BIRTCHER/EASTGATE DEVELOPMENT AGREEMENT AMENDMENT
Summary In 2003, the City Council approved a Development Agreement that allowed for commercial development of property located at the southeast corner of Fourth Plain and 137th Avenue. The United States Army acquired a portion of the area subject to the original Development Agreement which the Council released from its terms in 2009. That portion has been developed as a training center. The remainder of the site has not been developed because changes in economic conditions have made development infeasible due to the cost of offsite improvements required under the Development Agreement. 1. AWARD OF BID FOR CONSTRUCTION/REMODEL OF 415 W. 6TH STREET BUILDING (Staff Report 025‐11)
Summary The City of Vancouver advertised for bids to improve the recently purchased Class A office building at 415 West 6th St. The General Services Department in collaboration with GBD Architects and PAE Consulting Engineers have completed planning and construction documents to accommodate administrative offices for multiple City departments within the newly purchased building (known as the 415 Restack project). The building will provide customer service operations, a new Permit Center and a large multi‐use meeting space on the ground floor. The second floor will accommodate a new Council Chambers, City Manager and CVTV offices. Other City departments will occupy the 3rd and 4th floors and a CVTV production studio will be constructed in a vacant space on the 6th floor.
This project was competitively bid on March 3, 2011. The engineer’s estimate of anticipated cost for constructing this project based on the bid documents presented to bidders was $2,144,264. The bids include six alternates providing maximum flexibility to meet budget. Seven bids were submitted with the following result reflecting all bids (including alternates within the total bid pricing):

Sufficient budget for this construction contract was adopted in the November 2010 Capital Budget. The remaining budget will be requested to be carried forward into the 2011‐12 Capital Budget in the Spring of 2011 Supplemental.
Action Requested Authorize award of this construction contract for improvements to the 415 building (future City Hall), to the lowest responsible bidder, Skyward Construction, of Ridgefield, Washington, in the amount of $1,766,088.01 (price includes six alternates and Washington State Sales Tax). 2. REJECTION OF BIDS FOR THE PURCHASE OF SUBMERSIBLE PUMPS FOR ANDRESEN HIGH HEAD PUMP UPGRADE (Staff Report 026‐11)
Summary The City has obtained funding under the Energy Efficiency and Conservation Block Grant (EECBG) from the U.S. Department of Energy (DOE), which is an allocation of federal funds under the federal stimulus funding program (ARRA) to state and localities of a certain population size for energy use. The City obtained an allocation of $1,574,800.
One of the projects approved by the DOE was based on the City’s proposal to replace a wastewater lift pump at Andresen Pump Station. The existing pumps clog with rags and other solid materials within hours and thus run inefficiently. The new pump has a non‐clogging volute and impeller design that is better suited for domestic wastewater, and will operate more efficiently than the existing pumps. Because the new pumps will not clog, they will run efficiently, and save 200,000 KWH per year. Additionally, the new pumps will save labor and costs associated with maintenance “de‐ragging” which is completed every two days.
The City of Vancouver advertised for bids to purchase the equipment identified in the proposal to the DOE. This project was competitively bid on February 22, 2011. The Engineer’s estimate of anticipated cost for this equipment based on the bid documents presented to bidders was $190,000.00. Two bids were submitted with the following result reflecting all bids:

After bid opening it was determined that the apparent low bidder had provided a request for substitution of equipment. The timing of the substitution request did not provide for adequate time for staff to review the proposal to determine if the proposal would appropriately meet the needs of the project as well as the requirements of energy savings specified with the EECBG requirements.

Since no award of bid is proposed, there is no immediate budget impact; however, there is sufficient budget for this project through the adopted 2011‐2012 Budget funded by the EECBG.

3. REZONE COVENANT AMENDMENT FOR 192ND STATION INVESTORS LLC (Staff Report 027‐11)
AN ORDINANCE relating to planning and zoning; approving amendments to a recorded covenant related to a prior concomitant rezone of property in the City of Vancouver at SE 192nd Avenue between SE 15th and SE 20th Street; amending Ordinance M‐3705 (part); providing for severability; and establishing an effective date.
Summary In 2005 a covenant running with the land was adopted and recorded as part of a rezone from R‐ 18 to CC. Development standards similar to the standards found in a mixed‐use development were imposed on a 6.2‐acre site on the east side of 192nd Avenue between 15th and 20th Streets.
A public hearing was conducted by the City of Vancouver Hearings Examiner and preliminary site plan approval was granted on March 28, 2006.
The applicant has obtained pre‐leases for approximately 80% of the site requiring a re‐design of the site plan layout previously approved. A modified site plan will be submitted for review by staff after a decision regarding this covenant amendment request has been issued.
There will be no impacts to the City budget created by the adoption of the proposed ordinance.
