Memorandum of Agreement Providing for a TwelveMonth Extension of Contract No. 13-12 - Bayview Cemetery Maintenance and Operations, PM Landscaping

At its meeting of April 18, 2013, the City Council adopted a motion approving in second reading Ordinance No. 13-1723 exempting the purchase of cemetery maintenance and operations services from competitive bidding and approving the Agreement for Bayview Cemetery Maintenance and Operations for 2013-2015 between Robert S. Scheidt d/b/a PM Landscaping , and the City of Ketch ikan . As the City Council will recall , the agreement provided for three additional one-year renewal periods. As indicated in the attached memorandum of Contracts/Grants Administrator Chet Hugo, PM Landscaping has agreed to a twelve-month extension of the contract to June 15, 2018. Paragraphs (c) and (d) of Section 3 of the agreement provide for the twelvemonth renewals, incorporating price adjustments based upon the Consumer Price Index, all Urban Consumers, U.S. City Average for the prior calendar year. Based on the Consumer Price Index for 2016, the Finance Director has recommended that the maintenance and operations base rate be increased to $5,206.05 per month. A motion has been prepared for City Council consideration .

RECOMMENDATION It is recommended that the City Council adopt the motion authorizing the City Manager to execute the Memorandum of Agreement extending Contract No. 13-12, Bayview Cemetery Maintenance and Operations, between the City of Ketchikan and PM Landscaping for the 2017-2018 contract year.

Extension #3 of Contract 13-12, Bayview Cemetery Operations and Maintenance thru June 15, 2018

On April 18, 2013 City Council adopted Ordinance No. 13-1723 approving the award of the Bayview Cemetery Operations and Maintenance contract to PM Landscaping (owner: R. Steve Scheidt). On the 20th of May the contract was executed fo r a two-year period beginning on June 15, 2013. The contract contains an option to extend for three add itional one-year periods which were approved by City Council for 2015 & 2016. The attached Memorandum of Agreement represents the third and final one-year extension provided for in the contract. As a part of the extension the contract contains a provision for price adjustment based upon the Consumer Price Index, all Urban Consumers, U.S. City Average, all items index (CPI). Finance Director Bob Newell has determined that the monthly base rate for this final extension is $5,206.05.

The twelve month accumulation of the monthly base rate is $62,472.60.

In

adopting the 2017 General Government Annual Budget, The City Council appropriated $75,000 to provide for Bayview Cemetery contractual services, CIP page R-4.

The budgeted

appropriation also covers Burials, Entombments, Marker Settings, etc. which are not included in the monthly base rate. RECOMMENDATION: It is recommended that the City Council adopt a motion authorizing the City manager to execute the Memorandum of Agreement Extension #3, extending Contract 13-12 Bayview Cemetery Operations and Maintenance through June 15, 2018 and increasing the base monthly rate to $5,206.05. The Memorandum of Agreement Extension #3, as approved and signed by PM Landscaping, is attached. RECOMMENDED MOTION: I move that the City Council approve the Memorandum of Agreement Extension #3 extending Contract 13-12 Bayview Cemetery Operations and Maintenance thru June 15, 2018 and increasing the base monthly rate to $5,206.05; and authorize the City Manager to execute the Memorandum of Agreement Extension #3. MEMORANDUM OF AGREEMENT EXTENSION #3 OF 3 YEARLY EXTENTIONS FOR CONTRACT 13-12, BAYVIEW CEMETERY OPERATIONS AND MAINTENANCE, THRU JUNE 15, 2018

The City of Ketchikan and PM Landscaping agree to extend Contract 13-12 Bayview Cemetery Maintenance and Operations for 2013-2015 from June 15,2017 until June 15, 2018. The compensation for general maintenance and operations is increased to Five Thousand Two Hundred Six Dollars & Five Cents ($5,206.05) per month. Compensation for burials, entombments, and marker settings remains the same, as outlined in Exhibit B of Contract 13-12. All other terms and conditions of Contract 13-12 remain the same.
