Ball State University Volunteer Coach Agreement Athletics Compliance Office
I, ,subject to the terms and conditions stated in this Volunteer Coach Agreement, agree to serve as a Volunteer Coach with the Athletics Department at Ball State University (“University”) in the sport of ____________________________ for the ________________________ academic year. I agree as follows: 1. I understand the head coach, their assistants and all volunteer coaches are directly responsible, separately and collectively, to the Athletics Director, the policies and procedures of the University, the rules and regulations of the Mid-‐ American Conference, the rules and regulations of the Midwestern Intercollegiate Volleyball Association, and the constitution and bylaws (and official interpretations) of the National Collegiate Athletic Association (“NCAA”). 2. I understand all funds collected or used in the interests of the Athletics Department will be administered from source to expenditure in accordance with the policies of the University, and the rules and regulations of governing bodies for intercollegiate athletics with which the University is affiliated. Any violation of this paragraph is cause for immediate termination of my appointment as a voluntary coach. 3. I understand the head coach is my direct supervisor, and I will perform duties as assigned by the head coach and their designee within the confines of this Agreement. 4. I agree to conduct myself with honesty and sportsmanlike conduct at all times. 5. I agree to comply with all NCAA rules and regulations, and will not receive compensation or remuneration from the Athletics Department, any organization funded in whole or in part by the Athletics Department, or that is involved in the promotion of the Athletics Department (e.g., booster club, athletics foundation, etc.). 6. I understand I may not do any of the following while serving as a volunteer coach: a. Receive or place phone calls to prospective student-‐athletes. b. Write, email, text or otherwise communicate with prospective student-‐athletes. c. Receive any on-‐campus or off-‐campus meals during unofficial visits. d. Scout opponents off-‐campus. e. Travel with an assistant or head coach who is evaluating and/or coaching a prospective student-‐athlete. f. Provide any student-‐athlete or prospective student-‐athlete an extra benefit, such as meals, lodging or transportation. g. Receive complimentary admission to a University athletic event other than for the sport for which you are serving as a volunteer coach (not even if attending in the company of a prospective student-‐athlete). h. Receive cash bonuses, stipends, or gifts related to my volunteer coaching from the Athletics Department, the head coach, or any outside groups associated with the Athletics Department (e.g., booster club, etc.). i. Perform recruiting coordination functions. j. Gamble or wage anything of value on sports that are sponsored by the NCAA, whether amateur or professional. k. Receive housing benefits (including preseason training camp), except during away-‐from-‐home contests. l. Coach in the same sport for which I am a volunteer coach pursuant to this agreement at a high school, prep school, or junior college. Coaching at the junior high level is not prohibited. m. Coach prospective student-‐athletes in the sport for which I am serving as a volunteer coach pursuant to this agreement at a sports club, except when coaching at a sports club or organization located within a 50-‐mile radius of the University and all prospective student-‐athletes participating in the sports club I coach are within the categories of prospective student-‐athletes described in NCAA Bylaw 13.11.2.3 (which requires all prospective student-‐athletes reside within a 50-‐mile radius of the University’s campus). 7. I understand that I am permitted to do the following while serving as a volunteer coach: a. Receive compensation for employment at a university-‐sponsored sports camp or clinic. b. Receive a maximum of two (2) complimentary tickets to home contests in the sport for which I am serving as a volunteer coach. c. Receive meals during a prospective student-‐athlete’s official visit, as long as I dine with the prospective student-‐ athlete. The head coach shall decide in his or her sole discretion whether a volunteer coach is permitted to attending meals during an official visit. d. Receive complimentary meals incidental to organized team activities (e.g., pre-‐game meal, post-‐game meal), but not training table meals. e. Receive travel expenses (e.g., meals, lodging, etc.) associated with away games in the sport in which I serve as a volunteer coach. f. Receive parking expenses associated with practice and competitions.

g. Receive equipment incidental to coaching duties (e.g., shoes, shirts, jackets, shorts, etc.). h. Receive compensation from the University for duties performed outside the Athletics Department from an organization not funded by the Athletics Department. I understand public information in respect to the team, players and coaches will be provided through the Athletics Department Media Relations Office and in accordance with University policy. I agree to retain in confidence all confidential matters, including information concerning student-‐athletes (other than student directory information). I further agree, upon termination of this Agreement, to return to the University all documents or copies thereof or any other materials supplied to me by the University pursuant to this Agreement which may be designated to be confidential or proprietary to the University. I agree to report any violations of Mid-‐American Conference, Midwestern Intercollegiate Volleyball Association, or NCAA legislation involving the University to Athletics Compliance Office. I understand that I am not an employee of the University and shall not be entitled to wages, salary or any benefits applicable to employees of the University. I do understand that I will be permitted to obtain keys to facilities as necessary to fulfill my assigned duties and, at my expense, a staff parking permit. I further understand that such parking permit and keys must be returned to the Athletics department upon my termination for any reason. I understand that I am neither authorized nor empowered to act as agent for the University for any purpose and shall not on behalf of the University enter into any contract, warranty, or representation. I agree to be liable for my own negligent acts or omissions. This Agreement shall be governed and construed in accordance with the laws of the State of Indiana. This Agreement may be terminated at any time for any reason or no reason, with or without cause, and with or without notice. Once the head coach designates a volunteer coach, the head coach may release the volunteer coach, but may not replace the volunteer coach with another volunteer coach until the following academic year. This Agreement constitutes the entire understanding between the University and me with respect to volunteer coaching.

VOLUNTEER COACH: HEAD COACH: By: By: Printed Name: Printed Name: Date: Date: WAIVER AND RELEASE: In consideration of being permitted to serve as a volunteer coach at Ball State University, I assume the risk that may result from my participation as a volunteer athletic coach. I understand that the risks of my participation as a volunteer coach include being seriously injured or killed. I am knowledgeable about the sport for which I am serving as a volunteer athletic coach, have extensive experience related to the sport and am aware of the potential for injury and/or death while coaching. I do hereby release and hold harmless The Board of Trustees of Ball State University, and its officers, employees and agents, from all liability for property damage, personal injury and/or death, which occurs as a result of my participation as a volunteer athletic coach. The Parties agree that this Agreement does not waive or release any rights I may have under Indiana law governing workers’ compensation.
