Response to Preliminary Review Comments The following are the response comments for the above mentioned project. Our response comments are in bold. PLANNING DEPARTMENT

1. Legal Description. As the proposed rezoning does not include the entire property, a legal description will need to be submitted. The legal description for the request should extend to the far side of the planned McCrimmon Parkway extension. McAdams Response: Legal description is included with resubmittal. Proposed zoning boundary has been updated. Applications and related material have been updated to reflect the change in acreage included in the proposed request. 2. Map. The map that was submitted should be updated to include a title, name, north arrow and name of the preparer. You may also wish to reduce the size of the map to 11 x 17 or 8½ x 11. McAdams Response: Map has been updated and re-sized. 3. Vicinity Map. A second map depicting the property in relation to the land uses and zoning in the surrounding area should be submitted. Please ensure that the planned McCrimmon Parkway extension is depicted on the map. An aerial map from IMAPs with a zoning overlay and notations as to the surrounding uses would suffice to meet this requirement.

McAdams Response: Two maps are included with re-submittal: a current zoning map and a current land use map. 4. Project Number. A project number of 17-30000001 and file number of REZ 17-01 have been assigned to the application. The project number and file number should be identified on all documents contained in the application packet. McAdams Response: Added. 5. Cover Letter. The cover letter should be updated to provide information about how the request relates to all of the various review criteria in Section 2.4.19(A) of the Administrative Manual. McAdams Response: Letter has been updated to address findings in the Administrative Manual. 6. Owner Consent. Please provide written verification from the owner that you have the authority to make the application on their behalf. McAdams Response: Rezoning application was revised to reflect the increased acreage included in the request. The revised zoning application is signed by the property owner and included with resubmittal. 7. Please include payment for $38 public notice fee with revised materials. McAdams Response: Noted. Payment for $38 public notice fee and an additional $45 due to an increase in acreage is included.

8. Schedule. As discussed, the project has been tentatively scheduled for review by the Morrisville Planning and Zoning Board on Thursday, May 11 with anticipated consideration by the Town Council as follows: June 13 – Initial Briefing June 27 – Public Hearing July 11 – Potential Action In order to maintain this schedule, a revised application packet that fully responds to the above comments must be submitted no later than Monday, April 24 with additional packets for distribution to the Planning and Zoning Board due on Wednesday, April 26. General Use Rezoning Portion of PIN 0755-48-5334 Project #17-30000001 File #REZ 17-01 Rezone from Conditional – Industrial Management, C-IM to BAC, Business Activity Center

Dear Mayor and Council Members: The owner of the subject property, Southport Business Park Limited Partnership, is requesting to rezone approximately 15.6 acres from C-IM, Conditional – Industrial Management, to BAC, Business Activity Center. The proposed Business Activity Center zoning is justified because it: 1) Is consistent with the Comprehensive Plan, in that the rezoning request is consistent with the Future Land Use Map. The property is designated “Business Activity Center” on the Future Land Use Map. The rezoning request is also consistent with the policies in the Land Use Plan. Specifically advanced are the General Policies and Development Character of the Business Activity Center Future Land Use (5.3.4 of the Land Use Plan) and the Goal and Policies of Chapter 4, including Goal 1 (Policy 1D), Goal 2 (Policy 2E), and Goal 3 (Policies 3A, 3B, 3E). 2) Is required by changed conditions, in that the future McCrimmon Parkway extension will bisect the 22.57-acre property, separating the southern 15.6 acres from Southport Business Park. NCDOT will not permit full-movement driveway connections to McCrimmon Parkway extension or Aviation Parkway. This limit on access is a change in condition that makes the property unusable for flex warehouse or other industrial uses. For this reason, Southport will market the tract for sale; the Business Activity Center zoning allows for a wider range of uses and improves the marketability of the property. 3) Is compatible with existing and proposed uses surrounding the subject land, and is the appropriate zoning district for the land, in

Town of Morrisville Attn: Mayor and Town Council Morrisville NC 27560 that properties to the north are existing industrial and commercial uses, while properties to the west and south are currently zoned BAC. The Future Land Use Map designates this property as a “Business Activity Center”, thus the BAC zoning is the appropriate zoning district for this parcel. 4) Would result in a logical and orderly development pattern, in that the properties to the north are existing industrial and commercial uses, while properties to the west and south are currently zoned BAC. The proposed BAC zoning would allow for an orderly transition of development in this area. 5) Would result in development that is adequately served by public facilities (e.g., streets, potable water, sewerage, stormwater management, solid waste collection and disposal, schools, parks, police, and fire and emergency medical facilities), in that there are adequate public facilities available to allow the development of the parcel using the standards of the BAC zoning district. 6) Would avoid significantly adverse impacts to the natural environment – including, but not limited to, water, air, noise, stormwater management, wildlife, vegetation, wetlands, and the natural functioning of the environment, in that, while no site-specific development is proposed at this time, any future development of the property will follow applicable local, state, and federal regulations regarding impacts to the natural environment. 7) Would not adversely affect property values in the area, in that the proposed zoning is compatible with the zoning of surrounding properties and would not have a negative impact on property values. 8) Would be consistent with the public interest and the purposes and intent of this Ordinance, in that the proposed BAC zoning would allow future development of the parcel that complies with the stated goals of the Future Land Use Map, the Land Use Plan, and the purpose and intent of the Town of Morrisville Unified Development Ordinance.
