Agenda Title: Minor Subdivision – Settler’s Village Subdivision Fifth Filing Attachments: Letter from Lot Holding – April 7, 2009 Settler’s Village Fifth Filing Plat Letter from Bill Lanning – April 13, 2009 PURPOSE To review and approve or deny the Minor Subdivision application known as Settlers Village Fifth Filing. The applicant has requested a minor subdivision of the Settlers Village Subdivision to create a fifty (50’) strip of land that will be transferred to the Metropolitan District for the purpose of a public trail with landscaping.

Lamp Rynearson and Associates Town of Milliken Public Works Department A companion case to this minor subdivision will be the review of the landscape plan by the Planning Commission and review and decision by the Town Board. The applicant is completing the landscape pans and intends to submit them to the Town shortly. Staff has reviewed the minor subdivision documents and there are some additional plat corrections and document submittals that need to be made before the plat/documents are complete. STRATEGIC PLAN GOAL(S) IMPLEMENTED The creation of the fifty (50’) foot buffer for the purpose of a landscape buffer that includes a public trail is consistent with both the Johnstown/Milliken Parks, Trails, Recreation and Open Space Master Plan and the approved Planned Unit Development for the property. BUDGET IMPLICATIONS There are no budget implications to this action. PLANNING COMMISSION RECOMMENDATION At their April 15, 2009 meeting the Planning Commission recommended approval of the Minor Subdivision known as the Settler’s Village Fifth Filing to the Town Board with the following conditions: 1. Prior to the plat being signed by the Mayor and recorded with the County that the plat map deficiencies are corrected, any outstanding application documents are submitted and that both the plat map and the outstanding documents are approved by Town staff. 2. The Planning Commission and Town Board review and approve the landscape plan for Tracts A, B and C prior to commencement of any construction within said tracts.

SUGGESTED MOTION “I recommend approval of the Minor Subdivision known as the Settler’s Village Fifth Filing to the Town Board with the following conditions: 1. Prior to the plat being signed by the Mayor and recorded with the County that the plat map deficiencies are corrected, any outstanding application documents are submitted and that both the plat map and the outstanding documents are approved by Town staff. 2.
