The attached ordinance was approved in first reading at the City Council meeting of February 1, 2018. If adopted in second reading , Ordinance No. 18-1864, provides for amending subsection (d) of Section 14.20.045 and subsection (a) of Section 14.40.020 of the Ketchikan Municipal Code to adjust the semi-annual billing periods for reserved moorage as follows : • •

May 1 through October 31 . November 1 through April 30.

The rationale for adjusting the semi-annual billing periods is detailed in Port and Harbors Director Steve Corporon 's transmittal memorandum and requires no elaboration on the part of my office. I concur with the Port & Harbors Director's recommendation. At the City Council meeting of February 1, 2018, Mr. Charles Starr addressed the City Council to suggest alternative semi-annual billing periods. As requested by Mayor Williams, Mr. Starr's proposal will be considered by the Port & Harbors Advisory Board at its meeting of February 13, 2018. Mr. Corporon will be attending the City Council meeting of February 15, 2018, in order to address any questions and/or concerns Councilmembers may have. A motion has been prepared for City Council consideration.

RECOMMENDATION It is recommended that the City Council adopt the motion approving in second reading Ordinance No. 18-1864 amending subsection (d) of Section 14.20.045 and subsection (a) of Section 14.40.020 of the Ketchikan Municipal Code entitled "Reservation of Floats" and "Mooring Facilities Reserved Moorage Fee ," respectively, relating to moorage fees and charges; and establishing an effective date.

THE CITY OF KETCHIKAN, ALASKA ORDINANCE NO. 18-1864 AN ORDINANCE OF THE COUNCIL OF THE CITY OF KETCHIKAN, ALASKA; AMENDING SUBSECTION (d) of SECTION 14.20.045 AND SUBSECTION (a) OF SECTION 14.40.020 OF THE KETCHIKAN MUNICIPAL CODE ENTITLED "RESERVATION OF FLOATS" AND "MOORING FACIUTIES RESERVED MOORAGE FEE", RESPECTIVELY; RELATING TO MOORAGE FEES AND CHARGES; AND ESTABUSHING AN EFFECTIVE DATE.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KETCHIKAN, ALASKA, AS FOLLOWS:

Section 1: Amendment. Subsection (d) of Section 14.20.045 of the Ketchikan Municipal Code, entitled "Reservation of floats," is hereby amended to read as follows: " (d) It shall be the responsibility of the club renting a float to collect fees from its members for the reserved float and stalls. Such fees shall be payable in advance in two equal semi-annual payments due on [Mareh] May 1sc and [September] November 1sc of each year, and shall be, at a minimum, equivalent to the fee for the combined float and stall length or the reserved float. The provisions ofKMC 14.40.060 shall apply except that the club rather than the boat owner shall be subject to an action by the city for fees due under this section."

Section 2: Amendment. Subsection (a) of Section 14.40.020 of the Ketchikan Municipal Code, entitled "Mooring facilities reserved moorage fee," is hereby amended to read as follows: "(a) Boat owners having applied for and been granted a reserved mooring space shall be required to show proof of ownership and pay in advance semi-annual mooring facilities reserved moorage fees, which fees are charge for the period of [Mareh] May 1sc through the last day of [AttgtJ:st] October and for the period of [September] November l sc through the last day of [February] April. Payment shall be made in either of the following ways only: (1) Payment in full for the period [Mareh] May r cthrough [Attgttst]

For all boat owners making payments semi-annually the billing period shall be six months."

Attached is Ordinance No. 18-1864, which was prepared by the City Attorney's office at the request of Port and Harbors staff. The proposed changes would adjust the semi-annual billing periods for reserved moorage as follows: • •

March 1 through August 31 would change to May 1 through October 31 . September 1 through February 28/29 would change to November 1 through April 30.

Shifting the two 6-month periods by 2 months will make it easier for staff and customers , especially customers seeking seasonal moorage. Currently customers seeking to continue seasonal reserved moorage for September or October are required to prepay for a 6 month period from September through February and then seek a refund when they pull their boat for the winter. If adopted there would be one additional billing period to cover the 2-month transition period this year only and a flyer would be included in all bills explaining the change and assuring customers they will still end up paying the same amounts for reserved moorage and this is not a hidden rate increase. The Port and Harbors Advisory Board reviewed the proposed ordinance at their meeting of January 9, 2018, and voted unanimously to recommend approval. Port and Harbors staff also reviewed the proposed changes with Finance Department staff to ensure there were no accounting or implementation issues.

Regular Ketchikan City Council meeting was called to order by Mayor Williams at 7:00 p.m., February 1, 2018, with the following members present: Dick Coose, Mark Flora, Janalee Gage, Julie Isom, David Kiffer, Robert Sivertsen and Judy Zenge. The Pledge of Allegiance was given by all persons in the Chambers. Staff present were Manager Amylon, Assistant Manager Martin, Deputy Police Chief Dossett, Library Director Tully, Public Works Director Hilson, Electric Division Manager Donato, Electric System Engineering Manager Bynum, City Attorney Seaver, Port and Harbors Director Corporon, Finance Director Newell and C ity Clerk Suiter.

COMMUNICATIONS Mayor Williams said there was additional information laid on the table concerning the emergency repair of Beaver Falls Generator No. 4 as well as a letter concerning a downtown bus stop from Joseph Machini.

PERSONS TO BE HEARD Charley Starr, Commodore of the Ketchikan Yacht Club, spoke about the rate change for reserved moorage. He asked the Council to consider different timing, changing the months from May through ~tober to April through September.

CONSENT AGENDA Approval of the Minutes of the Regular City Council Meeting of January 18, 2018 Moved by Sivertsen, seconded by Coose the City Council approve the minutes of the regular City Council meeting of January 18, 2018. Contract No. 17-38 - City of Ketchikan Vehicle Towing, Storage and Disposal, Purdy's Totem Towing Moved by Sivertsen, seconded by Coose the City Council accept the bid of Purdy's Totem Towing for Contract No. 17-38, City of Ketchikan Vehicle Towing, Storage and Disposal; authorize funding from the Solid Waste Disposal Division's 2018 Salvage and Disposal of Impounded Property Account No. 620.02; and direct the city manager to execute the contract documents on behalf ofthe City Council. Mr. Lagueux provided a project overview by detailing how they've reached the point they are at today, noting they planned to be back before the Council with a final presentation in April. He provided scenarios for each berth, explaining the traffic flow options they considered. He described some of the feedback they have heard during the public meetings, indicating many comments had been incorporated into the resulting options. He emphasized that what he was showing were recommendations that will be updated and refined as they move forward . He said there would be an updated and streamlined presentation in April. He answered questions from the Council. In response to Mayor Williams, Manager Amylon said he is discussing with the city attorney the te rms of the LID used to build the Berth III parking lot as to what impact that may have on the project.

Ordinance No. 18-1868 - Authorizing Negotiation of an Agreement with The Great Alaskan Lumberjack Show, LLC and John R. Dawson - Pedestrian Promenade Easements, Thomas Basin Easement - First Reading Copies of Ordinance No. 18-1868 were available for all persons present. Moved by Coose, seconded by Kiffer the City Council approve in first reading Ordinance No. 18-1868 authorizing negotiation of an agreement between the City, The Great Alaskan Lumberjack Show, LLC (TGALS) and John R. Dawson (Dawson); giving TGALS an easement in T homas Basin, with TGALS and Dawson g iving the City easements for a pedestrian promenade; and establishing an effective date. City Attorney Seaver said this is being brought forward in order to provide a quicker method to process the easements. He and Manager Amy lon answered questions from the Council. Motion passed with Gage, Flora, Isom, Zenge, Coose, Kiffer and Sivertsen voting yea.
