Bylaws 13 and 16: Entertainment

While men and women basketball are in evaluation periods, check out the upcoming February Dead Periods for other sports in Compliance Assistant.

We’re going online! Recruiting coaches and medical personnel now have access to Compliance Assistant. In addition, practice logs are available online.

Don’t forget to re-

Whether you’re recruiting a talented PSA or coaching and mentoring current SA’s, everyone wants to establish a helpful, trusting relationship between coach and player. All PSA’s must be treated equally, regardless of your interest, and so too, must SA’s, regardless of the depth of your relationship/mentorship. Bylaws 13, Recruitment, and 16, Awards, Benefits and Expenses for Enrolled Students, have articles governing entertainment opportunities and expenses for recruits and teams alike. Here are a few things you can do to keep the troops occupied without incurring a violation:

Recruits on Official Visits:

In addition to transportation and accommodation expenses, coaches or other athletic department representatives can provide entertainment to events held on campus during the visit for the PSA and his parents/ guardians.

Three complimentary admissions to a campus athletics event may be provided to the PSA and parents/guardians accompanying the PSA on the visit. Siblings, friends, cousins are not included, although you could reserve seats adjacent to the complimentary seats, as long as they pay normal cost of tickets.

My PSA signed an NLI - NOW WHAT?

A lunch, dinner or brunch at the home of an institutional staff member, is permitted.

One meal may be provided to the PSA and parents/legal guardians during the unofficial visit. If campus dining facilities are open, the meal must take place on campus.

For more information about entertainment do’s and don’ts for recruits, see Bylaw 13.6-13.7.2.6.

Team Entertainment:

Recreational entertainment activities such as snowmobiling, boating, etc., can be provided by an institutional staff member to entertain the PSA and parents/legal guardians as long as the cost of this entertainment is assessed against the $30 per-day entertainment limit, and does not exceed this limit.

Recruits on Unofficial Visits:

Three complimentary admissions to an on-campus athletic event to the PSA and parents/ legal guardians accompanying PSA on unofficial visit may be provided. Again, siblings, friends, cousins are not included.

The institution may pay the actual costs for entertainment which takes place within a 100mile radius of where a team plays or practices for an away contest.

Tickets to professional sport contests during away games may be provided as reasonable entertainment if the institution pays the actual costs, or if the tickets are complimentary from a representative of athletic interests, including boosters, for the team’s entertainment during an away game.

During vacation periods where a team is required to remain on campus and classes are not in session, the institution may provide actual costs for reasonable local entertainment.

The institution may rent movies including pay-perview movies in their hotel rooms for SA’s or take the team to the movies immediately before an away contest or en-route, or the night before a home or away contest.

For more information on Team Entertainment, see Bylaw 16.7.

But what about off-campus entertainment for recruits and SA’s?

Jose wants to go to Niagara Falls and ride the Maid of the Mist!

Coach thinks it may be a matter of timing and says “I’m not

Jose, a PSA from Brazil in men’s soccer, really wants to see Niagara Falls and ride the Maid of the Mist while on an Official Visit. Can his student host take him there and

provide this activity? No. Bylaw 13.6.6.1 restricts entertainment of PSA’s and his/her parents or legal guardians, to on-campus activities only, UNLESS on-campus dining facilities are closed. If, however, Jose becomes a team member and as a(n) SA is required to remain on campus during a vacation period, the coach can provide this trip as entertainment for all team members. Better yet, perhaps a booster or alumnus could provide the expenses!

there is a play on campus which she and her parents would like to attend. The cost of tickets exceed the daily entertainment allowance. Is there a way Annie and her parents can see the play? Yes. Although Annie is not permitted to pay for any entertainment that has been arranged by the institution, she and her parents can see the play, along with the Student Host, providing the cost of attendance does not exceed the total entertainment allowances for both days of the visit.

Annie, a basketball PSA on an Official Visit with her Mom and Dad, will be attending an on-campus basketball game on the second day of her visit, with the complimentary tickets provided by the Athletic Department. On the first night of her visit, however,

My PSA just signed a(n) LOI/NLI! What’s next?

sure about that, Jose. Let me look into it.”

How much contact can you have after an athlete has financially committed to attending your institution?

COMPLIANCE

TOOLS

As we approach the time when we will be able to participate in the National Letter of Intent program, we are currently aiming to mimic the requirements of this program to the extent possible, so that these regulations will be more familiar as we move on to our final admission. For those of you who have signed prospects and offered financial assistance, you’re probably wondering how much contact you can have with the prospect once he/she has signed and accepted the offer? Here’s a few tips:  There is no limit on the number of phone calls,

nor on which institutional staff members can call the PSA, EXCEPT boosters, enrolled students and SA’s: they are not permitted. Bylaw 13.1.3.3. In a 19th July 2013 official interpretation, the NCAA Division II Legislative Committee determined…

“that it would be permissible for an institution's coaching staff member to have contact with a prospective studentathlete who has signed a National Letter of Intent or written offer of admission/ financial aid with the coach's institution outside a permissi-

ble contact period. [References: Bylaws 13.02.4 (contact and evaluation periods), 13.02.4.1 (contact period), 13.02.4.2 (evaluation period), 13.02.4.3 (quiet period), 13.02.4.4 (dead period) and 13.1.6 (contacts)]”

It is permissible to use a photo of a PSA during a visit in printed institutional items such as season brochures, etc.. The photo, however, cannot be given to the PSA. Bylaw 13.10.6.
