INTRODUCTION

The primary objective of this project is to develop a detailed Water/Sewer Consolidation Study with a recommended plan and alternatives which answers questions that the Town of Tupper Lake has about the how district consolidation would affect residents and local governments. The final report will provide the Town with a document that includes the following elements: Executive Summary, Introduction, Asset Information, Financial Summary, Water and Sewer Rates, Local Laws and Intermunicipal Agreements (IMAs), Evaluation of Alternatives, and Recommendations. This information will be utilized by stakeholders to determine: 1) Potential financial savings of district consolidation; 2) management improvements; 3) service delivery changes resulting from a re-organization/consolidation process; and 4) alternative consolidation plans which include complete consolidation of all districts and partial consolidation based on different scenarios identified by the committee. These items will be summarized in the Recommendations section of the Plan. The Town Board hired the Development Authority of the North Country to oversee the district consolidation study process. The Board also appointed a Consolidation Study Committee (CSC) which has been charged with developing a study to evaluate consolidation of the Town’s water and sewer districts. The CSC is comprised of Patricia Littlefield (Town of Tupper Lake Supervisor), Samantha Davies (Town Accountant), Laurie Fuller (Town Clerk), Paul O’Leary (Town Assessor/Code Enforcement/Planner), John Quinn (Councilman), Paul Maroun (Village Mayor), Mary Casagrain (Village Clerk/Treasurer) and Mark Robillard (Village Water/Wastewater Superintendent). The CSC began this initiative with a kick-off meeting on December 8, 2016. Since that time, the CSC has been working to develop a basis of understanding of the Village and Town water and sewer districts, the way in which these districts are provided services, and the cost to taxpayers to within these districts. The results of this initial phase of the project are summarized in this report, known as the EXISTING CONDITIONS REPORT. Appendix A of this report contains copies of the PowerPoint Presentations that summarize the additional details that were reviewed by the CSC at monthly meetings. This report is being funded by and prepared in accordance with the New York State Department of State Work Plan requirements, as outlined in Contract No. T00020GG-3800 and T00021GG0-3800. The Town of Tupper Lake is located in the southern part of Franklin County and has a population of 5,971, according to the 2010 census (see Figure 1). The Town was organized in 1890 and was known as the Town of Altamont until 2004, when the name was changed to the Town of Tupper Lake. Tupper Lake is home to The Wild Center, an interactive natural history attraction, and the Adirondack Public Observatory; both are popular Adirondack tourist 1|Page

destinations. The Town also operates a beach and campground that offers full water, sewer, and electrical hookups for campers. The Town’s water and sewer systems are fed from the Village of Tupper Lake’s systems. The Town has 28 water districts and 25 sewer districts.

As part of the district consolidation study, the Authority is using Geographic Information System (GIS) to map the water and sewer district boundaries for the purpose of analyzing tax parcels and billing customers within each district, and the water and sewer mains based on operator knowledge. The Village water and wastewater operators maintain the infrastructure in the Town through an IMA, and the Village Clerk handles all of the billing for water and sewer service. The Town applies a special district tax on the annual tax bill to certain water and sewer

districts for maintenance fees and/or bond debts. Figure 2 and Figure 3 illustrate the Town’s Water and Sewer Districts, respectively.

ASSET INFORMATION

The following section provides an overview of each of the water and sewer districts within the Town of Tupper Lake. Water and sewer districts are special districts given the task of supplying water and sewer needs to a community1. Each special district is a separately taxed area with individual accounting of revenue and expenses. The Town reports this information on a separate Annual Update Document (AUD) for each district. In New York State special districts are paid for by the customers they serve. In order words, only tax payers within a specified district can be charged for those services. Any debt, operation and maintenance or other system expenses are paid for through the collection of water and sewer rents. Since these expenses vary by district, the Town has established different rates for each of its water and sewer districts.

WATER DISTRICTS

In total, the Town has 28 water “districts” that serve 771 Equivalent Dwelling Units (EDUs) and 771 tax parcels2. The Village sends out a total of 650 bills for these customers. This total includes 1 district extension (WD#8-2) with separately managed debt and 1 “special case” (WD#17) where 29 parcels in the district were not taxed correctly for debt for several years and are now back-charged for taxes owed. Water districts range in age and were constructed over the last 95 years with the oldest district dating back to the early 1920s and the most recent district being constructed in 2004. Town-owned system components include 94,308’ of mainline water pipe, main line valves, hydrants, and corporation/curb stops3. Main line pipe is primarily ductile iron with a small amount of transite, cast iron, PVC, and galvanized pipe present in various districts. There are two water booster pump stations that serve Water District 3 and Water District 15. Village customers are responsible for the maintenance of their own service laterals and system meters for commercial properties. Table 1 shows water system components by district. The Town purchases water from the Village of Tupper Lake and the Town is served by the Village’s Water Treatment Plant, water storage tanks, and distribution system. The Village also provides operation and maintenance for the Town’s water districts. Details regarding the services provided by the Village and the cost for these services are explained in an IMA between the Town and Village for Water and Sewer Districts (2005). See Appendix B. 1

SEWER DISTRICTS

The Town of Tupper Lake has 25 sewer “districts” that serve 786 EDUS and 758 tax parcels. The Village sends out a total of 652 bills for these customers4. This total includes three sewer district extensions (SD#9-2, SD#17-1, and SD#17-2) with separately managed debt and one special case (SD#8-2) where two property owners paid off their portion of the district debt in full and are only taxed for the annual maintenance fee. Sewer districts range in age and were constructed over the last 47 years with the oldest district dating back to 1970 and the newest district constructed in 2006. Town-owned system components include 109,214 feet of sewer mainline and manholes. Town customers are responsible for their sewer laterals/cleanout, and grinder pumps (in certain districts). The Village collection system receives sewage from the Town and transmits it by gravity or via pump stations to the Village’s Wastewater Treatment Plant. Eight districts have grinder pump stations. The ownership and responsibility for operation and maintenance of these stations is not consistently managed across all sewer districts. Three of the eight districts/extensions have grinder pumps that are the responsibility of the private property owners (SD#1, SD#08-1, and SD#08-2). Five of the districts have grinder pumps that are maintained by the Village. The lack of consistency in managing grinder pumps makes it challenging to ensure proper maintenance and system operation. It’s also difficult for water personnel to keep track of the specific scenarios associated with each property that has a grinder pump. To address this issue, it’s recommended that the Town consider standardizing ownership and maintenance responsibility for grinder pumps and lateral piping from the grinder pump to the sewer main as the Town’s responsibility. Formal standardization on the make and model of grinder pumps should also be addressed by board resolution to ensure that all future connections are similar in design and installation. The standardization will ensure that spare pumps/parts are available. Finally, it’s recommended that the Town implement an annual grinder pump inspection program that is implemented by the Village water/sewer department to identify potential issues and better plan for equipment repairs/replacements. Table 2 provides a summary of the Town’s sewer infrastructure.

Authority staff will work with the Village and Town to reconcile differences between the number of parcels being served and the number of customer bills sent by the Village. Parcel data was compiled with information from the Franklin County Real Property Office, the Town Assessor, and the Village Clerk. Differences in the total number of parcels served and customers billed may be due to incorrect parcel data produced by the County; incorrect municipal records; or customers who own several parcels only being sent one bill.

DISTRICT ADJUSTMENTS

One of the objectives of the Existing Conditions Report is to develop an accurate accounting of the customers within each district. This is a critical part of any consolidation study because the customer list will be utilized in future phases to assess the impact on rates as a result of district consolidation. In the process of reviewing Village, Town and County billing records several issues were identified that affect the total parcel and EDU counts for each district. These issues are detailed in Appendix C and summarized below. These adjustments include the assignment of one EDU/parcel in the respective water/sewer district.5 

Parcels Reassigned to District – Some parcels were re-assigned from one district to another after the 2016 tax rolls were issued. Four tax parcels were moved from one district to another and ten parcels that were not recorded to be in an identified district were assigned to a district in 2017.



Parcel Incorrectly Taxed – One parcel in Water District No. 7 was discovered to have been incorrectly taxed. This parcel is an island and does not receive water service. This was corrected in 2017; thereby reducing the total number of parcels in the district by one.



Parcel Subdivision – Eight new parcels were affected by subdivisions in 2017 or 2018 and will be added to the respective water/sewer special district tax rolls.



Parcel Consolidation – Two parcels were affected by consolidation in Water District No. 17. These adjustments will be reflected on the 2018 tax rolls. Some parcels that no longer exist due to prior year consolidation were still listed in billing records; these parcels were deleted.



Parcels Receiving Water and/or Sewer Service Not in District – Thirty-four parcels are presently receiving water and/or sewer service but are not assigned to a district. District consolidation will require that customers not currently in a district are assigned to a district to ensure consistent operation, management and administration. For purposes of this study, these parcels have been assigned to the nearest geographic district that doesn’t have existing debt. Figures 4 and 5 illustrate parcels not in water and sewer districts. Table 3 lists the affected parcels and their proposed district assignment.

FINANCIAL SUMMARY

The Village spends water and sewer revenue to provide services to its district residents. The revenues, expenditures, debt and fund balances are reported annually in a report called an AUD. For this report, AUDs from the last three fiscal years were reviewed (2014, 2015 and 2016). The Town’s fiscal year begins January 1st and ends December 31st so 2017 data was not available at the time of this report. Appendix D contains detailed summaries of AUD information for Town water and sewer districts. The Town manages its water and sewer districts by collecting only the amount of debt needed to cover projected payments in the upcoming year and collecting maintenance fees to cover work that was performed in the prior year. Because unplanned maintenance may exceed available maintenance fund balances, borrowing from the Town’s general fund may be necessary during a given fiscal year to cover payments to the Village. When this occurs the Town then raises rates in the following year to make up the shortfall. These instances can be seen on the AUDs when there are negative fund balances. To move to a more proactive method of managing infrastructure, it’s recommended that the Town consider developing Asset Management Plans for its water and sewer systems. Asset Management Plans would help the Town better plan and budget for future maintenance that will be required to keep systems operating properly.

WATER DISTRICTS

Twenty-one of the Town’s water districts/extensions are debt free at the time of this report and one additional district (WD#15) will be debt free in 2017. In total, the outstanding water district debt reported on the 12/31/2016 Annual Update Document was $564,9456. Water district debt is summarized below:  WD#3 will have new debt in 2017 as a result of an ongoing capital improvement project. The estimated amount of new debt for WD#3 will be $200,000.  WD#7 has two outstanding loans, as reported in the 2015 Annual Update Document: 1) $46,746 will be paid off in 2019; and 2) $192,916 will be paid off in 2031.  WD#8 has outstanding debt of $48,279 that will be paid off in 2019.  WD#16 owes $24,304 that will be paid off in 2019.  WD#17 and WD#17-Other have outstanding debt of $248,000 that will be paid off in 2035.

The 12/31/2016 AUD reported debt total includes the WD#15 debt of $4,700 that will be paid off in 2017, and does not include the $200,000 of new debt incurred by WD#3 in 2017.

The combined fund balance of all the Town’s water districts as reported on the 2016 AUD was $67,098. Figure 6 illustrates the trend in Town water fund balances over the last three years.

SEWER DISTRICTS

Eighteen of the Town’s sewer districts/extensions are debt free at the time of this report and two districts (SD#8-2 and SD#16) will be debt free in 2019. In total, the outstanding sewer district debt reported on the 2016 Annual Update Document is $2.4 million. Sewer district debt is summarized below:  SD#5 has two outstanding loans from the 2015 Annual Update Document: 1) $213,333 that will be paid off in 2021; and 2) $86,327 that will be paid off in 2035.  SD#8-2 has two outstanding loans: 1) $25,989 that will be paid off in 2019; and 2) $2,000 that will be paid off in 2017.  SD#16 has outstanding debt of $10,975 that will be paid off in 2019.  SD#17 has outstanding debt of $53,875 that will be paid off in 2035.  SD#17-1 owes $136,698 that will be paid off in 2035.  SD#17-2 owes $59,881 that will also be paid off in 2035.  SD#23 has the largest outstanding debt of $1.85M and that will be paid off in 2038. The combined fund balance of all the Town’s sewer districts as reported on the 2016 AUD was $35,017. Figure 7 illustrates the trend in Town water fund balances over the last three years.

WATER & SEWER RATES

Town water and sewer rates for Town customers consist of three components. The first component of the rate is based on the charges that the Village assesses the Town customers for supplying water and routine operation and maintenance. This portion of the fee is billed directly by the Village Clerk to Town customers on a monthly basis. In 2017, Town water customers paid $340.80 and sewer customers paid $326.40 per year. The Village’s rates for water customers are established by Village Code in Chapter 50 “Water Rents” Section 50-6 “Flat Rate Schedule” and Section 50-7 “Metered Service Rate”. These rates were last updated 5/18/16. The only metered Town customer is the Wild Center and they pay the same rate as a Village metered customers. The minimum charge per month for a single Village household unit is $21.20 per month or $254.40 per year. The Village charges a premium for Town customers and the minimum charge is $28.40 or $340.80 for a single family unit. The Village’s rates for sewer customers are established by Village Code in Chapter 41 “Sewer Rents” Section 41-3 “Rental Rates”. These rates were last updated in 1996. The minimum sewer charge per month for a single Village household is $22.00 per month or $264 per year compared to a rate of $27.20 per month or $326.40 per year for Town single family unit. The two remaining components of the customer’s bill are levied by the Town on annual real property tax bills issued in January. The Town’s bill includes debt charges and operation/maintenance, above and beyond routine service as outlined in the Village-Town Water/Sewer District IMA. Debt is computed by taking the total annual debt to be paid and dividing by the total number of EDUs that the district serves. In districts that have no debt this charge is $0. Water district debt charges per EDU ranged from $0 (for districts with no debt) to 15 | P a g e

$270.99 per year in 2016. Sewer district debt charges per EDU ranged from $0 to $384.76 per year in 2016. The Town O&M bill is assessed similarly by dividing the total project operation and maintenance expenses for the system from the prior year by the total number of EDUs. Water operation and maintenance fees ranged from $0 to $45 and sewer operation and maintenance fees ranged from $0 to $85 per year per EDU in 2016. Combining these three billing components, the total annual water rates for Town customers can be determined. In 2016 the combined rates ranged from $340.80 to $636.79 for water and $326.40 to $746.02 for sewer. Tables 4 and 5 shows Town water and sewer fees by district. District

LOCAL LAWS & INTERMUNICIPAL AGREEMENTS

As part of this water and sewer district consolidation study, a review was completed of the Town’s existing water and sewer laws. This is an integral part of the study because consolidation of districts may impact existing water and sewer use laws. To complete this part of the study, the Town’s attorney was consulted and it was determined that the Town has limited documentation regarding the consistent use and development of Town water and sewer infrastructure. The primary documents that govern Town water and sewer customers are the Village’s water and sewer local laws, and the Town/Village IMA for Water & Sewer Districts. The IMA was executed 9/10/01 and updated on 9/1/05. The scope of the IMA includes the Village providing water and wastewater treatment at Village facilities, and operation and maintenance of the Town’s system with their water/wastewater department personnel. The Village’s scope also includes overseeing new service connections and billing Town customers for service. The IMA has a term of 30 years and is set to expire 9/1/35. Upon review of the IMA and discussion with Village and Town personnel that oversee the delivery of water/sewer services, it appears that there are some current practices that are not fully described in the current agreement between the Village and Town. It’s recommended that the existing agreement be fully reviewed and updated to reflect current districts served, protocols for operation and maintenance, and billing. In addition to the IMA, the Village had a Contract with the New York State Office for People with Developmental Disabilities (State) to provide the Sunmount facility with water, sewer and electric services. The Town was not a party to this contract and does not incur costs associated with providing service to Sunmount, although the facility is located within the Town limits. This contract was updated annually by amendment through amendment #37; which covered the State’s fiscal year from April 1, 2015 – March 31, 2016 (NYS Contract C152735#37). The Village was notified that the State no longer required this contract with the Village. The Village doesn’t bill Sunmount according to the same billing method that it uses for other Town customer. It is recommended that the Village and Town review the current billing practices to ensure that Sunmount is properly being billed for their water and sewer service, and to determine how best to deal with Sunmount as part of a water and sewer consolidation process. The Town of Tupper Lake does not have a Sewer Use Law that governs all of its districts; rather, the IMA suggests that Town water and sewer customers must comply with Village laws. To ensure that all districts are following the same standards and that those requirements comply with current requirements (Village’s State Pollution Discharge Elimination System (SPDES) 18 | P a g e

permit, stormwater interconnection issues, etc.) it’s recommended that the Town adopt a new town-wide sewer use law that is consistent with the 1994 New York State Department of Environmental Conservation (NYSDEC) Model Sewer Use Law and that supersedes any prior resolutions, requirements noted in district formation documents, etc. It’s also recommended that the Village’s existing sewer laws be reviewed and updated to be consistent with the NYSDEC Model Sewer Use Law. Water is managed in a similar fashion to sewer currently. The Town of Tupper Lake does not have a Water Use Law that governs all of its districts and the IMA suggests that Town customers must follow the Village’s water laws where applicable. To ensure consistency and enforceability of requirements, it’s recommended that the Town adopt a town-wide Water Use Law that supersedes any prior resolutions, requirements noted in district formation documents, etc. It is also recommended that the Village’s existing water laws be reviewed and updated to be consistent with current regulatory requirements and practices. The Town and Village do not have a single document to provide to homeowners or contractors that details the approval process for new connections and the standards that are required by the Village and Town for materials and construction. Developing such a document helps ensure consistency and that new connections are installed in accordance with the Village and Town requirements. The document also helps ensure that connection fees are well established, protocols are in place to collect fees to cover expenses associated with the review and inspection of new connections, that all new services are properly documented, and that work is performed by qualified personnel. It’s recommended that the Town and Village work together to jointly develop connection protocols for homeowners and contractors.

CONCLUSIONS

This concludes the first phase of the Town of Tupper Lake Water/Sewer District Consolidation Study: the Existing Conditions Report. This report is intended to give a comprehensive overview of the Town’s existing water and sewer infrastructure, administrative protocols in place to manage the infrastructure by district, and the cost of operating and maintaining the Town’s water/sewer infrastructure. The next step in the process is to explore more efficient ways of managing water and sewer districts through consolidation. Results will be documented in the Alternatives Report. There is grant funding available through the New York State Local Government Efficiency (LGE) program that provides financial and technical assistance to local governments for planning and implementation activities necessary for the reorganization of municipal governments, functions, and services. The Citizens Re-Organization Empowerment Grant (CREG) program assists local governments with consolidation and could provide funding of up to $50,000 for consolidation of water districts and $50,000 for consolidation of sewer districts. Additionally, the Local Government Efficiency Implementation program provides funding of up to $200,000 per municipality for consolidation of services. If the Village and Town were to structure a consolidation of Village and Town water/sewer services, $400,000 could be available through the NYS Department of State for implementation.

Be it enacted by the Town Board of the Town of A ltamo nt as fo llows: SECTION I STATUTORY AUTHORITY This local law is enacted pursuant to SECTION ry PURPOSE SECTION I . Use of Public Sewers Required. The Owner(s) of all residences, buildings or properties used for human occupancy, employment, recreation or other purposes, situated within the Town of Altamont and abutting any street or right of way in which there is now located or may in the future be located a public sewer line, is hereby required at the owner(s) expense to connect all toilet faci lities and other waste water facilities directly with such public sewer line, within ninety (90) days after such owner receives notice iTom the Town to make such connection. Owner(s) of properties with to il et or other wastewater faci lities located more than three hundred feet (300') from a pub lic sewer line may request a variance from the Town Board from the required connection , provided that such property has an on site sewage facility meeting New York State Department of Health standards. The Water/Sewer Superintendent of the Village of Tupper Lake sball be notified when the private sewer line is ready for its connection to the public sewer line. The connection shall be made under the supervision of the Superintendent or a representative within his department. SECTION 1. General discharge prohibitions. No person shall· make a connection of roof, down spouts, interior or exterior foundation drains or other sources of surface run off or ground water to a sewer line which is connected directly or indirectly to a public sewer line. No person shall discharge or cause to be discharged into the public sewer system any liquid or solid waste which could cause hann or have any adverse effect on the waste water treatment process or equipment, including gasoline, fuel oil or other flammable or explosive liquid, solid or gas; any solid or viscous

substances, any garbage that has not been property shredded, or any waste containing objectionable or toxic substances which are not amenable to trearment or reduction by the sewage treatment processes of the Village of Tupper Lake. SECTION 4 Authority of Inspectors. The WaterlSewer Superintendent of the Village of Tupper Lake and any other duly autborized employees of the Town or Village of Tupper Lake bearing proper credentials and idemification sball be permitted to emer upon private properties which are discharging waste into the public sewer system for tbe purpose of inspection and observation of the private sewer line, whether or not an easement bas been provided. SECTION 5 Any person fOlUld to be in violation of any provision of this loca l law shall be served with written notice stating the nature of the violation and providing a reasonable period of time for the satisfactory correction thereof. Any person who shall continue any violation beyond the time lim it provided shall be guilty of an offense, and on conviction shall be subject to a fine in the amount of not less than $300 .00 for each violation. The Town may enforce obedience to this local law by injlUlction . Any person violating any provision of this local law shall be tiable to the Town for any expense, loss or damage to the Town by reason of such violation. SECTION 6 Effective Date.This local law shall take effect immediately upon the tiling of the local law with the Secretary of State.

AGREEMENT This Agreement made this / day of ~. • 2005 by and between the VILLAGE OF TUPPER LAKE hereafter referred to as the «Village" and the TOWN OF TUPPER LAKE (formerly known as the Town of Altamont) hereafter referred to as the "Town", both municipal corporations located in the County ofFranklin, State of New York. WITNESSETH WHEREAS, the Village furnishes water and provides sewage collection service through its Municipal Water and Sewer System to customers located in various Water and Sewer Districts outside the Village and within the Town, and WHEREAS, the parties have previously entered into an Agreement dated September 10, 2001 with several Amendments, and the parties wish to consolidate said Agreement and Amendments together with other revisions. Prior to the formation of any additional Water andlor Sewer District or extension thereof, the Town shall notify the Village Board of Trustees of the Town's intention to create the District and the Town will provide the Village with the engineering plans and all other pertinent information. The Village will review the proposal and advise if the project is acceptable and will also advise if the Village collection or distribution system has the ability to accept the additional loading or demand, and if any improvements must be made to rhe existing systems. If the Village's response indicates an acceptance of the proposed project, it will be subject to final approval upon completion of construction.

create the District and the Town will provide the Village with the engineering plans and all other pertinent infonnation. The Village will review the proposal and advise if the project is acceptable and will also advise if the Village collection or distribution system has the ability to accept the additional loading or demand, and if any improvements must be made to the existing systems. If the Village'S response indicates an acceptance of the proposed project, it will be subject to final approval upon completion of construction. When an engineering finn is selected for the project, the Town shall notify the Village, which then shall become involved with the design of the infrastructure along with equipment and material used in the project. Before final design and going to bid, the Town shall provide written notification and engineering plans to the Village Board of Trustees. The Village must be satisfied with the design and grant written approval in a timely manner for the project to move forward, which approval cannot be umeasonably held . Being involved from the initial formation of a Water and Sewer District is critical as the Village will maintain both the equipment and infrastructure after construction is completed. Therefore, strict compliance with approval procedures and Village Code is required. Sewer service clean outs will be included in the design and installed by the contractor at the property line of each user. This allows for future access if a problem arises . The access port will also assist in the determination if corrective action may be required. Because the service laterals connections are installed during construction, the Village must have a means of monitoring when customer's services are activated. This can be accomplished by observation at the service access or cleanout. Pressurized water service laterals to undeveloped property in newly created Districts will be addressed with the project engineer in the design phase. Sleeves shall be installed under the roadway for future service line installation along with three point ties for later identification. These locations shall be recorded on the construction drawings. Future excavation would only be necessary in the shoulder area of the roadway leaving the driving lanes untouched when connecting a parcel with water and sewer sefVlce. Water and wastewater tapping fees shall be include in the bid price of each District in a lump sum amount. This is to be determined by the number of water and wastewater connections multiplied by the current Village tapping charges. Districts will comply with the Village of Tupper Lake Code, including but not limited to Chapters 40, 41 , 50 and any amendments or subsequent chapters.

When construction and inspection of the project has been completed, the Town shall notify the Village Board in writing. This written notification shall include a list of all property owners serviced along with a breakdown of capital improvements costs. The District shall then be added to this District Agreement by addendum. The Town shall provide the Village with copies of all maintenance manuals, design and as-built drawings for each District. The Town will provide the Village with a revised District boundary map to include new areas of expansion. 4.

PUMPING STATIONS

This section of the Agreement is for the major pumping facilities associated with the respective Districts. The Village Water and Sewer Department shall inspect and provide maintenance service to all water and wastewater pump stations within the several Town Water/Sewer Districts on a daily basis during regular hours at no additional cost to Town District users. Service calls to lift or pumping stations, which require overtime pay for employees, shall be charged to the respective District. Any and all power costs, replacement of pumping facilities or parts within the District shall be the full responsibility of the Town or designated District. When providing servicing and repairs, the Village Water and Sewer Department shall provide manpower only during regular working hours. Any other costs needed to complete maintenance and repair work shall be the responsibility of the Town or designated District.

All maintenance, repairs or replacement other then regular Village Department labor required for a District facility which are the responsibility of the Town shall be charged by the Town to the respective District and in tum charged to the property owners within the District as a benefit or other basis as set forth in the resolutions of the Town Board establishing the District. Under this Agreement the ViUage assumes no liability or ownership for any equipment or structure or such equipment or structure' s inadequate design or performance. When portable electric generator sets are required, the Town shall be responsible for operation, storage and maintenance of the generators for the respective Districts.

INVIDMJAL GRINGER UNITS

In the design stages it may be necessary to install individual grinder units in Sewer Districts along with low-pressure force mains to service some parcels. In the event the Town assumes responsibility for individual grinder units, the Town shall obtain all necessary easements or rights-of-way for these units. In addition, these units will be maintained by the Village of Tupper Lake Water and Sewer Department, provided they meet or exceed aU Village specifications for individual grinder pump units. All costs associated with the repair or replacement of these units including labor will be charged to

the respective District. This agreement pertains only to individual grinder units installed in the outdoor area on private property. The Village of Tupper Lake Water and Sewer Department will not be responsible for maintenance of units installed within the property owner's residence or other facility. 6.

WATER AND SEWER MAIN LINES

In consideration of the annual approved user rate paid to the Village, the Village Department of Water and Sewer agrees to maintain and repair all Water and Sewer main lines within the said Town Districts, and perform record keeping of all valves, manholes and line sizes relative to the operation of a collection and distribution system. All regular Department equipment expenses along with the manpower to make such repairs shall be the responsibility of the Village Department of Water and Sewer. All materials such as clamps, pipes and fittings, etc., used in the repair of Town mains shall be the responsibility of the respective District.

During maintenance or repair ofservice mains excess spoils must be removed and select material brought to the site. The first call will be to the Town of Tupper Lake Highway Superintendent and/or Deputy for assistance. In the event the Town Highway Department cannot respond, the Village of Tupper Lake Department of Public Works Superintendent will be contacted. Under this Agreement, the Village Department of Public Works shall remove or transport new material to the site. This department shall be reimbursed for all expenses oflabor, equipment and materials used . Labor will be charged according to the negotiated contract of Unit I. Equipment cost will be calculated by the formula used by the New York State Department of Transportation for rental, as adjusted from time to time. All expenses of District maintenance which are the responsibility of the Town shall be charged by the Town to the respective District and in turn charged to the property owners within the District on a benefit or other basis, as set forth in the resolutions of the Town Board establishing the Districts.

If attempts to secure the Village Department of Public Works for assistance fail, the Village Water and Sewer Superintendent or designated employees has the authority to contact an independent source to bring the materials necessary for this project. All expenses associated with the independent contractor shall be the responsibility of the Town and charged to the respective District. After the infrastructure pipeline is set to line and grade, backfill will consist of one (J) foot of special material installed and compacted along and over the pipe. Select backfill will then be used to fill in the remaining excavation to one (I) foot below grade. A minimum of 12" select of granular fill shall then be brought in and compacted to meet the existing road surface.

Lawn work and road shoulder work shall be roughed in to the existing grade. The Village shall not be responsible for maintenance of the ditch line, blacktopping of crossing, black dirt, seeding or any other related work associated with the finished or final grade. This shall be the responsibility of the Town or respective District.

In the event Village Water and Sewer personnel are called for repair or assistance and it is then determined that the problem was within the owner's property and therefore the owner's responsibility, the owner shall be charged for all time, material and equipment used at the site. When road crossings or edge work must be excavated, an authorized Village representative shall have the authority to cut the road without filing for permits or notification to any Town Department other than the emergency response agencies such as Fire, Police or Rescue. During the construction, an attempt shall be made to notifY the Town Highway Department of the work being conducted on or along Town roadways . The Village will provide scheduling of annual maintenance of hydrant flushing, painting, valve exercising and related work which shall fall under this maintenance Agreement. The Village will provide annual line cleaning along with vacuuming of lift station wells and collection system manholes which shall be part of this maintenance Agreement. The Village is only responsible for providing the manpower and regular equipment for the repair of mains. Any upgrading or extensions of these lines are the responsibility of the District. Any main which requires upgrading because of developmental needs, inferior design or improper installation shall be upgraded at the expense of the respective Districts. No upgrading or expansion of the present water or sewer mains shall be conducted without prior notice and consent of the Village. Any new construction of a District facility or infrastructure shall be conducted under the supervision and approval of a New York State Licensed Professional Engineer and shall also be subject to such approvals as may be required of the New York State Department of Health, Department of Environmental Conservation or any other agency with jurisdiction. The Town work force shall not install any water and sewer related facilities without the use of full-time field inspectors agreeable to both parties. The Village shall not be liable or held responsible for any work conducted without their consent. No connections of cellar or roof drains shall be allowed to connect to the sanitary main. The Town must provide an access point for the property owner to discharge groundwater. This is covered under Village Code Book Article IV, Building Sewers and Connections, Section 40-21 entitled "Prohibited Connections".

INSTALLATION OF WATER AND SEWER SERVICE LATERALS

The Town will be responsible for the installation of water and sewer lateral lines within the District, from the main lines to the property line of the property owner in the District. All such costs shall be the responsibility of the respective district. All service lines and other water and sewer facilities within the private property lines shall be the responsibility of the owners thereof. The Village will provide connections for water and sewer service to new homes or other facilities within the Districts and shall charge to the property owners the set charges therefore, unless such charges were incorporated into the District formation. The Town shall not cause any additions, expansions or extensions to the present Water and Sewer System except those set forth in the original engineering plans for each District, without prior written notice to and consent of the Village. Charges for individual connections shall be paid to the Village of Tupper Lake prior to any work order issued for this service. The following shall be the owner's responsibilities for connections to service laterals extending from the owner's property line to the Town road or easement; a. The Village Superintendent or authorized representative must be present when the connection is made to water or sewer utilities. b. It will be the owner's responsibility to make the necessary arrangements with the contractor and Village to schedule this work. c. No inspections will be performed outside the designated working hours of the inspector unless other arrangements and costs are agreed upon. d. Safety precautions, such as barricades and lights if necessary, must adequately guard any open excavation. e. Owners with private wells that will still be utilized shall have no interconnection between the private well and the Village water supply. f. Final inspectioilS"will be conducted by Village authorized personnel after residents have connected to insure there is no risk of cross connection. 8.

MAINTENANCE OF WATER AND SEWER SERVICE LATERALS

In consideration . of the user rate paid by the owners within each District established by the Village of Tupper Lake, the Village water and Sewer Department agrees to maintain a record of curb stop locations and sanitary access (cleanout) locations. These records shall be updated when necessary and kept on file for future reference. Village personnel will locate curb stops along the tum ofl7on services for the determined charge

set forth in the Village Code Book 50-12. On site locations of property owner's service laterals to assist contractors will be provided by the Village when possible. The Village Water and Sewer Department will be responsible for the maintenance and repair of newly installed and existing service laterals provided they comply with Village specilications. The cost of materials for repair or replacement of service laterals (from the main to the owner's property line) shall be assessed to the Town or respective district. The Village Water and Sewer Department will only supply labor and machinery costs. During maintenance or repair of service laterals, excess spoils may need to be removed and select material brought to the site. The same provision shall apply as set forth in paragraph 6 of this Agreement regarding water and sewer main line repairs. 9.

WATER AND SEWER RATES

The Village may charge customers within such Water and Sewer District at such rates for its services as the Village may from time to time establish, including penalties and interest. The Village shall bill such customers directly. The Town designates the Village as its agent to collect such charges and agrees that the Village may retain the proceeds thereof for the services of the Village to such customers. The Village may charge the Town with the amount of any delinquent water and sewer accounts from time to time, but not less than once a year, together with any reasonable collection costs incurred, and the Town agrees to reimburse the Village for such amounts. The Town shall thereupon assess such delinquent charges and costs to the appropriate tax assessment roll pursuant to the Town Law of the State of New York. 10

TERM OF AGREEMENT

The Village will continue to accept into its sewage collection system and inceptor disposal system, public sewage from all legally connected customers within the District specilied in the Agreement, as now and hereafter amended, for a period of thirty years from the date hereof, and continuing for the term of any bonds issued by the Town on behalf of any Sewer District for the installation of improvements. The Village will continue to supply excess municipal water for all legally connected customers within the Water Districts specilied in this Agreement as hereafter amended, continuing if available for the term of any bonds issued by the Town on behalf of any Water District for the installation of improvements. Provided that, in the event of a drought emergency causing tbe possibility that all customers receiving water service within the Village and Town Districts cannot receive an adequate supply of water, the Village may discontinue service to all District customers. In the event the Village terminates its obligation to provide maintenance services within the Districts or any portion thereof upon, upon the termination of this Agreement,

. the Town will provide such maintenance service and the customers within such Districts will pay the cost thereof by appropriate assessments to each customer as provided in the

resolutions and orders establishing such Districts. II.

PRlOR AGREEMENT AND AMENDMENTS

This Agreement supersedes all previous Agreements between the parties with respect to the Districts specified herein, together with all amendments thereof. Basis for rental charge: The sewer rental charge will be based upon the consumption of water on the premises cOlmected with and served by the sewer system or upon the type of premises being serviced by the sewer system on a flat-rate basis. Charges will be made for each family unit or each business establishment within each building. Billings for multiple-family dwellings will be on the basis of each family unit. One or more persons using or operating a cook stove upon which their food is prepared shall be considered a family unit. A business establishment is any individual, finn, corporation or association regularly established and doing business under the laws of the State of New York.

The following rates are established for that portion of the sewer system within the corporate limits and for that portion of said system outside said corporate limits for premises upon which a water meter is installed: a sum equal to 176% of the water metered charge of the flat rate indicated in Subsection A above if the flat rate is higher than the metered rate.

A charge 0[$265.00 will be made for each new connection to the system and shall be billed as a separate service. Period of rental; penalties for late payment: Sewer charges shall be billed monthly. service will be made from the time the tap is made to the sewer main until the location is destroyed or ceases permanently to take service. A penalty of 1 Vz will be added if such charges are not paid in full within 30 days after each billing date.

Rents to constitute a lien: Sewer rents constitute a lien upon the real property served by the sewer system or such part or parts thereof for which sewer rents shall have been established and imposed. The lien shall be prior and superior to every other lien or claim except the lien of an existing tax, assessment or other lawful charge imposed by or for the state or a political subdivision or district thereof.

Collection authority: Collection of the sewer rents will be made pursuant to § 452 of the General Municipal Law.

Disposition of rents: Revenue derived from sewer rents, including penalties and interest, shall be credited to a special fund, to be known as the "Sewer-Rent Fund." The monies in such fund shall be used pursuant to § 451 ofthe General Municipal Law.

§ 41-8

Definitions: The terms "sewer rents," "sewer system," "part," "sewage," "industrial waste" and "other wastes" shall mean as defined in § 451 of the General Municipal Law.

§ 41-9

Severability: If any clause, sentence, paragraph, section or part of this local law shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair or invalidate the remainder thereof, but

shall be confined in its operation to the clause, sentence, paragraph, section or part thereof directly involved in the controversy in which such judgment shall have been rendered.

Effective date:

This local law shall take effect on August 1, 1996 at 12:01 am of said day.

Installation of Check Valves Required for Sanitary Sewer Comiectiori Legislative Intent The purpose of this Local Law is to safeguard the health and property from potential contamination by preventing backflow from a user's connection to the mtinicipality's sanitary sewer line. Applicability This Local Law shall apply to all installations of backflow prevention assemblies related to connections to the municipality's sanitary sewer line, regardless of whether the coimection or assenibly is located within the Village limits, and regardless of whether the connection or assembly is for all businesses, dwellings, or other customer or user of the municipality's sanitary sewer system. ' Definitions "Backflow" means the reversal of flow of water and other substances from the sanitary sewer lirie system to the customer's service connection. "Check valve" means a valve that seats readily and completely to completely cease the flow of sewer material. Each check valve must be carefiilly machined to save free moving parts and assure; water tightness, permitting no leakage in a direction reverse to the normal flow. The face of the closure element and valve seat must be of bronze composition or other noncorrodible material vvhich will seat tightly under all prevailing conditions of field use. Pins and bushings must be of bronze or other noncorrodible, nonsticking material, machined for easy, dependable operation. : . . "Grade" means the lowest elevation level at which the ground surface meets the foundation ofa .. building, structure or other enclosure havirig piuinbing facilities. "Service connection" means the terminal eiid of a service connection from the mimicipality's sanitary sewer line (i.e. where the Village loses jurisdiction and control over the sewer line at the point of delivery) to the customer. ' Installation Requirements (a) This Local Law shall apply to all new service connections and to all existing service • connections requiring repair or replacement. (b) All customers having new plumbing facilities, or those facilities requiring repair or replacement at the service connection, located below grade and required to connect to the municipality's sanitary sewer line shall be required, at their sole cost and expense, to install a check valve on the sanitary sewer line at the service connection point prior ; to the initiation or reestablishment of service.

(e) (d)

Clean-out access vwlll be required on each side of the check valve to allow for service, maintenance and inspection of both inflow and outflow from the check valve. It shall be the duty of the customer on any premises on aiccoiint^^^ valve protective devise is installed, to have a competent inspection to insure the proper operation of the device. Devices shall be repaired, overhauled or replaced at the expense of the customer whenever they are found to be defective.

Enforcement , (a) The Code Enforcenient Officer for the municipality having competent jurisdiction shall be responsible for enforcing the requirements of this Local Law. (b) No cormection to the municipal sanitary sewer line shall be installed or maintained : unless the backflowjprevention is installed in accordande with this Local Law. • Failure to install the backflow prevention device within the prescribed timeframe established by the Cbde Enforcement Officer may result in the termination of service. (c) The Code Enforcement Officer shall be permitted to make periodic inspections to verify that the check valve assembly is installed, maintained and operating in a manner in accordance with this Local Law. Effective Diate - . This Local Law shall take effect upon filing with the New York State Department ofState.
