IMPORTANT: The holder of this ticket is granted a limited, revocable license by Pittsburgh Associates, L.P. (“Pirates”) to attend the Event at PNC Park (“Facility”) in the seating area identified on the ticket. DATES AND TIMES OF THE EVENT ARE SUBJECT TO CHANGE; AND SUCH CHANGES DO NOT ENTITLE HOLDER TO A REFUND OR EXCHANGE. Holder is responsible for reviewing www.pirates.com prior to the event to determine whether any schedule change has been made. The holder acknowledges that except as explained above, this ticket does not otherwise confer any rights on him/her, including without limitation, any right to purchase tickets for other Events, ownership rights, leasehold rights, or intellectual property rights. By using this ticket to enter the Facility, the HOLDER EXPRESSLY AGREES to be bound by the following terms and conditions: (1) holder will not transmit or aid in transmitting any description, account, picture, audio or video of the Event (including pre and postgame activities) to any other party for commercial use; (2) holder consents to and grants an irrevocable, unrestricted worldwide license in perpetuity without further compensation for the use in any and all media now or hereafter known, of his/her image or likeness, name, voice, comments or other proprietary or public rights, to the Pirates, the visiting team, the Office of the Commissioner of Baseball, Major League Baseball Properties, Inc., Major League Baseball Enterprises, Inc., MLB Advanced Media, L.P., the MLB Network, LLC, and each of their respective agents and licensees, in any live or recorded broadcast, telecast, photograph, video, audio, audiovisual, and/or other recording of the Event; (3) holder will not violate any standards of Guest Conduct, including those posted on the Pirates’ website PNC Park AZ Guide (www.pirates.com/AZ), provided on signage within the Facility, or communicated orally or in writing by authorized team or stadium personnel; (4) holder will not use the ticket for advertising, promotion (including contests and sweepstakes), or other trade purposes without the express written consent of the Pirates; (5) holder will not resell or offer for resale this ticket in a manner or a price that violates any resale policy published by the Pirates or any Federal, State, or local law or regulation; and (6) holder agrees that this license does not confer any right on holder to receive, participate in or receive any compensation in connection with any promotion, benefit, or giveaway offered by the Pirates as part of the Event. TERMINATION: Holder agrees that breach of the foregoing terms and conditions will automatically terminate this license, holder will not be admitted to or will be removed from the Facility, and holder will not be entitled to any compensation. Holder further agrees that the Pirates may terminate this license for any other reason, in the Pirates’ sole discretion, by tendering to the holder the purchase price identified on this ticket. LOST/STOLEN/DESTROYED TICKETS: Holder acknowledges that the Pirates are under no obligation to replace or reissue this ticket if it is lost, stolen, or destroyed, and that if the Pirates agree to replace or reissue this ticket, holder may be required to pay an administrative fee. Holder assumes the risk that tickets obtained from sources other than the Pirates or Tickets.com may be lost or stolen tickets, which will not be honored and admission will be denied. WAIVER AND RELEASE OF LIABILITY: The holder assumes all risk and danger incidental to the Event, whether occurring prior to, during or after the Event, including specifically but not exclusively, the danger of being injured by thrown or broken bats, thrown or batted balls, objects thrown into the stands for entertainment purposes, promotions or competitions, and spectator conduct. Holder hereby releases the Pirates, the visiting team, Major League Baseball, and the Sports & Exhibition Authority, and each of their players, managers, coaches, affiliates, governing bodies, officers, directors, partners, employees, and agents from any liability for personal injury or property damage sustained by the holder. By entering the Facility, holder irrevocably waives any right he/she may have to assert such claims. DISPUTES: The holder agrees that in consideration for being allowed to enter the Facility, ALL DISPUTES, CLAIMS OR CONTROVERSIES ARISING OUT OF OR RELATING TO THE PURCHASE, SALE OR USE OF THIS TICKET OR ATTENDANCE AT THE EVENT (“CLAIM”) SHALL BE RESOLVED EXCLUSIVELY THROUGH BINDING ARBITRATION conducted in Allegheny County, Pennsylvania before a single arbitrator appointed by the American Arbitration Association (“AAA”) in accordance with its then governing rules and procedures, including the Supplementary Procedures for Consumer Related Disputes, where applicable. The holder and the Pirates WAIVE ALL RIGHTS TO A TRIAL BY JURY. Holder further WAIVES ANY RIGHT TO SEEK CONSEQUENTIAL OR PUNITIVE DAMAGES in any action or proceeding involving any Claim. The holder and the Pirates agree that any Claims must be arbitrated on an individual basis only, and shall not be consolidated or joined with or in any arbitration or other proceeding involving a Claim of another party. OUTSIDE FOOD AND BEVERAGE/GATE POLICY: No bottles, cans or alcoholic beverages may be brought into the Facility. Bags up to the size of 16"x16"x8" will be permitted inside the Facility. All bags are subject to search. Hard sided coolers, briefcases, ice packs and cooler inserts will not be permitted. Water bottles that do not exceed 24 ounces in size and are clear, plastic, sealed and disposable may be brought into the Facility. The Pirates reserve the right to modify these policies in their sole discretion by providing notice on the team’s website (www.pirates.com). RAIN CHECK: If a regulation game is not played on the game date printed on this ticket, please refer to www.pirates.com/raincheck for the rain check exchange policy for this game.
