Over the past decade, the financial services industry in Malta has worked hard to establish itself as a trust jurisdiction worthy of serious consideration due to its comprehensive regulatory and legal framework, the expertise of service providers, the tax environment and its judiciary. The Trusts and Trustees Act has and keeps providing a commendable platform for the creation of different forms of trusts (and foundations) and for the adequate authorisation and supervision of trustees. The trust vehicle is an important alternative to the traditional concepts we are used to work with and it is not to be underestimated in its validity or effectiveness. Whilst making sure that the most salient definitions are well understood, the aim of this seminar will outline the different aspects and mechanics of the Act, highlighting the most important features in the creation, life-time and eventual termination of a trust.
