APPLICABLE GENERAL PLAN SECTIONS ANALYSIS As part of the Lehi City annexation procedures, all annexation requests are required to be reviewed by the Planning Commission. The Planning Commission’s responsibility is to review the proposed annexation and determine whether or not the requested zoning is appropriate and complies with the General Plan. The Planning Commission’s recommendation will be forwarded to the City Council for their review upon final consideration of the annexation. The General Plan designates this property as Low Density Residential (LDR). The proposed R-1-8 zone is not consistent with the Low Density Residential (LDR) General Plan designation. As per the DRC comments, the applicant will need to apply for the R-1-Flex zone in receive zoning that is consistent with the General Plan. The LDR designation may only allow the R-1-8 zone on properties which are bordered on at least three sides by existing R-1-8 zoned properties. The applicant has indicted that the owners will continue to use the property for residential and agricultural purposes with the intent to develop one additional home on this property. The DRC also recommended that a TH-5 zoning be granted for the main area of the parcel with an R-1-Flex zone applied to the smaller area proposed for development of a new home. The DRC made an additional comment that the applicant is required to pay for the purchase of the Rocky Mountain Power infrastructure which serves this parcel. This annexation is being done by resolution because the property is part of an existing county island. Water dedication is required for all areas to be zoned RA-1 and will be required in order for the annexation to record. RECOMMENDATIONS Planning Division staff recommends a POSITIVE recommendation to the City Council for R-1-Flex and TH-5 zones on the Moon Meadows B annexation. This recommendation is based on the following findings: 1. These zones are consistent with the LDR designations on the General Plan Land Use Map. 2. The proposed application conforms to the goals and policies of the General Plan. 3. The proposed application does not affect the health, safety, welfare, and morals of the City. 4. Other findings as determined by the public hearing.

Critical Issues: Annexation agreement will be required as a condition of recording the annexation plat – as a part of the agreement. As a condition of recording the annexation plat, and prior to the preliminary subdivision application being scheduled for Planning Commission, the owner/developer needs to complete the required water dedication for the R-1-Flex Zone. For the R-1-Flex Zone, the rate is acre feet per acre of culinary water and acre feet per acre of irrigation water. 2.

GENERAL COMMENTS: 1. Rocky Mountain Power customer on this parcel. RMP will require purchase of this service upon annexation. All RMP costs will be paid by developer. 2. Recommend TH-5 zoning on the main area of the annexation. The smaller remaining area proposed for development of a new home would need to be zoned R-1-Flex instead of R-1-8 as per the General Plan. Only properties that are bordered on at least 3 sides of existing R-1-8 qualify for the R-1-8 Zone. THIS ITEM WILL BE SCHEDULED FOR CITY COUNCIL ON MAY 10, 2016.
