Unfortunately, in all youth sports, problems will arise from time to time. While it is the goal of the Newport Mesa Girls Softball League (“NMGS”) that all complaints/incidents will be handled in a courteous manner at the coach/parent/player level, from time to time assistance from the NMGS Board of Directors (“NMGS BOD”) is necessary. If informal efforts amongst coaches, parents, and players have not been successful in resolving the issue, you may utilize the following procedure.1 First, you (“Complainer”) must complete the Complaint-Incident Report Form (available on the NMGS website under “Documents”) and return the completed form (“Complainer Form”) to the VP-Player Agent, a member of the NMGS BOD. The VP-Player Agent will immediately forward the Complainer Form to the NMGS BOD and the accused (“Accused”). The Accused will provide the VP-Player Agent with his/her written version of the incident (“Accused Form”) within three (3) days after his/her receipt of a copy of the Complainer Form. The VP-Player Agent will immediately provide a copy of the Accused Form to the Complainer and the NMGS BOD. If the VP-Player Agent and the parties are unable to informally resolve the issue within five (5) days from the date the VP-Player Agent received the Complainer Form, the Complainer can request that the VP-Player Agent schedule a hearing to be held before the NMGS BOD, to be heard during their next regularly scheduled NMGS BOD meeting. At the hearing, the Complainer and the Accused may bring witnesses and present such other evidence as they deem appropriate. The decision of the NMGS BOD shall be final, and shall be disclosed to the Complainer and the Accused as soon as possible by the VP-Player Agent. The NMGS BOD will determine the disciplinary action of all said disputes. Disciplinary action may include, without limitation, a written warning, suspension from NMGS for a stated period of time, or possible expulsion from NMGS. Disciplinary action may also include monetary restitution if said dispute involved use of funds and/or expenditures not authorized by NMGS. A summary of the dispute and its resolution shall be kept in the records of the NMGS for a period of two years.
