RESOLUTION NO. 17 - 96 PUBLIC DEFENDERS OFFICE AMENDMENT TO RESOLUTION 02-39 - SCOPE OF THE

PUBLIC DEFENDERS ACTIVITIES

WHEREAS, Idaho Code §19-860 allows Boimer County Board of Commissioners to establish and maintain an office of the Public Defender; and

WHEREAS, on the 2"'' day of July, 2002 the Board of County Commissioners passed Resolution #02-39 creating the Office of the Public Defender; and WHEREAS, the Board of County Commissioners desires to clarify the scope of the Public Defender activities; and

WHEREAS, the scope of Public Defender activities is limited exclusively to the following: #1. Indigent Criminal Defense; #2. Civil Contempt; #3. Child Protective Act proceedings. The BOCC reserves the right to expand the scope of Public Defender services on a caseby-case basis. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Bonner County, Idaho, that the scope of Public Defender activities is limited exclusively to #1. Indigent Criminal Defense; #2. Civil Contempt; and #3. Child Protective Act proceedings. The BOCC reserves the right to expand the scope of Public Defender services on a case-by-case basis. A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BONNER

COUNTY, IDAHO ESTABLISHING AND DECLARING THE OFFICE OF THE PUBLIC DEFENDER AND DECLARING THAT THE PUBLIC DEFENDER AND

DEPUTY PUBLIC DEFENDERS FOR BONNER COUNTY, IDAHO SHALL BE FULL TIME EMPLOYEES OF BONNER COUNTY.

WHEREAS, Idaho Code § 19-860 allows Bonner County Board of Commissioners to establish and maintain an office of the Public Defender; and

WHEREAS, the Board of County Commissioners ofBonner County, Idaho, deem full-time Public Defender and DeputyPublicDefenders to be in the best interest of Bonner County, Idaho, and of the citizens ofBonner County, Idaho; and WHEREAS, the term of office ofthe "Public Defender" shall be for a foiu: (4) year term; and WHEREAS, in accordance with Idaho Code § 19-860(1), the rate of annual compensation given the duties required of a Public Defender which is less than required for the Prosecuting Attorney shall be at a rate of annuallyof approximately eighty five percent (85%) of that of the ProsecutingAttorney for Bonner County. The initialsalaryrate ofannual compensationfor tihie Public Defenier shall be fifty thousand nine hundred sixty two dollars ($50,962); and

l'^WHEREAS, ) • the Boai'd of County Commissioners ofBonner County, Idaho, deem that the office of the Public Defender be created with the appointed Public Defender, a ChiefDeputy Public Defender, a Deputy Public Defender, a Senior Legal Secretary, a Legal Secretary, and a Receptionist/Legal Clerk, and if demonstrated the Board of County Commissioners may authorize additional deputies and/or support staff; and

WHEREAS, the Public Defender and Deputy Public Defenders shall be required to devote fulltime to the discharge oftheir dutiesduring their tenure in office and serve at the pleasxire of the • Board of County Commissioner; and

WHEREAS, the procedures for the estabUshment of the office of the Public Defender identified under Idaho Code § 19-860(2) shall be instituted through the Administrative Judge of the First Judicial District.

BE IT RESOLVED by the Board of County Commissioners of Bonner County, Idaho, that Bonner Countyherebycreatesthe office of the PublicDefender. The Public Defender will serve at the pleasureof the Board of CountyCommissioners. The initial salary rate of annual compensation for the Public Defendershall be fiftythousand nine hundred sixty two dollars ($50,962). ThePublicDefender andDeputyPublic Defenders arerequired to devote full-time to the dischai'ge of their duties of office; and

IT IS FURTHER RESOLVED that pursuant to the provisions of Idaho Code § 19-860, this Resolution, anyotherapplicable provisions of law, compliance therewith shall be deemed mandatory responsibilities, obligations and duties of the Public DefenderandDeputyPublic Defenders for Bonner County, Idaho, commencing with the term begiimingOctober 1,2002.
