FirstFACTS Landfill law changes

Adjustments made on private landfill ordinance Elbert County’s commissioners held a first reading for changes to the private landfill ordinance during a public hearing on Monday at 5 p.m. and then held the second reading and passed the ordinance during the regularly scheduled meeting just 30 minutes later. Changes to the ordinance now require commissioners to consider additional factors in approving a private landfill. Some of those factors include: 1) Will the private disposal site be located on a state highway for ingress and egress thereto, and would the private disposal site create traffic through any primarily residential areas? 2) Is access into and out of the property adequate to serve the proposed special use, to provide for traffic and pedestrian safety, the anticipated volume of traffic flow, and to allow access by emergency vehicles? 3) The proximity to any corporate limits of any municipality; 4) The proximity to any lakes, rivers or state waters; 5) Is the site located within one mile of any water supply well; 6) Will the site be injurious to the Elbert County environment? 7) The proximity to any historical or cultural site; 8) Would the site be detrimental or injurious to the enjoyment, use or development of adjacent properties or general neighborhood? 9) The proximity to any state or local parks or recreation areas; 10) The proximity to a residential area, church or cemetery; 11) Will the private disposal site or related handling facility be closer than 500 feet from the interior boundary lines of the subject property? 12) Will the site interfere with the natural flow of surface waters to the detriment or damage of adjoining or nearby properties? 13) Will the special use be a hazard or

THE ELBERTON STAR nuisance because of the number of persons who will attend or use the facility, vehicular movement, noise or fumes generated, or type of physical activity? 14) Would the special use adversely affect the existing uses or property values in the vicinity of the special use? 15) Is the parcel to be used of sufficient size to satisfy the space requirements of the use? 16) Are public facilities and infrastructure adequate to serve the proposed special use? 17) Are the areas of operation properly screened to protect other properties in the area from such adverse effects as noise, fumes, noxious odors, light glare and other negative impacts? 18) Will the hours of operation of the special use have adverse impacts on other properties in the area? The ordinance became effective immediately after the vote on Monday night.

On Sept. 16, 1981, welterweight boxer “Sugar” Ray Leonard knocks out Thomas Hearns in the 13th round to unify boxing’s middleweight title. Leonard was behind on all three judges’ scorecards and fighting with one eye closed when he delivered a right hand to his opponent’s head that sent Hearns crashing to the canvas. Leonard, 25, entered the fight as the World Boxing Council’s (WBC) welterweight champion with a record of 31-1, while Hearns, 22, was 32-0 with 30 knockouts and held the World Boxing Association (WBA) belt. On the day of the fight, 25,000 spectators packed a hastily built outdoor arena at Caesar’s Palace casino in Las Vegas to watch the two champions battle it out in 100-degree heat. By the 13th round, Hearns was dictating the fight to a nearly half-blind Leonard. Suddenly, Hearns fell to the floor, the victim of what Pearl ruled a push by Leonard. Soon after, Hearns went down again after a right hand from Leonard, but Pearl again ruled this meeting with the canvas the result of a shove instead of a knockdown. The next time Hearns went down, it was the result of a flurry of Leonard punches to his head, which sent “The Hitman,” as Hearns was known, through the ropes. Leonard finished off Hearns in the 14th.
