CONSENT AGENDA (ITEMS 1-2) The following items will be passed by a single motion to approve all listed actions and resolutions. There will be no discussion on these items unless requested by Council. 1. FIRST AMENDMENT TO MAIN PLACE PARKING GARAGE LICENSE AGREEMENT AND PARKING AND ESTOPPEL AGREEMENT (Staff Report 084-12)
Summary The City of Vancouver and Main Place of Vancouver Limited partnership (MPLP) entered into a Parking License Agreement (PLA) for the use of the Main Place Parking Garage. The term of the lease commenced no later than December 31, 1991, for a 20-year period. The Parking License Agreement has been renewed by MPLP or assigns for an additional 20-year period until 2031 so long as the City of Vancouver owns the garage. MPLP has transferred all of their rights and obligations to MPLP2. Main Place Partners are refinancing the adjacent office building at 1111 Main Street. To close the refinancing, a Parking Estoppel and Agreement to benefit MPLP and their lender is necessary. Action Requested: Approve the Parking Estoppel and Agreement and authorize the City Manager or his designee to sign the agreement. (Mike Merrill, Parking Services Manager, 487-8658) 2. 3. CONSUMER FIREWORKS REGULATIONS (Staff Report 083-12)
AN ORDINANCE relating to the use or discharge of legal consumer fireworks, adopting changes to VMC 16.30.050 that reduces the number of days when personal consumer fireworks can legally be sold from seven (7) days to three (3) days and legally be used from four (4) days to one (1) day beginning in 2014; providing for savings, severability and an effective date. Summary The City of Vancouver currently allows the sale of personal consumer fireworks within the city limits for seven (7) days from June 28-July 4 and the use of personal consumer fireworks for four (4) days from July 1-4. Many of the fireworks stands are operated by non-profit organizations that use the proceeds to fund operating expenses, special projects and other charitable work. Each year, the City receives complaints from citizens who are upset by the noise, litter and pollution associated with the use of

consumer fireworks. This proposed ordinance change would reduce the days that fireworks can legally be sold to three (3) days, July 2-4 and would reduce the days that fireworks can legally be used to one (1) day, July 4. The Revised Code of Washington and the Washington Administrative Code require 365 days’ notice for changes in the fireworks ordinance so this reduction in sale and use days would go into effect in 2014. With new restrictions on sales and use, the Fire Marshal’s Office and Vancouver Police Department recommend a stepped-up education campaign and enhanced enforcement for at least the first two years, especially given that it appears the County will continue with a longer sale and use period. If the ordinance is adopted, $10,000 for fireworks education and enforcement will be included as a decision package in the 2013-2014 General Fund budget, to be used in 2014. The 2015-2016 budget will also include $10,000 for education and enforcement in 2015.
